This is a civil action for damages in an amount in excess of the minimum jurisdictional limits of this Court. 2. Plaintiff, Julia Salazar (hereinafter Julia), is a resident of Palm Beach County, Florida and is sui 3. Defendant, Kai Hernandez (hereinafter Kai), is a resident of Palm Beach County, Florida and is sui juris. 4. All facts giving rise to this cause of action occurred in Palm Beach County, Florida, although the mug photos and other public records extend throughout the United States and beyond through the World Wide Web. 5. In June 2010, Julia, was a 19 year old female freshman who attended Columbia University. Plaintiff graduated top of her class in high school and has no criminal history. In June 2010, Kai, was going through a divorce with her now ex-husband, Keith Hernandez (hereinafter Keith). 7. In June 2010, Keith was living up north while Kai was living in the marital home located at 335 River Drive, Tequesta, FL, 33469. Kai was living in the marital home with her then fiance, Barry Silverman (hereinafter Barry). 8. Upon information and belief, Barry has a criminal history to include theft and fraud. 9. Upon information and belief, during the summer months of 2010, Kai had filed several suspicious claims with her home owner?s insurance company to include theft and burglary. 10. On or about July 2010, Kai asked her neighbor Julia to house sit for a week in August and to take care of Kai?s dogs. During this encounter, Kai expressed concern for the security of her house. 11. On or about August, 2010, Julia house sat for the week. While watching over the house Julia noticed that there was drug paraphernalia to include open syringes, guns, and approximately 25 Pottery Barn gifts totaling approximately $1175 in different parts of the house. 12. When Julia found these objects in the house, and not knowing what to do, Julia called Keith to let him know what she had found in the marital house. 13. Upon learning what Julia had found, Keith told Julia to take photos of the objects found and to send him a list of the narcotics. Salazar, Julia vs. Hernandez, et al. Once returning from their travels, Kai and Barry met with Julia to pay her for house sitting and asked again if Julia would watch the house in the future. Again, Kai urged that she was most concerned about the security of the house. 15. On or about September 2010, Julia house sat for the entire month of September. 16. On or about September 20, 2010, Keith forewarned Julia that he would be stopping by the marital home with his attorney. While Keith was at the marital home two Tequesta police officers arrived. In front of the officers, Keith proceeded to have Julia tell the officers about the guns, paraphernalia and gift cards that she found in the house. The officer wrote a report and specifically said to Julia that her name would not appear in the report. 17. In November, 2010, Kai sent Julia an envelope with cash in it for payment for watching the house in September. When Julia attempted to call Kai she never picked up the phone. 18. Upon information and belief, on or about December 13, 2010 and December 14, 2010, a female had attempted to access Kai?s bank account, via the phone, at USB Investment Bank. According to Kai, she was contacted by her personal banker who played a recording of the female?s voice who allegedly attempted to access Kai?s account. Based solely on listening to the recording, Kai falsely alleged that the person attempting to access her funds must have been Julia. 19. Upon information and belief, on or about December 16, 2010, Kai engaged in a character assassination against Julia, by defaming her through false Salazar, Julia vs. Hernandez, et at. Case No: 50 2013 CA 004374 MB AB Amended Complaint Page 4 of 8 accusations made to the Tequesta Police Department. Kai falsely accused Julia of trying to access Defendant?s funds at the USB Investment Bank and suggested to the police that Julia had stolen $11,800 in cash from her house. In addition, Kai told the Tequesta Police that Julia was having an affair with her soon to be ex?husband Keith, which was not true. 20. Upon information and belief, after Kai had reported the alleged fraud to police, Kai stated to Keith that ?Julia is going to have a lot of problems? and suggested that Julia had been in trouble with the law priorto this alleged incident, which is not true. 21. Several months later, commencing on or about March 23, 2011, Julia, while home in Florida on break from school, agreed to speak with the Tequesta Police Department after they contacted her, thinking that the police wished to discuss what she had observed at the marital home. Instead, she was confronted with the accusations made against her by Kai. After being interrogated by the Tequesta Police Department, Julia was subsequently handcuffed and arrested wherein she was required to be finger- printed, pose for mug shots, and post a bond for her release pending adjudication of her case. 22. The criminal proceedings brought against Julia because of the defamatory statements were ultimately dismissed. However, Julia was humiliated by being handcuffed, being finger-printed, and having to pose for mug shots, which are still public record and accessible through the internet and via other means. 23. Kai?s statements to the Tequesta Police Department was falsely made or made in reckless disregard of its truth or falsity. The false statement made by Kai to the Salazar, Julia vs. Hernandez, et al. Case No.: 50 2013 CA 004374 MB AB Amended Complaint Page 5 of 8 Tequesta Police Department on or about December 16, 2010, is attached as ?Exhibit 24. The statement made by Kai was false and without good motives. 25. The statement made by Kai was made against Julia with improper motive and purpose to gratify Kai?s ill will, hostility and intent to harm Julia, rather than to advance or protect Kai?s interest or right. 26. The nature of the statement is such that it imputes to Julia the commission of crimes and moral unfitness and character. 27. The nature of the statement made by Kai is such that it tends to expose Julia to hatred, ridicule, contempt or tends to injure Julia in her business, reputation or occupa?on. 28. The statement made by Kai was made with express and actual malice intending to cause serious injury to the reputation of Julia, to inflict maximum emotional damage on Julia, and to interfere in her personal and professional relationships. COUNT - DEFAMATION OF CHARACTER 29. Plaintiff, Julia Salazar, incorporates by reference the allegations contained within paragraphs 1 through 28 as fully set forth herein. 30. As a direct consequence of the Kai?s defamation of Julia, Julia has suffered and will continue to suffer in the future impairment of reputation, health, shame, humiliation, mental anguish, hurt feelings, aggravation or activation of an existing condition, medical expenses, lost earnings and lost earning capacity. Kai told me she received a telephone call from her private banker (Mark Zeller) who represents USB Bank in New York, advising her that an unknown pereon(s) attempted to access her ?nanciai accounts by pretending to be Kai. All of the security questione eeked by a teieohone banker were correct except for one question. Due to the incorrect response by the unknown caller. Kai's account was red flagged and the calier was transferred to Mark. According to Kai, Mark knows Kai wail and knew the person on the other end of the phone conversation did not sound like his client. After a brief conversation, the called ended. Mark was able to retrieve a copy of the telephone conversation of the unknown caiier, which was played back for Kai. Kai immediately recognized the voice on the teiephone recording to be that of Juiia Saiazar. Juiia was once a house sitter and the daughter of a cloee personal friend of Kai's. Julia is currently a person of interest in the recent theft of approximately twelve thousand dollars in cash among other stolen item from Kai's house while she was on vacation.
