Case No. IN THE MAGISTRATE COURT OF Calhoun COUNTY, WEST VIRGINIA CRIMINAL COMPLAINT (CONTINUATION PAGE) On Wednesday, April 19, 2017, at approximately 2230 hours, S/Trooper N. S. Stepp, hereafter referred to as this trooper, was conducting stationary patrol at the intersection of US ?11.33 and WV Rt. 16111 Millstone, Calhoun County, West Virginia At this time, this trooper noticed 11 blue' in color 1996 Chevrolet Cavalier, bearing WV-Registrati on WM 65, traveling cast on US Rt 33, diaplaying a defective registration light. This trooper then activated the emergency lights in efforts to initiate a traf?c stop at this location on the target: -vehicle. The target vehicle then turned north on WV Rt.16 and began to travel Grantsville. . This trooper follOWed the target vehicle, with the emergency lights activated, for approximately 7 tenths of a mile, when the terg'ot vehicle darted left onto Daniels Run Road and began to travel at a hight rate of speed At this time, this trooper contacted the WVSP South Charleston Dispatch and advised that this trooper was in pursuit of the target vehielii; Alter traveling approximately .3 tenths of a mile, the target vehicle was attempting to negotiate a left hand curve and the roadway and lost control of the vehicle and crashed into a ditch This trooper then gave the driver ofthe target vehicle, who was eventually identified as Joshua Michael Settle, numerous commands to exit the vehicle. After exiting the vehicle, this trooper attemIited to restrain him to effect the arrest, at which time Mr. Settle began to resist this trooper. This trooper gave Mr Settle countless number of verbal commands to stop resisting this trooper and to comply With the commands After physically ?ghting with Mr. Settle for approximately fifteen (15) minutes, this trooper was eyentually able to get him under and secure him in restraints. During the strenuous ?ght, Mr. Settle strticlc this trooper Se?v?cral times with his ?sts; Mr Settle even attempted to disarm this troopers 31. While grappling with him, Mr. Settle was able to success?illy unclasP this trooper' holster and was pulling on the handle of this. 1:13? trooper' pistol-.11 should also be noted that during the struggle, Mr. Settle rip this troOp er?s lapel and the front ofthis troopers shut . . Due to him having been transported to CAMC General for treatment of non life threatening injuries, Mr. Settler was then occasioned to the South Central Regional Jail to housed until the Calhoun County Magistrate Court resumed session. aahould be noted that Mr. Settle was in police custody while receiving medical treatment at CAMC General and was transported to South Central Regional Jail after being released during the early morning hours of Thursday, April 20, 2017.
