NARRATIVE On Thursday, July 28, 20l l, Investigator Jeff Diez observed information, via the internet, of a planned protest of BP(British Petroleum) New Orleans of?ce, located at 1250 Poydras Street New Orleans, LA. On August 1, 201 l, I,Trooper Amell Garner, contacted the New Orleans Police Department. It was con?rmed that a group called Gulf Change had contacted NOPD and advised them of a planned protest of the BP of?ce building, from the hours of 5pm to 8pm. lnfonnation was gathered, in an effort to ?nd out more about the individuals and/or organizations attending the protest. The organizers of the protest were identi?ed as Cherri Foytlin, Kindra Amesen, Karen Harvill, Linda Leavitt, and Elizabeth Cook. Foytlin Is the co-founder of Gulf Change She has an online blog, - . ,which exhibits concem about coastal and wildlife Issues, especially birds Foytlin believes that BP should pay for the health bene?ts of those people who live near the oil spill. Kindra Amesen Is a shennan 5 wife ?om Venice, LA. She believes that there are serious health issues arising from the spill. Karen Harvill is from Waveland, MS and she describes herself as an illustrator, musician environmental activist and green advocate. Linda Leavitt is from New Orleans, LA. She is interested in environmental concerns especially oil related. Elizabeth Cook is an activist who resides in the New Orleans area and has been involved in numerous protest in New Orleans. Cook belongs to a group called "The Emergency Committee to Stop the Gulf Oil Disaster". On August 2, 201 1, l, Tpr. Garner and Sgt. Chavez Cammon contacted Cherri Foytlin. A meeting was scheduled for August 3, 201 1, at 200pm, to discuss the expectations, concerns, and safety of the protest. On August 3, 20l l, at approximately 2pm, I, Trooper Garner along with Sgt. Cammon, Lt. Lamar Davis, and Trooper .lustin Ben'y met with Cherri Foytlin and Karen Savage. Both ladies advised that their organizational mission is to bring about attention to the issues affecting the Gulf South. They further advised that they want to bring this change through positive interaction. The meeting was called in the interest of public safety, due to the past interaction between BP and protestors where multiple arrest were made. The meeting was an attempt to bring emphasis to safety and adherence to private property designations. Sgt. Cammon advised the ladies of the rules and regulations they will be expected to follow. It was emphasized that the protestors were not allowed to cross onto private property, but they had to remain on the sidewalk area, which was public property. Both ladies were clearly advised that they must not cross onto the portion of the sidewalk that was private property, are they would be arrested for trespassing. Foytlin showed some excitement at the thought of being arrested and asked further questions regarding the subject. Although, the excitement regarding the idea was exhibited or expressed, she stated that she understood the rules of the protest and that they would abide by those rules.They also advised that they received con?rmations ?'om 150 people and that they were expecting 155 additional participants. However, the 155 additional could not be con?rmed. On August 4, 201 1, at approximately 515pm, Cherri oytlin ignored the orders previously given her by LSP and NOPD supervisors, and crossed onto the business private property and began attempting to go inside the building. Foytlin refused to move and sat down in front of the door of the of?ce building. Approximately eight others sat down on side of her and began to speak against BP. The subjects stayed in that position the duration of the night. At approximately 8 0pm, the subjects were asked numerous times by New Orleans Police Department to leave the premises. Three subjects re?ned to leave the premises and was arrested by New Orleans Police Department. The subjects were Cherrie Foytlin, Noah Learned, and Kyle Nugent. St. John Sheriffs Of?ce, would assign their Special Operations Division personnel to attend the protest in plain clothes and also alert their uniform division in the event of any safety issues. I arrived at 200 Regala Park in Gramerey, LA for approximately 1700 hours, 1 1/16/17. This is the site of tonight's public hearing by the Louisiana Department of Environmental Quality. The facility at 200 Regala Park Dr. is a Public Gymnasium located near the Mississippi River in St. John Parish. The Department of Environmental Quality set up a forum in which speakers in support, and those in opposition had 8 minutes each to address the board. There were approximately 6 speakers. speaking in opposition. that represented various environmental protest groups. There were no issues during the meeting. Those that spoke were respectful and only required moderate corrections ?'om the BBQ staff running the meeting. The only media present appeared to be a print media photographer.
