THE COURT, having considered the Parties’ Stipulated Motion Regarding the May 10, 2018 Order, and being fully advised it is hereby ORDERED that the Parties’ Stipulated Motion Regarding the May 10, 2018 Order is hereby GRANTED; and it is further ORDERED that the limited protective order detailed in the Court’s May 10, 2018 Order (Dkt. #183) is revised to read as follows: Disclosure of, and access to, the names, Alien numbers (“A numbers”), and application filing dates of the unnamed plaintiff members of the Naturalization Class and Adjustment-of-Status Class shall be limited to the following: 26 ORDER GRANTING STIPULATED MOTION REGARDING MAY 10, 2018 ORDER – 1 Case 2:17-cv-00094-RAJ Document 192 Filed 05/25/18 Page 2 of 3 1 2 3 1) Plaintiffs’ attorneys of record in this action, during such time as they continue to represent Plaintiffs; 2) Any support staff and other employees of Plaintiffs’ attorneys of 4 record assisting in this action with an appropriate need to know, and to 5 whom Plaintiffs’ attorneys have first given a copy of this Order and 6 instructions on the support staff or employee’s obligation to comply 7 with the Order; 8 9 10 11 3) Experts retained by Plaintiffs to the extent reasonably necessary to prepare expert reports and testimony; and 4) The Court and court personnel. Plaintiffs’ attorneys of record shall maintain the above-described information 12 in a secure manner, i.e., in a locked filing cabinet (for any paper copy) or in a 13 password- protected electronic file to which only authorized persons have access, 14 and shall not transmit that information over any electronic mail or cloud-based 15 sharing unless the method of transmission employs point-to-point encryption or 16 other similar encrypted transmission. 17 Plaintiffs’ counsel, and any person acting on their behalf, are prohibited from 18 either disclosing to any individual who contacts them whether that individual is an 19 unnamed member of either the Naturalization Class or Adjustment-of-Status class, 20 or contacting the unnamed plaintiff members of the Naturalization Class and 21 Adjustment-of-Status class for any purpose absent prior order of this Court. 22 Plaintiffs’ counsel, and any other persons subject to this Order or the Court’s 23 May 10, 2018, Order, must strictly abide by this limited protective order. 24 Defendants agree to meet and confer with Plaintiffs’ counsel over ways in which 25 Defendants might be able to provide Plaintiffs’ counsel with information about 26 particular unnamed class members to develop evidence for use in their case.
