The Grant Deed and Escrow Instructions you signed acknowledged the property, identified by DTSC as the Church and Fruit Junkyard (Site), has a Land Use Covenant (LUC) recorded which carries specific restrictions for the property owner and its successors that are enforceable by DTSC. The Fresno SARA prepared a Site Operation and Maintenance Plan, dated November 17, 2017, which DTSC approved in a letter dated December 5, 2017. The December 5th letter also identifies that the Site owner is required to establish and maintain a financial assurance mechanism, submit annual and 5-year review reports to DTSC and pay for costs incurred for oversight activities. As specified in LUC Section 301(1) DTSC must be notified of any new Site use. DTSC may also require a specific management plan to guarantee that future Site activities shall not degrade the soil cap. DTSC Clovis Office staff conducted a Site drive?by inspection May 3, 2018. Additionally, DSC has received calls from nearby neighbors concerned that ?new? activities on the Site could damage the soil cap and may even be exposing neighbors to contaminants. DTSC conducted another drive-by inspection on June 15, 2018 and confirmed the Site was occupied by recreational vehicles, trucks and campers without DTSC notification or approval. Please be advised that failure to comply with the LUC and Soil Management Plan may result in enforcement actions in accordance with Section 3.03 of the LUC.
