Plaintiffs Motion for a Preliminary Injunction came before the Court on April 28,
2015. Plaintiff appeared by and through Assistant City Attorney Ben Miller. Defendants
appeared by and through their attorneys Bill Miner and Harvey Korrell. The Court,
having heard argument, ?nds as follows:

Based upon stipulations put onto the record from defendants, the City has
withdrawn its Motion for Preliminary Injunction. Those stipulations were: (1) Uber
agrees not to appeal the hearing of?cer?s 4/4/15 decision determining that the current city
code applies to Uber, and (2) Uber has stopped operating in the city and will not resume
operating in the city until Uber receives the city?s permission or Uber complies with any

future ridesharing legislation adopted by the Oregon Legislative Assembly that preempts

NOW, THEREFORE, IT IS HEREBY ORDERED that the City?s Motion for
