BY AUTHORITY 1 2 3RESOLUTION NO. 18-0813 COMMITTEE OF REFERENCE: 4SERIES OF 2018 FINANCE & GOVERNANCE 5 6 A RESOLUTION 7 8 9 10 11 12 Amending the Denver City Council Rules of Procedure to provide for a censure process. WHEREAS, § 3.3.2 of the Charter authorizes the City Council to make rules governing its 13procedures; and 14 WHEREAS, Sec. 13-11.5 (a)(2), D.R.M.C., provides that the Council may adopt or amend 15its rules of procedure by resolution. 16 17NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY AND COUNTY OF 18DENVER: 19 20 Section 1. The Denver City Council Rules of Procedure shall be amended to add a new 21Rule 9.7 as follows: 22 23 Rule 9.7 Censure 24Censure is a disciplinary procedure that may be imposed upon a member of the Denver City Council for 25violating the Denver Charter, Denver Revised Municipal Code, or an officially adopted Council policy, in 26accordance with the following process: 27 28 (1) Any member of City Council may request a censure resolution. (2) If requested by a councilmember, the Clerk of Council (“clerk”), in consultation with legislative 29 counsel, must prepare the censure resolution. The resolution may be accompanied by any reports for 30 the City Council agenda for the next council meeting. The clerk must provide the reports to the 31 32 councilmember who is the subject of the censure before he or she places the resolution on the agenda. (3) At the meeting, any councilmember may move to adopt the censure resolution. After the motion is 33 moved and seconded, the council may discuss the censure resolution. Following the discussion, the 34 councilmember subject to the censure may rebut or otherwise comment on the resolution, for a time 35 not to exceed ten minutes. Following the rebuttal, other councilmembers may respond to the rebuttal 36 or otherwise comment, for a time not to exceed five minutes per member. Following the response 1 2 1 1 period, the council shall vote on the censure resolution. Ten affirmative votes are necessary to pass the 2 3 resolution. (4) If a member of City Council offers an amendment that amends the censure resolution, that amendment 4 must also be subject to debate.
