ORDER
On October 25, 2017, the Court ordered the parties to file written submissions showing
cause why this case should not be dismissed as moot in light of the expiration of Executive Order
No. 13,780 and the United States Supreme Court’s dismissal and vacatur of Trump v. Int’l
Refugee Assistance Project, 583 U.S. __, No. 16-1436, 2017 WL 4518553 (Oct. 10, 2017). [Doc.
No. 44]. The parties have filed their submissions as required; and upon review of the parties’
submissions, the Court concludes that the Plaintiffs’ claims in the Amended Complaint are moot,
as they are based on an Executive Order that has expired by its own terms and their resolution
would have no effect on the rights of the parties. See DeFunis v. Odegaard, 416 U.S. 312, 316
(1974). It also appears from the Plaintiffs’ submission that they have under consideration the
filing of an amended or supplemental complaint and have asked the Court for leave to file such a
pleading. Upon consideration of this request, the Court concludes that given the events that have
transpired since the filing of their Amended Complaint, the Plaintiffs should be granted leave, as
requested. Accordingly, it is hereby

ORDERED that the stay previously imposed be, and the same hereby is, LIFTED for the
limited purpose of allowing Plaintiffs leave to file an amended or supplemental complaint within
forty-five days of the date of this Order; and it is further
ORDERED that in the event that Plaintiffs timely file an amended or supplemental
complaint, the stay is lifted in its entirely and the case shall proceed in accordance with the
applicable rules and procedures; and it is further
ORDERED that if Plaintiffs do not timely file an amended or supplemental complaint,
the action shall be dismissed as moot.
The Clerk is directed to forward copies of this Order to all counsel of record.
