Records necessary to administer the operation and maintenance plan were not maintained or were inadequate. 49 CFR 192.603(b) The attached Timeline re?ects that Atmos Energy did in fact "conduct actions that are directed toward protecting people ?rst and then property." This also demonstrates that the Company coordinated and complied with the directives of the ire Department, which had jurisdiction over the scene. With reSpeet to this incident, Atmos Energy immediately responded to the call, dispatching SilVester Williams and a construction-crew to the scene. They both arrived within thirty minutes of when Atmos Energy was ?rst noti?ed of the damage. When Atmos Energypersonnel and equipment arrived at the scene, they immediately coordinated with the Fire Department, who was already present and in control of the scene. The Fire Department had closed the road, inferrned residents of the leak, evacuated the immediate area and informed other residents to report any smell of gas. Relying upon the Fire Department, Atmos Energy personnel at the scene immediately began using a barhole and combustible gas indicator to probe the ground for evidence of migration, deSpite the fact that gas was blowing and venting to atrnOSphere at the rupture site. Extensive probing on the north and south sides of the fence at the incident location (the ?duplex") and around the duplex did not reveal evidence of any migration of gas toward the duplex. This emergency reaponso work was witnessed by independent personnel as described in the Timeline. The Timeline delineates how Atmos Energy complied with its operations and maintenance plan by re5ponding relying up on the control of the scene exercised by the Fire Dep attrnent and proactively ensuring that Company personnel investigated the extent of the leak. The Timeline also establishes that Atmos Energy dispatched construction equipment and personnel to repair the leak. Moreover, Atmos Energy?s training of its emergency responders, service technicians and construction personnel emphasizes the protection of people ?rst and then property. The Company?s training program also emphasizes cempliance with procedures, communication and coordination with ?re department incident commanders who are in control of the scene, and documentation of the response actions. RRC Response to Alleged Violation No. 1 The Railroad Commission (RRC) does not dispute that Atmos Energy did dispatch Mr. Williams and the Construction Crew to the scene. The RRC requested a timeline on numerous occasions and was told that Atmos Energy did not prepare a Timeline. During Records review RRC Investigator Terry Sullivan asked Mr. Marc Chapman if he could get a Timeline and was told that he would have to consult with Atmos Energy Attorneys as to whether or not they were required to prepare a timeline. Also the Timeline now provided does not address that the Atmos Technician failed to turn the Stop Cock to the closed position at 520 E. Main Street. RRC Investigator witnessed and photographed that the Service Meter on the East side of the structure was still in the open position after the explosion when the scene was opened to all investigators. That alone speaks to the fact that Atmos Energy failed to protect Life and Property by not turning the Stop Cock on the service meter located on the east side of the property to the off position when they arrived on the scene. Alleged Violation Item No. 2 Description: Hans. procedures and/orprogroms required by Part 4'9 CFR 192 were not maintained, modified, or followed as necessary. Requirement: 49 CPR 192.l3(c) This allegation incorrectly assumes that gas was detected in the sewer. This was not the case as demonstrated by the extensive probing performed by Atmos Energy personnel, which produced no evidence of migration into the seam or tOWard the duplex. In addition, Annos Energy' training program employs state of the art training to ensure cOmpliance with established procedures for dealing with situations such as this. For example, Atmos Energy reSponse personnel are trained to determine the nature and extent of migration and to locate the gas leak and take action. They are also trained to eliminate sources of ignition in potential areas of accumulation of a ?ammable mix of gas. In this regard, the facts demonstrate Atmos Energy's compliance with these protocols. First, the Fire Department records con?rm that the Fire Department had control of the scene by the time of the pIOmpt arrival at the scene by Atmos Energy personnel. The Fire Department records also con?rm that Atmos Energy personnel were told at the scene that the area had been evacuated. The Fire DepartInent told unevacuated residents to not use ignition sources. The odor of gas was observed as strong. There were no reports of the smell indoors at any time during the two hours that Atmos personnel were present at the scene before the explosion occurred. RRC Response to Alleged Violation Noway suggesting that there was gas in the sewer system. At the time of the investigation Atmos Energy did not provide the records required to determine if there was or was not gas concentrations in the sewer system. The operator is required to perform an accident investigation to analyze accidents and failures. Additionally, employees? actives must be reviewed to determine whether emergency procedures were followed. This consists of the initial amount of gas detected in the sewer and the gas readings taken at homes in the evacuated area. There was also no documentation as to what services had the stop-cocks turned to the closed position. During the field investigation of the debris at 520 E. Main Street. Units A and B, RRC investigator observed