I have carefully reviewed Petitioner?s motion1 ?led in the above?captioned case on

April 24, 2017. While captioned otherwise, it is in essence a motion for my disquali?cation
pursuant to Rule 33 of the West Virginia Rules of Appellate Procedure. This memorandum is my
response pursuant to Rule 33(g). I ?nd no basis for my disquali?cation under Canon 2, Rule 2.11
of the Code of Judicial Conduct because neither I nor my husband has an economic interest in the
subject matter in controversy.
