THE GRAND JURY CHARGES THAT:

At all times material to this indictment:

1. was a website offering for sale digital video
discs containing recordings of copyrighted television broadcasts of hockey games, and
other copyrighted works such as team and player pro?les, from the National Hockey League
and other professional hockey leagues.

2. was a website offering for sale
subscriptions which enabled subscribers to download an unlimited number of video
clips of copyrighted television broadcasts of hockey games, and other copyrighted works such as
team and player pro?les, from the NHL and other professional hockey leagues.

3. Neither nor BROADSTREETBULLYCOM
had the permission of the NHL or any other professional hockey league to reproduce or distribute

these recordings.

4. During each of the following 180-day periods, ending on the dates noted
below, in the Eastern District of defendant

willfully infringed the copyright of a copyrighted work for purposes of commercial advantage
and private financial gain, by reproducing and distributing during a 180-day period ten (10) or
