To be specific, your correspondence dated October 24, 2014 suggests the Company did not timely respond to matters raised in connection with the Commission?s investigation of this event. This contention is incorrect and fails to re?ect the verbal extension granted by you on October 27th. This extension was granted to re?ect the fact that Atmos Energy did not receive written notice of the alleged violations set forth in a document dated August 18th. In order to memorialize this extension, Atmos Energy sent correspondence dated October 29th confirming the extension, as well as the new, agreed upon date for the Company?s response (December Pursuant to this agreement, Atmos Energy timely faxed its response to the Commission on December Despite the granted extension, Atmos Energy subsequently received notice that an enforcement action had been issued regarding the above referenced matter. In light of the potential overlap in the mailing process, Atmos Energy contacted the Commission to determine the basis for the issuance of the enforcement action. In response, the Company was verbally told that the enforcement action was issued, not for the reason cited in the enforcement action, but rather because the Company had allegedly failed to respond to a request seeking construction information for the pipe in question. The Company, however, has no record of receiving a request for this information. And, as indicated in its December 2nd response, information responsive to this allegation was provided. Specifically, the Company made clear that during the 1970?s [the timeframe during which the pipe in question was installed], the Company followed the manufacturer?s installation procedures. The North Richland Hills (NRH) Fire Department was the ?rst responder to the scene at 04:10pm. According to its account, the fire at the scene was eliminated around 04:23pm and as a precautionary safety measure, there was evacuation of nearby homes and diversion of traffic around the scene. The natural gas distribution system in the area is owned and operated by Atmos Energy, Mid-Tex Division. Information from Atmos Energy indicated that, the company was notified of the incident at 05:01 pm and its first responder arrived onsite by 05:20pm. Following initial assessment, a report on the event was transmitted to both Railroad Commission of Texas and Department of Transportation. Onsite investigation by the Railroad Commission of Texas and Atmos Energy, found a grade one leak with maximum natural gas concentrations of 100 percent on a six (6) inch Poly Ethylene (PE) gas main line, in front of the house. This gas concentration (100 percent) was found over a migration span of 40 feet, towards east side of house. Also found was, 41 percent natural gas concentration in a water meter manhole in front of the house, near street. The leak was later, pinpointed on a failed butt-fusion joint on the 6 inch PE gas main. The information from home-owner at 7916 Hanrvood Road, indicated that, seven (7) people were in the house at the time of the event; however, one injury; a seven years old girl was reported. The victim suffered a second degree burn and was care-flight to Parkland Hospital in Dallas for treatment. The girl was discharged on Christmas Eve (December 24, 2013). Investigation (Include a probable cause statement for incident/accident investigation) On Saturday, December 21, 2013, there was an apparent gas related house explosion and fire incident at 7916 HanNood Road, North Richland Hills in Tarrant County. The natural gas distribution system in the area is owned and operated by Atmos Energy, Mid-Tex Division. The incident resulted in one personal injury and property damage, estimated at $143,194. The estimated natural gas lost was 33MCF. The incident occurred at about 04:00pm on December 21, 2013. Per the home-owner narration, seven (7) people were in the house at the time of the event; however, there was one injury; a seven years old girl. The victim suffered a second degree burn. According to him, the victim went to use the restroom, located in the middle of the house and immediately, she flipped the light bulb, there was an explosion, followed by fire. The force of the explosion pulled the back wall of the house down and outwards and also many of the windows in the house. The North Richland Hills (NRH) Fire Department responded to the scene at 04:10pm and according to its account, the fire at the scene was eliminated around 04:23pm and the building was completely cleared at 02:05am (12/22/2013). There was evacuation of nearby homes and diversion of traffic around the location of the scene, following the incident. Onsite investigation by the Railroad Commission of Texas and Atmos Energy included a natural gas migration survey; conducted by means of bar-hole testing, using Sensit Gold G2 Serial 29981 (calibrated on 11/22/2013), along gas main and service line to 7916 Harwood Road and also on sewer vents, water-meter?manhole, driveway and around the location. A grade one leak with maximum natural gas concentrations of 100 percent was found on the gas main, in front of the house. The gas concentration (100 percent) was found over a migration span of 40 feet, towards east side of house. Also found was, 41 percent natural gas