Seattle City Light's Department Policy and Procedure (DPP) governing the Utility Hearing Office, dictates a customer has only five (5) business days after a Supervisor's decision to submit an appeal. The Supervisor, Ms. Diane Clement, issued her decision on April 30, 2018. Your appeal mailing was postmarked May 8, 2018. Therefore, your appeal letter was postmarked six (6) business days after the supervisory decision, so your letter was mailed one day past the five (5) business days rule. Also, the Hearing Officer Review Form you completed and submitted to me clearly states in the first paragraph that customers, "must file an appeal in writing within five business days after completing the supervisor review." (Please refer to attached copy of first page of the review form.) Since I am bound to follow Seattle City Light's Departmental Policies and Procedures, I regretfully must deny your appeal. I understand that the strict application of this rule can be difficult for customers to accept. Since you submitted a check with your appeal under the expectation that your dispute would be heard by the Hearing Office, I am returning you your check in the amount of $357.20 as your appeal now has been denied.
