Coats, the Prosecutor appointed by this Court (?Prosecutor?), and Curtis DeLapp, Respondent, and respectquy request the Court accept the Settlement Stipulation, enter an order of approval of the Settlement Stipulation and enter a ?nal order of dismissal in this matter. In support of these requests, the Prosecutor and Respondent state as follows: 1. On August 1, 2018, Petitioner, The State of Oklahoma, on relation of Douglas L. Combs, Chief Justice of the Supreme Court of Oklahoma, ?led a Petition against Respondent, a District Judge in the Eleventh Judicial District of Oklahoma, pursuant to Oklahoma Constitution, Art. 7-A, and Rule 9, 5 0.5.2011, Chl, App. 7. 2. The Petition alleges that Respondent engaged in certain conduct prohibited by the - Oklahoma Constitution, 20 0.8.2011 and Canons 1, 2 and 4 of the Code of Judicial duct, 5 2011 Ch 1, App.4. The Petition further describes numerous alleged acts by Respondent that constitute such violations. nvening the Court on the 3- Also on August 1, 2018, this Court entered an Order C0 J?diCi-Elry, Trial Division, to decide Respondent?s matter. his 4- After reviewing the Petition, Respondent contacted the Prosecutor through counsel, Stephen B- Riley, and stated a desire to resolve this matter without a trial on the following tel-mg: a. ReSpondent will immediately resign as District Judge for the Eleventh Judicial District of Oklahoma, effective upon entry of the ?nal order in this matter; 13- Respondent is currently a candidate for re-election as District Judge of the Eleventh Judicial District of Oklahoma Respondent will immediately. withdraw from that race and will no longer be a candidate for that of?ce; (ii) will notify the requisite election of?cials of his withdrawal; and will issue a public statement that he is no longer a candidate for that of?ce; c. Respondent will not again ?le as a candidate for any judicial position in Oklahoma; d. Respondent will not in the future seek, and will not accept, appointment to any judicial position in Oklahoma; e.
