DECLARATION BY RAMON MERCADO: I, the undersigned, declare: I am the Defendant in this matter. I have reviewed the police reports in this matter. I have noticed factual misstatements and untrue statements contained in the police reports in this matter, authored by Los Angeles County Sheriff?s Department deputy James Peterson (#447537). On November 08, 2016, the day of this incident, I was driving a car that belonged to an acquaintance. was pulled over by a Los Angeles County Sheriff?s Deputy when I was driving southbound on Interstate 5. The Deputy that pulled me over was James Peterson. What Deputy Peterson said in his police report is not true and factually incorrect. Speci?cally, the statement in the Deputy?s report which states I told him the car was mine is untrue and I never told him the car was mine. The car was not mine, it was not registered to me and it was borrowed by me, from someone else. Next, the line in the report where the deputy states that I told him twice the car was mine is untrue. The line in the report that states the vehicle was void of luggage/personal items for driver or passenger is untrue. We had luggage in the back seat of the car. Likewise, where the of?cer states that the luggage was most likely a prop is absurd as I told the of?cer I was driving my father to Southern California so he could catch a plane back to his native Mexico. Motion for pre?trial discovery -8- informed and believe that the foregoing is true and correct to the best of my knowledge under penalty of perjury. Executed on this day of 2017, at California.
