May 4, 2016 MEMORANDUM TO: Chief Brian Addington FROM: Lieutenant Wade Derby SUBJECT: Pitchess Motion Sibbitt and Ingram Sir, It has come to my attention that we have received recent notice a Pitchess Motion involving former Of?cer Sibbitt has been ?led by the public defender in a domestic violence homicide. On March 3, 2015, I prepared a memorandum to you expressing my concerns that we failed to disclose material facts about the existence of an internal affairs ?le against Sibbitt/Ingram in two prior Pitchess motions ?led in 2014. In October 2014 I also submitted a memorandum to you about my concerns if we did not maintain my IA ?ndings as a documented summary, after the ?rst Pitchess motions in this matter. You agreed with me and I did a cover memorandum for and provided it to your of?ce with all my notes, recorded witness interviews and the investigation we initiated prior to their (Sibbitt Ingram) resignations. My memorandum did state my investigation was not fully completed before the of?cers resigned. As you are aware however, it was disclosure of my ?ndings that were used to compel their resignation as they were facing termination and possible criminal charges as a result of their actions on duty. We issued an IA number that was later listed as issued in error. I am again expressing to you my concerns that we must not allow this matter to remain undisclosed. We do possess Pitchess/Brady discovery materials on both former of?cers, and I will testify to that truth. I have offered to go before the court and explain my ?ndings in camera before and you told me it would no longer be an issue. I do not want any one or our organization compromised as a result of the illegal acts of two former police of?cers. If we do not disclose this information we will likely compromise or have a criminal conviction on a domestic violence homicide case overturned. In addition there will likely be civil rami?cations from the victim?s family. Finally, I believe we will bear possible criminal culpability for violating State and/or Federal laws for nondisclosure. I do not want to see any negative outcome occur for our organization, or the victim?s family which is why I am expressing my concerns. Lt. Wade Derby