concentration in a water meter manhole in front of the house, near street. Further investigation eastward, also found natural concentrations in front of nearby house at 5213 Bob Dr. The leak was pinpointed on a failed butt-fusion joint on the gas main. Furthermore, a special leak survey was also conducted three block radius from scene using, Heath RMLD Serial 800933006 (calibrated on 12/21/20130). Atmos natural gas distribution map system indicates that. the gas main in front of 7916 HanNood Road is located on map sheet The main shows a 6-inch Poly Ethylene pipe with dead-end at (west) and transitions to 6-inch Coated Steel on Harwood Road Bob Drive (east). The 6-inch PE main was installed in 07/17/1972 by Lonestar Gas Company (operator of the natural gas distribution system at the time) and the pipe was manufactured by Nipak. Atmos archives (records) provided the following information about the PE pipe material: 6 D2513. However, there was neither records on the joining procedure (butt fusion) nor operator qualification connected with the installation. Per Atmos Energy, the MAOP of this main is 60psig, but the average operating pressure (high) in the past five (5) years was 43.5psig. At the time of the incident, the pressure in the main was 38psig. The natural gas service line to 7916 HanNood Road is a 3A-inch Copper line tied-in to the main via a dresser coupling. There is no record on the date of installation on this service line, as at 1972, customer was responsible for service line. However, the pressure test conducted on the line, held at 38psig for ten minutes. Similar test on house piping also held pressure. On the other hand, the main could not hold pressure due blowing leak on the failed butt-fusion joint. Investigation (Include a probable cause statement for incident/accident investigation) Atmos leak records for NRH system, including mapsheet AGB64990 was reviewed. From the records, the last survey was performed on 05/16/2011. The next survey is due in 2014. Records in the last ?ve (5) years show that, there were a total of twenty-three (23) leaks. As at the date of the incident, there was no record of open leak order in the mapsheet, as all of the leaks have been repaired. However, out of the 23 repaired leaks on record, sixteen (16) were found during survey and seven (7) via Leak Investigation Order (LIO). It was important to note that, leak 512767) (LIO 398374) (Grade One) found on 04/03/13 was caused also by failure of butt-fusion on similar pipe type (Poly 2 (2306). Accordingly, laboratory investigation on the failed butt-fusion is required from operator. The last odor concentration test on record was done on 08/06/13 at 09:30am using Heath Odorator Serial 1820 at 7900 Smithfield Road. The test found 0.08% gas-in-air at threshold level and 0.33% gas-in-air at readily detectable level. Similarly, the post incident odor concentration test taken on 12/21/13 at 10:43pm at Meter 08K862809, near the scene of incident found 0.17% gas?in-air at threshold level and a strong odor at 1% gas-in-air readily detectable level. The instrument used was Heath Odorator Serial 2762; last calibrated on 12/05/13. The investigation did not find any leak complaint call to Atmos Energy from 7916 Han/vood Road or nearby houses on Harwood Road, prior to the incident. Atmos LUG record considers the North Richland Hills (NRH) system as part of an integrated pipeline asset referred to as the "metro or metroplex system" There are a total of 83 cities in this LUG system, hence, operator does not have an independent LUG for the NRH system. The metroplex system LUG for 12 months rolling period, ending 06/31/2013 was 5.826%. This LUG was found to be under the 10% code threshold; however, due to the fluctuations found in the LUG in some months in the 12 months reviewed, investigation for potential abnormal operating condition may have been imperative during the period. The elimination of the leak involved, shutting-off gas flow in the main at the stopple (installed approx. 85-ft upstream from leak) on the coated steel section of the main. Thereafter, 223/8-inches of the PE pipe where the failed butt?fusion was located was cut-off and replaced with MTD fitting. The leak was permanently repaired by 06:30am (12/22/13) and gas flow on main was reinstated by 05:00pm (12/22/13). Emergency Response (Complete for incident/accident investigations) On 12/21/13, Atmos was notified of the incident at 05:01pm and its first responder arrived on scene at 05:15pm. The emergency action taken by Atmos includes perimeter bar-hole testing of the main and service lines around 7916 Harvvood Rd., while waiting on power company to turn-off power to the scene. The incident was reported to Railroad Commission of Texas and PHMSA by Atmos at 06:10pm and 06:22pm respectively. The result of the leak survey established a natural gas leakage from the gas main in front of the affected property (scene). as well as migration. This information helped to pinpoint the area of the active leak. For precautionary reasons, nearby homes were evacuated and three block radius to the scene were further surveyed for gas leaks. The excavation and isolation of the part of the main leading to accident scene occurred at approx. 