We appreciate that you have raised these matters with us. As you know, the Company has a firm policy prohibiting conduct that contributes to an uncomfortable or inappropriate work environment. All such complaints are therefore taken seriously. If the Company determines in good faith that inappropriate conduct has occurred, then the Company will take effective remedial action commensurate with the severity of the offense; appropriate preventive action also will be taken. In addition, SolarCity takes seriously the right of employees to bring concerns forward for investigation, without fear of retaliation or reprisal. Retaliation against any employee for raising a concern in good faith, or for participating in an investigation, is prohibited; individuals who undertake such retaliation are subject to disciplinary action up to and including immediate dismissal. Similarly, any interference, intimidation or retaliation directed toward at any individual who has made a complaint in good faith, or who has cooperated with the investigation, is prohibited. As a result of your complaint, we conducted an investigation, which includes interviews with you and others, as well as various evidence. The Company considers its investigation closed. Should additional or new information become known or available, the Company reserves its right to re-open its investigation. While we are unable to share specific details with you, we are confirming the following findings: - There is no evidence that you were improperly denied business cards, laptop bags, or access to the office printer; - Although your claim that Susan Beckum twice texted you a photo of Erin in her underwear and Susan referred to Erin as “pipes and panties” was substantiated, the investigation uncovered that in this timeframe and prior to your falling out with Susan, you and Susan exchanged numerous sexually suggestive or explicit texts on your personal cell phones; - As for your claim about expense reports and mileage, our investigation confirmed that these expenses were legitimate and verified; and - As for your allegation that a co-worker falsified information in order to log a CW, we verified there was indeed a valid contract signed by the customer. In addition, you confirmed that the matters about which you complained are not ongoing and that you have noticed a significant improvement. The investigation revealed a couple of areas of concern. All communications including those on a personal phone you use for work purposes must comply with our policies, including our Non-Harassment and BYOD policies which are available on The Grid. Again, we thank you for raising these concerns as well as giving SolarCity a chance to demonstrate its strong commitment to maintaining an appropriate workplace where it is safe and acceptable for employees to raise concerns in good faith. Feedback from our employees provides an opportunity to improve communication, understanding, and processes.
