PLAINTIFFS’ NOTICE OF SUPPLEMENTAL AUTHORITY
IN SUPPORT OF MOTION TO LIFT THE STAY
In further support of the October 9 Motion to Lift the Stay and Related Relief (ECF No.
103), Plaintiffs attach a copy of the Supreme Court’s order dismissing the appeal in Trump et al.
v. International Refugee Assistance Project et al., 16-1436, and remanding with instructions to
vacate the judgment and dismiss the challenge to the March 6 Executive Order as moot. Ex. 1.
Plaintiffs note that the request to lift the stay and to file an amended complaint are
unopposed: Defendants do not oppose lifting the stay, nor do they oppose the filing of the
amended complaint. See ECF No. 103-3. Plaintiffs are prepared to file the proposed amended
complaint and a motion for preliminary injunction concerning the September 24 Proclamation
immediately once the stay is lifted.

Order ?expired by its own terms? on September 24, 2017, the appeaT

479 U. S. 361, 363 (1987). FoTTowing our estabTished practice in
such cases, the judgment is therefore vacated, and the case is
remanded to the United States Court of AppeaTS for the Fourth
Circuit with instructions to dismiss as moot the cha11enge to

340 U. S. 36, 39 (1950). We express no view on the merits.

Justice Sotomayor dissents from the order vacating the