01:34am and the total time taken to stop gas flow in the main, from the time, operator was notified was about eight hours. The North Richland Hills (NRH) Fire Department was the first responder to the scene at 04:10pm. According to its account, the fire at the scene was eliminated around 04:23pm and as a precautionary safety measure, there was evacuation of nearby homes and diversion of traffic around the scene. The natural gas distribution system in the area is owned and operated by Atmos Energy, Mid-Tex Division. Information from Atmos Energy indicated that, the company was notified of the incident at 05:01 pm and its first responder arrived onsite by 05:20pm. Following initial assessment, a report on the event was transmitted to both Railroad Commission of Texas and Department of Transportation. Onsite investigation by the Railroad Commission of Texas and Atmos Energy, found a grade one leak with maximum natural gas concentrations of 100 percent on a six (6) inch Poly Ethylene (PE) gas main line, in front of the house. This gas concentration (100 percent) was found over a migration span of 40 feet, towards east side of house. Also found was, 41 percent natural gas concentration in a water meter manhole in front of the house, near street. The leak was later, pinpointed on a failed butt-fusion joint on the 6 inch PE gas main. The natural gas distribution system in the area is owned and operated by Atmos Energy, Mid-Tex Division. The incident resulted in one personal injury and property damage, estimated at $143,194. The estimated natural gas lost was 33MCF. The incident occurred at about 04:00pm on December 21, 2013. Per the home-owner narration, seven (7) people were in the house at the time of the event; however, there was one injury; a seven years old girl. The victim suffered a second degree burn. According to him, the victim went to use the restroom, located in the middle of the house and immediately, she flipped the light bulb, there was an explosion, followed by fire. The force of the explosion pulled the back wall of the house down and outwards and also many of the windows in the house. The North Richland Hills (NRH) Fire Department responded to the scene at 04:10pm and according to its account, the fire at the scene was eliminated around 04:23pm and the building was completely cleared at 02:05am (12/22/2013). There was evacuation of nearby homes and diversion of traffic around the location of the scene, following the incident. Onsite investigation by the Railroad Commission of Texas and Atmos Energy included a natural gas migration survey; conducted by means of bar-hole testing, using Sensit Gold G2 Serial 29981 (calibrated on 11/22/2013), along gas main and service line to 7916 Han/vood Road and also on sewer vents, water-meter?manhole, driveway and around the location. A grade one leak with maximum natural gas concentrations of 100 percent was found on the gas main, in front of the house. The gas concentration (100 percent) was found over a migration span of 40 feet, towards east side of house. Also found was, 41 percent natural?gas concentration in a water meter manhole in front of the house, near street. Further investigation eastward, also found natural concentrations in front of nearby house at 5213 Bob Dr. The leak was pinpointed on a failed butt-fusion joint on the gas main. Furthermore, a special leak survey was also conducted three block radius from scene using, Heath RMLD Serial 800933006 (calibrated on 12/21/20130). Atmos natural gas distribution map system indicates that, the gas main in front of 7916 Han/vood Road is located on map sheet The main shows a 6-inch Poly Ethylene pipe with dead-end at (west) and transitions to 6-inch Coated Steel on HanNood Road Bob Drive (east). The 6-inch PE main was installed in 07/17/1972 by Lonestar Gas Company (operator of the natural gas distribution system at the time) and the pipe was manufactured by Nipak. Atmos archives (records) provided the following information about the PE pipe material: 6 D2513. However, there was neither records on the joining procedure (butt fusion) nor operator qualification connected with the installation. Per Atmos Energy, the MAOP of this main is 60psig, but the average operating pressure (high) in the past five (5) years was 43.5psig. At the time of the incident, the pressure in the main was 38psig. The natural gas service line to 7916 HanNood Road is a %-inch Copper line tied-in to the main via a dresser coupling. There is no record on the date of installation on this service line, as at 1972, customer was responsible for service line. However, the pressure test conducted on the line, held at 38psig for ten minutes. Similar test on house piping also held pressure. On the other hand, the main could not hold pressure due blowing leak on the failed butt-fusion joint. Inves?ganon (Include a probable cause statement for incident/accident investigation) Atmos leak records for NRH system, including mapsheet AG364990 was reviewed. From the records, the last survey was performed on 05/16/2011. The next survey is due in 2014. Records in the last five (5) years show that, there were a total of twenty-three (23) leaks. As at the date of the incident, there was no record of open leak order in the mapsheet, as all of the leaks have been repaired. However, out