This is an action to foreclose a mortgage on real property located in Palm Beach County, Florida. 2. The Court has jurisdiction over the subject matter herein. 3. On or about April 13, 2007, Jeffrey M. Siskind executed and delivered a promissory note (the "Note"), and Jeffrey M. Siskind and Tanya L. Siskind a/k/a Tanya Siskind executed a mortgage securing the payment of the Note (the ?Mortgage?). A copy of the Note and Original Note Certi?cation are attached hereto as Exhibit 17-014061 FL001.N002 FILED: PALM BEACH COUNTY, FL, SHARON R. BOCK, CLERK, 12/12/2017 04:51:38 PM 4. The Mortgage was recorded on June 1, 2007 in Of?cial Records Book 21793 at Page 755 of the Public Records of Palm Beach County, Florida and encumbered the property described in the Mortgage (the ?Property?). A copy of the Mortgage is attached hereto as Exhibit 5. The Mortgage was subsequently assigned to US Bank National Association, as Trustee, successor in interest to Bank of America, National Association as Trustee successor by merger to LaSalle Bank National Association, as Trustee for WaMu Mortgage Pass-Through Certi?cates, Series 2007 Trust by virtue of an assignment of mortgage (the ?Assignment of Mortgage?) recorded on May 29, 2013, in the Of?cial Records Book 26051 at Page 5, of the Public Records of Palm Beach County, Florida. A copy of the Assignment(s) of Mortgage are attached hereto as Exhibit 6. The loan was subsequently modi?ed pursuant to the Loan Modi?cation Agreement, which is attached hereto as Exhibit 7. The Plaintiff, directly or through an agent, has possession of the Note, which is either made payable to the Plaintiff or has been duly endorsed. Therefore, the Plaintiff has the right to enforce the Note. 8. Setect Portfolio Servicing, Inc. is the servicer of the loan described in the Note and Mortgage and, as such, has the authority to initiate the instant foreclosure on the Plaintiff?s behalf pursuant to a Power of Attorney. 9. Defendant(s), The Unknown Trustee of the Second Siskind Family Trust, has defaulted under the Note and Mortgage by failing to pay the October 1, 2016 payment, and all subsequent payments due thereatter. 10. All conditions precedent to ?ling of this action have been performed or have occurred. 11. The Plaintiff declares the full amount payable under the Note and Mortgage to be due. 12. There is now due, owing and unpaid to the Plaintiff $2,892,264.77, that is due on principal on the Note and Mortgage, together with interest from September 1, 2016, late charges, all costs of collection (including title search expenses for ascertaining necessary parties to this action), and reasonable attorney?s fees. 13.
