ADMINISTRATIVE ORDER SUPREME COURT OF APPEALS OF WEST VIRGINIA RE: ASSIGNMENT OF THE HONORABLE PAUL T. FARRELL, JUDGE OF THE SIXTH JUDICIAL CIRCUIT, TO THE SUPREME COURT OF APPEALS OF WEST VIRGINIA WHEREAS, Menis E. Ketchum, former justice of the Supreme Court of Appeals of West Virginia resigned, effective July 28, 2018. The resignation of Menis E. Ketchum creates a vacancy on the Supreme Court of Appeals, and the notice of such vacancy was provided to the Governor of the State of West Virginia. WHEREAS, by order entered on June 8, 2018, Allen H. Loughry II, Justice, was suspended without pay, and is prohibited from hearing any civil or criminal matter or performing any other judicial ?lnctions during the pendency of the judicial disciplinary proceedings against him. As a result of this suspension Chief Justice Margaret L. Workman deems it is necessary to assign a judge to provide assistance on the Supreme Court of Appeals during the suspension of Allen H. Loughry II. IT IS THEREFORE ORDERED, that the Honorable Paul T. Farrell, Judge of the Sixth Judicial Circuit, be, and he is hereby temporarily assigned to the Supreme Court of Appeals of West Virginia under the provisions of article section 8 of the Constitution of West Virginia, with said assignment commencing on August 9, 2018 and continuing until the Chief Justice determines that the assistance is no longer necessary. WHEREAS, Articles of Impeachment have been adopted by the House Judiciary Committee to be presented to the House of Delegates. Pursuant to the provisions of article section 8 of the Constitution of West Virginia, and the Rule of Necessity, it is ?lrther ORDERED that if the Articles of Impeachment proceed to the Senate, the Honorable Paul T. Farrell, Judge of the Sixth Judicial Circuit be, and is hereby assigned to the Supreme Court of Appeals of West Virginia as the Acting Chief Justice for said impeachment proceedings. It is further ORDERED that the Acting Chief Justice Paul T. Farrell appoint other justices to preside as needed. IT IS FINALLY ORDERED, that the Clerk of the Supreme Court of Appeals of West Virginia record this Order in the Of?ce of said Clerk and that proceedings be held in the manner provided by law.
