The remand Order by the U.S. Court of Appeals for the Ninth Circuit has rendered 4 Defendants’ Motion to Stay District Court Proceedings Pending Disposition of 5 6 7 8 Cross-Appeals (Dkt. No. 110) moot, and the Court accordingly should deny that motion as moot. 2. The remand Order has not rendered the Jewish Family Service of Seattle (“JFS”) 9 Plaintiffs’ Cross-Motion for Limited Expedited Discovery on Compliance with 10 Preliminary Injunction (Dkt. No. 121) (the “Discovery Motion”) moot. The JFS 11 Plaintiffs will separately move to reinstate that motion, and the Doe Plaintiffs will 12 move to join the motion. 13 14 15 16 17 18 3. The Court need not wait for the Ninth Circuit’s mandate to issue before addressing the JFS Plaintiffs’ Discovery Motion or setting a briefing schedule for Defendants’ forthcoming Rule 12(b)(1) motion regarding mootness. 4. Defendants intend to file a Rule 12(b)(1) motion, and the parties agree on the following briefing schedule for that motion: 19 a. Defendants shall file their Rule 12(b)(1) motion on or before May 25, 2018; 20 b. The Doe and JFS Plaintiffs shall file their opposition briefs on or before June 21 22 23 24 19, 2018; and c. Defendants shall file their consolidated reply brief (not to exceed twenty-four (24) pages in length) on or before June 29, 2018. 25 The Parties reserve the right to request modification of the briefing schedule in the 26 event that the Court allows discovery to proceed. The Parties further agree that the interests of judicial economy favor a stay of all 2 proceedings and motion practice in the JFS case and a continuation of the stay in 3 Doe,1 with the exception of (1) Plaintiffs’ Discovery Motion upon reinstatement (and 4 joinder by Doe Plaintiffs), as well as any discovery permitted by the Court pursuant 5 to its order resolving that motion; (2) Defendants’ forthcoming Rule 12(b)(1) motion; 6 and (3) any other proceedings and motions relating to this Court’s preliminary 7 injunction Order. 8 9 6. Defendants need not answer the operative JFS Complaint before the Court resolves 10 Defendants’ forthcoming Rule 12(b)(1) motion, and JFS Plaintiffs need not move for 11 class certification until the Court resolves the Rule 12(b)(1) motion and JFS 12 Plaintiffs’ Discovery Motion and any related discovery is complete. Should the Court 13 deny the Rule 12(b)(1) motion, JFS Plaintiffs and Defendants will confer on the 14 timing of Defendants’ further responsive pleading and will submit a proposal to the 15 Court. If the Court allows any discovery, then the Parties will confer on the timing of 16 17 JFS Plaintiffs’ motion for class certification once that discovery is complete and the 18 Court has decided the Rule 12(b)(1) motion, and will submit a proposal to the Court. 19 7.
