On February 10, 2017, the Court held a Status Conference to discuss the status of the individual
plaintiffs and the issue involving the organizational plaintiffs' standing. After hearing from counsel,
the Court dismissed the First Amended Petition for Writ of Habeas Corpus and took a recess for
counsel to discuss a briefing schedule for a motion to dismiss the claims of the organizational
plaintiffs. After the recess, the Court stated that it was informed that the lawyers were considering a
dismissal without prejudice. Counsel then requested an opportunity to speak to their clients before
dismissal of the action. Accordingly, the Court ordered the parties to file with this Court a
stipulation to dismiss the action without prejudice on or before February 17, 2017; if the parties are
not able to reach an agreement, the parties are to submit a proposed briefing schedule on or before
that date."
