R.S. 42:19(A)(2)(a) greater than twenty-four (24) hours before the special Board meeting Thursday (August 9) morning as required by La. R.S. 42:19(A)(1)(b)(i).  The Public Notice identified the date, time and place of the special Board meeting in accordance with La. R.S. 42:19(A)(1)(b)(ii)(a).  The Public Notice included an agenda separately listing and describing with reasonable specificity each action to be taken during the special Board meeting in accordance with La. R.S. 42:19(A)(1)(b)(ii)(bb).    Op. Atty. Gen. 14-0172 is both non-binding and clearly distinguishable.  The agenda item in question simply stated "discuss any other business properly brought before this committee," which the AG's office admitted "did not give detail about the content of the discussion."  However, the AG's office ultimately held that "the agenda item [was not a] violation of the Open Meetings Law."  The agenda item included in Public Notice posted by OPCD stated "personnel action," which clearly indicates that the Board planned to discuss an employee matter.  The law does not require a public body to identify the individual to be discussed (Op. Atty. Gen. 93-0230).  The law merely requires "that an agenda must be reasonably clear so as to advise the public in general terms each subject to be discussed." (Op. Atty. Ebbert, I’m not exactly sure what this email chain is all about, but it was brought to my attention by a female employee who was offended (rightly so) by Steve’s comments.  This is definitely inappropriate for the Executive Director to send to all OPCD AFT employees—just as Frith’s email was.  It seems that Frith’s mistake was to include me in her email & Steve was “smart” enough to leave me off his reply.  Unfortunately for Steve, the email got to me from an employee that feels this is not right.  His words in his email were viewed as being demeaning towards women.  Steve should know better!  Rumor had it that Frith was going to appeal her termination and her defense was going to be that emails like the one she wrote was common by ALL OPCD AFT  employees.  I was told that in emails used to show Frith’s misuse of emails, there was some concerns regarding things that were said in those same emails by other OPCD employees.    I know we (me included) have all put things on emails that we shouldn’t have but for the Executive Director to do the same type of thing this soon after the Deputy Director’s termination is impossible for me to understand.   This has to stop and good order and discipline maintained.   I am not normally one to push for someone to be punished but in this case I feel it is needed.  I am asking that you personally render an appropriate punishment on Steve for this lack of judgement,  I also feel this is needed so as not to be seen as having one standard for Frith and another for Steve.
