Kenneth Fischer No. RDB-18-100 Request for detention hearing and for medical treatment Dear Judge Copperthite: Please accept this as the defense request for a detention hearing in this matter at the Court’s earliest convenience, per Mr. Fischer’s prior waiver. ECF 9. While I address this to Your Honor’s attention as next week’s duty magistrate, and advise the Court that the defense intends to have witnesses at the hearing, I also note that Mr. Fischer currently is held subject to an order entered by Judge Coulson. ECF 6. I also submit that certain matters brought to the attention of the Court on July 5 have not been addressed in the intervening eight weeks. Issues relative to Mr. Fischer’s medical care have been bewilderingly delayed or overlooked, his property remains MIA, and Mr. Fischer now has acquired an infection in his surgical site. By contrast, if released on conditions Mr. Fischer can be treated through his own health care insurance. In addition, he is in the midst of divorce and custody/ visitation proceedings in state court, which he would be able to address if on release. Mr. Fischer has no prior criminal justice system involvement, and there was no allegation of violence or weapons related in any way to the charges lodged against him. We therefore request Mr. Fischer be permitted to reside at the home of his father, Charles K. Fischer, 7510 Patapsco Drive, Sykesville, MD 21784. Charles Fischer is willing and able to serve as third party custodian, and has no internet connection in the home. In light of the offenses charged, this addresses the primary concern this Court would entertain, that of danger to the community. It certainly would speed the course of discussions to resolve this matter, which have been gravely impaired by Mr. Fischer’s medical issues and isolation at MTC.