of the 23 repaired leaks on record, sixteen (16) were found during survey and seven (7) via Leak Investigation Order (LIO). It was important to note that, leak 512767) (LIO 398374) (Grade One) found on 04/03/13 was caused also by failure of butt-fusion on similar pipe type (Poly 2 (2306). Accordingly, laboratory investigation on the failed butt-fusion is required from operator. The last odor concentration test on record was done on 08/06/13 at 09:30am using Heath Odorator Serial 1820 at 7900 Smithfield Road. The test found 0.08% gas-in-air at threshold level and 0.33% gas-in-air at readily detectable level. Similarly, the post incident odor concentration test taken on 12/21/13 at 10:43pm at Meter 08K862809, near the scene of incident found 0.17% gas-in-air at threshold level and a strong odor at 1% gas-in-air readily detectable level. The instrument used was Heath Odorator Serial 2762; last calibrated on 12/05/13. The investigation did not find any leak complaint call to Atmos Energy from 7916 Harwood Road or nearby houses on HanNood Road, prior to the incident. Atmos LUG record considers the North Richland Hills (NRH) system as part of an integrated pipeline asset referred to as the "metro or metroplex system" There are a total of 83 cities in this LUG system, hence, operator does not have an independent LUG for the NRH system. The metroplex system LUG for 12 months rolling period, ending 06/31/2013 was 5.826%. This LUG was found to be under the 10% code threshold; however, due to the fluctuations found in the LUG in some months in the 12 months reviewed, investigation for potential abnormal operating condition may have been imperative during the period. The elimination of the leak involved, shutting-off gas flow in the main at the stopple (installed approx. 85-ft upstream from leak) on the coated steel section of the main. Thereafter, 223/8-inches of the PE pipe where the failed butt-fusion was located was cut-off and replaced with MTD fitting. Emergency Response (Complete for incident/accident investigations) On 12/21/13, Atmos was notified of the incident at 05:01 pm and its first responder arrived on scene at 05:15pm. The emergency action taken by Atmos includes perimeter bar-hole testing of the main and service lines around 7916 Harwood Rd.. while waiting on power company to turn-off power to the scene. The incident was reported to Railroad Commission of Texas and PHMSA by Atmos at 06:10pm and 06:22pm respectively. The result of the leak survey established a natural gas leakage from the gas main in front of the affected property (scene), as well as migration. This information helped to pinpoint the area of the active leak. For precautionary reasons, nearby homes were evacuated and three block radius to the scene were further surveyed for gas leaks. The excavation and isolation of the part of the main leading to accident scene occurred at approx. 01:34am and the total time taken to stop gas flow in the main. from the time, operator was notified was about eight hours. Natural gas concentrations were found on the main in front of the residence 7916 Harwood Rd., with the highest concentration 100% over a migration span of 40-feet towards east side of structure (7916 Harwood Also 41% of natural gas was found in water-meter manhole near street in front of structure (scene). A special leak survey was also conducted three block radius from scene, using Heath RMLD. There were no other leaks found. The next survey is due in 2014. Records in the last five (5) years show that, there were a total of twenty-three (23) leaks found. As at the date of this review on 01/08/2014, there was no record of open leak order in the mapsheet. Out of the 23 repaired leaks on record, sixteen (16) were found during survey and seven (7) were called-in. The pipe material in both leaks was Poly 2 (2306). Pipeline Operation History Description (Repair or Leak Reports, Exposed Pipe Reports): The leak was located on buried 6-in Poly Ethylene (PE) main. The depth of cover on the main from curb was about 36-in. The repair process involved shutting-off gas flow in the main at the stopple (installed approximately 85-ft upstream) on the coated steel section of the main and excavation of the cover through to the 6-in PE pipe. After exposing the pipe, approximately 223/8-in of the PE pipe where the failed butt-fusion was located was cut-off and replaced with MTD fitting. The emergency action taken by Atmos includes perimeter bar-hole testing of the main and service lines around 7916 Harwood Rd., while waiting on power company to turn-off power to the scene. The incident was reported to Railroad Commission of Texas and PHMSA by Atmos at 06:10pm and 06:22pm respectively. The result of the leak survey established a natural gas leakage from the gas main in front of the affected property (scene), as well as migration. This information helped to pinpoint the area of the active leak. For precautionary reasons, nearby homes were evacuated and three block radius to the scene were further surveyed for gas leaks. The excavation and isolation of the part of the main leading to accident scene occurred at approximately 01:34am and the total time taken to stop gas ?ow in the main, from the time, operator was notified was about eight hours.
