No. 128), the Parties submit the following joint status report 3 outlining their views as to how the Court should proceed. 4 5 6 7 8 9 10 11 A. Matters relating to both Doe and Jewish Family Service of Seattle (“JFS”) cases (Case Nos. C17-0178 and C17-1707): 1. Defendants intend to file a Rule 12(b)(1) motion regarding mootness (“Rule 12(b)(1) Motion”). As discussed below, the Parties disagree as to whether any discovery is appropriate in relation to that motion and when the Court should make that determination. However, given Defendants’ intention to file the Rule 12(b)(1) Motion, the parties agree on the following briefing schedule for that motion: 12 a. May 25, 2018: Defendants file their Rule 12(b)(1) Motion; 13 b. June 19, 2018: The Doe and JFS Plaintiffs file their opposition briefs; and 14 c. June 29, 2018: Defendants file a consolidated reply brief, which shall not 15 16 17 18 19 exceed twenty-four (24) pages in length. 2. The Parties reserve the right to request modifications of the 12(b)(1) Motion briefing schedule above in the event that the Court allows discovery to proceed. 3. All Parties further agree that the interests of judicial economy favor a stay of all 20 proceedings and motion practice in the JFS matter and a continuation of the stay in the Doe 21 matter,1 with the exception of the following: (1) the JFS Plaintiffs’ forthcoming motion to 22 reinstate their Cross-Motion for Limited Expedited Discovery on Compliance with Preliminary 23 24 25 26 1 Doe v. Trump, No. 17-178, was previously stayed. (Dkt. No. 34.) However, the stay was lifted to allow Doe Plaintiffs to file a Third Amended Complaint and litigate a preliminary injunction motion relating to the October 23, 2017 Agency Memo titled “Resuming the United States Refugee Admissions Program with Enhanced Vetting Capabilities.” (Dkt. No. 41.) No. 121) (the “Discovery Motion”) and any discovery permitted by the Court 2 pursuant to its order resolving that motion; (2) the Doe Plaintiffs’ forthcoming motion to join the 3 Discovery Motion; (3) Defendants’ forthcoming Rule 12(b)(1) Motion; and (4) any other 4 proceedings and motions relating to this Court’s Preliminary Injunction Order. 5 6 7 4. Parties will meet and confer before bringing that matter to the Court’s attention. 5. 8 9 6. 14 15 16 7. 19 20 21 Further, as set forth below, the Parties note that they respectfully disagree as to when it would be appropriate for this Court to permit any discovery or decide the mootness issues raised by Defendants’ forthcoming motion to dismiss. B. 17 18 Concurrently with this Joint Status Report, the Parties will file a stipulated motion respectfully requesting that the Court enter an order consistent with the above representations. 12 13 The Parties further agree that the Court need not wait for the Ninth Circuit’s mandate to issue before addressing the JFS Plaintiffs’ Discovery Motion.2 10 11 Should any Party determine that additional motion practice may be necessary, the Matters relating to JFS case only (Case No. C17-1707) 1. JFS Plaintiffs and Defendants agree that Defendants’ Motion to Stay Proceedings Pending Appeal (Dkt. No. 110) has been rendered moot by the Ninth Circuit’s remand (Dkt. No. 126). 2. JFS Plaintiffs and Defendants further agree that Defendants need not answer the 22 operative JFS Complaint before the Court resolves Defendants’ forthcoming Rule 12(b)(1) 23 Motion, and that JFS Plaintiffs need not move for class certification until the Court resolves the 24 Rule 12(b)(1) Motion and Discovery Motion and any related discovery is complete. If the Court allows 3 any discovery, then the Parties will confer on the timing of JFS Plaintiffs’ motion for class 4 certification once that discovery is complete and the Court has decided the Rule 12(b)(1) motion, 5 and will submit a proposal to the Court. 6 7 C. Disputed Matters Plaintiffs’ Position 8 1. 9 Both JFS and Doe Plaintiffs maintain that discovery is necessary both to address urgent 10 11 12 13 14 concerns regarding Defendants’ compliance with the Court’s preliminary injunction, as detailed in JFS Plaintiffs’ Discovery Motion, and to address mootness issues that will be raised in Defendants’ forthcoming Rule 12(b)(1) Motion. As Plaintiffs argued before the Ninth Circuit in response to Defendants’ motion to dismiss the cross-appeals as moot, the Court cannot 15 effectively evaluate mootness here prior to discovery. JFS Plaintiffs will therefore file a motion 16 to reinstate their Discovery Motion addressing the continued need for this discovery, and 17 respectfully request that this Court grant discovery regarding compliance and mootness. The 18 19 20 21 Doe Plaintiffs intend to file a motion to join the JFS Plaintiffs’ Discovery Motion. Plaintiffs further maintain that discovery can and should be granted prior to the Court’s consideration of Defendants’ 12(b)(1) Motion, as it is necessary to resolve the issues raised by that motion. Defendants’ Position 22 2. 23 As Defendants argued before the Ninth Circuit, discovery is unnecessary and 24 inappropriate. Defendants will file their Rule 12(b)(1) Motion on or before May 25, 2018, and 25 respectfully submit that any order on discovery should be deferred until after that motion is fully 26 briefed. Moreover, this Court should assure itself that it has subject-matter 2 jurisdiction before it grants any of Plaintiffs’ requests for discovery. See Steel Co. v.
