See Dkt. # 189. With 18 respect to other documents, however, the Court requested that Plaintiffs file a supplemental brief 19 “more precisely challeng[ing] Defendants’ remaining privilege assertions” in light of the newly- 20 produced affidavit from Mr. Emrich. Id. at 8-9. The Court also “encourage[d] the parties to 21 work together to resolve these discovery issues without Court intervention.” Id. at 9. 22 Per the Court’s encouragement, the parties plan to meet and confer regarding the 23 remaining documents withheld pursuant to the deliberate process privilege. The parties hope that 24 further discussions will either obviate the need for supplemental briefing or at least narrow the 25 issues before the Court.
