STATE OF MAINE UNIFIED CRIMINAL Hancock, 38 Location Ellsworth Docket No. STATE OF MAINE Plaintiff MOTION TO CONTINUE vs. BECAUSE OF MOOSE ATTACK JEREMY EATON Defendant NOW COMES the Defendant, by and through counsel, and asks that the pending trial in the above captioned matter, be continued for 60 days, so that he can continue to recover ?om injuries associated with a moose attack. In support of this Motion, the Defendant would show as follows. 1. On or around February 4, 2018, while on a snowmobile and ice ?shing trip with his two sons and some friends, in Maine?s Northwoods, the Defendant encountered a bull moose on a single track snowmobile trail. 2. The moose was aggressive toward the riders and Mr. Eaton confronted the Moose and attempted to drive it away. 3. After successfully driving the moose into the woods, Mr. Eaton proceeded away from the encounter, at the head of the group of riders. 4. Said moose then charged Mr. Eaton, and hit the snowmobile in the handlebars, sending it, and Mr. Eaton, into a tree at approximately 35mph. 5. Mr. Eaton?s son, Jacob, then charged the moose, scaring it away. 6. Mr. Eaton was rushed to EMMC, where he was diagnosed with a broken pelvis and four broken ribs. 7. Mr. Eaton is currently at home, recovering. But due to pain, medication, and being unable to move effectively, cannot adequately participate in his defense. 8. Toff Toffolon does not object to this Motion being granted. WHEREFORE, the defendant asks that this trial be continued.
