On May 10, 2018, the Court granted Defendants’ motion for reconsideration of its April

2

11, 2018 Order granting in part and denying in part Defendants’ motion for a protective order

3

concerning production of the names, Alien numbers, and application filing dates of unnamed

4

class members. Dkt. 183 (“Order”). The Court ordered the parties to abide by a protective order

5

that limited disclosure of the information to (1) Plaintiffs’ attorneys of record, (2) Experts

6

retained by Plaintiffs, and (3) the Court and court personnel.

7

In order to facilitate the implementation of this Order, the parties jointly request that the

8

Court revise its protective order to permit Plaintiffs’ counsels’ administrative and technical staff

9

to also view and access the names, Alien numbers, and application filing dates of unnamed class

10

members. Accordingly, the parties respectfully request that the Court revise its protective order

11

as outlined in the proposed order submitted herewith.

THE COURT, having considered the Parties’ Stipulated Motion Regarding May 10, 2018
Order and being fully advised now, therefore, it is hereby
ORDERED that the Parties’ Stipulated Motion Regarding May 10, 2018 Order is hereby
GRANTED; and it is further
ORDERED that the limited protective order detailed in the Court’s May 10, 2018 Order
(Dkt. 183) is revised to read as follows:
Disclosure of, and access to, the names, Alien numbers (“A numbers”), and application

filing dates of the unnamed plaintiff members of the Naturalization Class and Adjustment-of-

Status Class shall be limited to the following:

1) Plaintiffs’ attorneys of record in this action, during such time as they continue to

11

represent Plaintiffs;

12

2) Any support staff and other employees of Plaintiffs’ attorneys of record assisting

13

in this action with an appropriate need to know, and to whom Plaintiffs’ attorneys

14

have first given a copy of this Order and instructions on the support staff or

15

employee’s obligation to comply with the Order;

16

3) Experts retained by Plaintiffs to the extent reasonably necessary to prepare expert

17

reports and testimony; and

18

4) The Court and court personnel.

19

Plaintiffs’ attorneys of record shall maintain the above-described information in a secure

20

manner, i.e. in a locked filing cabinet (for any paper copy) or in a password- protected electronic

21

file to which only authorized persons have access, and shall not transmit that information over

22

any electronic mail or cloud-based sharing unless the method of transmission employs point-to-

23

point encryption or other similar encrypted transmission.

24

Plaintiffs’ counsel, and any person acting on their behalf, are prohibited from either

25

disclosing to any individual who contacts them whether that individual is an unnamed member of

26

either the Naturalization Class or Adjustment-of-Status class, or contacting the unnamed plaintiff