that the stop-cock of the service meter in the debris on the east side of the structure was still in the open position. This fact leads the RRC Investigator to disagree that Atmos Energy Technician did in fact eliminate all sources of ignition in potential areas of accumulation of a ?ammable mix of gas. Alleged Violation Item No. 3 Description: The valves on the high pressure distribution system were not adequately spaced so as to reduce the time to shut down a section of mam in an emergency. Requirement: 49 CFR 192.181(a) As an initial matter, 49 CFR l92.181(a) imposes no Speci?c requirements regarding valve Spacing. The Commission?s rules are equally silent regarding this issue. Further, the violation report fails to identify any standard against which the alleged valve spacing deviation can or should be evaluated. In additiOn, the Commission's report inaccurately alleges that no valve was available to shut down the ?ow in the 500 block of East Main Street during the emergency. This allegation ignores the nature of the poly pipe that was lo cated at the scene of the incident. A key feature of poly pipe is that every unearthed section of the pipe can flinction as a valve with the use of squeeze equipment. The Timeline establishes that the Company: (1) arrived at the scene, (2) quickly evaluated the situation consistent with the Fire Department?s cooperation, and (3) ensured the arrival of censtructlon equipment by 11:10 am. In shod, within less than two hours, Annos Energy personnel and equipment were an site, a determination was made where to dig, the pipe was excavated, and Atmos Energy personnel Were in the process of errposing the pipe to apply the squeeze tool When the explosion occurred. Finally, Atmos Energy?s actions are consistent with past practice and balance the need for a mechanical valve on poly pip es with the use of squeeze equipment to create a valve more proximate to a leak. Importantly, the Commission has heretofore agreed that the integrity of the pipeline is maintained by creating valves with squeeze tools rather than installing mechanical valves that require maintenance and create the potential for leaks. These facts, coupled with the absence of any Speci?c rule language imposing mandatory spacing requirements provide evidence for the Commission to withdraw the alleged violation. RRC Response to Alleged Violation No. 3 The Commission's concern is the length of time it took Atmos Energy to eliminate the Grade I situation. The Gas was blowing for approximately Seven Hours and the commission feels that Atmos Energy could have closed a valve at a nearby DRS to stop the flow of gas. Alleged Violation Item Number 4 Description: Procedures to prevent damage by excavation activities were not Waflable or were not followed. Requirement: 49 CFR 192.614(a) As stated by the Commission in its Comments, the Cemmission interprets the rule to require inspection by the operator if there is reason to believe that the pipeline could be damaged by excavation. First, even assuming the Commission?s interpretations are correct, the facts of this incident reveal that the line locate request had expired and was not active at the time of the incident. Given these facts, the Commission's position arbitrarily imposes an unreasonable capectation that the utility has a centinuing obligation to inspect deSpite the exPiration of a line locate request. Second, 49 CFR 192.614(a) does not state that such insPections of the pipeline are required. Even if it did, neither the documents nor the evidence gave Atrnos Energy any reason to believe that TNMP would disregard the rules that require exPosing the gas line before using mechanical equipment and in using mechanical equipment Within the 18 inch tolerance zone. Atmos Energy complied with Part which requires operators to "carry out, in accordance with this section, a Written program to prevent damage to that pipeline from excavation activities." Sections 3.1 to 3.7 of the Operation and Maintenance Manual contain the provisions of the policies of Atmos Energy that comply with the requirements of Part 192614. The Timeline establishes that Atmos Energy complied with Part 192.614. In response to the request for a line locate by on December 17, the line was properly marked With paint and ?ags on December 18 by Heath Consultants. The photographs taken by Heath on December 18 show the preper markings Atmos Energy was provided no information that TNMP was digging on an expired line locate on Jammy 1 1 Without requesting that the marks be refreshed. TNMP never informed Dig-Tess Heath or Aunos Energy of any dif?culty exPosing the gas main before using the auger to drill a hole. never informed either Dig?Tess Heath or Atmos Energy that it was going to use the auger to drill a hole within the 18 inch tolerance zone. Atrnos Energy complied with the requirements of Part 192.614 becahse the evidence indicates that TNMP knew of the requirement to refresh line locate markings. The evidence also indicates that knew of the requirement to espose a gas pipe before using mechanical equipment. The evidence also indicates that TNMP knew to not use mechanical equipment with the eighteen inch tolerance zone. RRC Response to Alleged Violation No. 4 The rule requires that Atmos Energy provide as follows for inspection of pipeline that an operator has reason to believe could be damaged by excavation activities. The Inspection must be done as frequently as necessary during and after activities to verify the integrity of thepipeline. .Atmos failed to follow this aspect of the rule. Should this case go to hearing, Enforcement would be required to seek an administrative penalty of not less than $50,000.00 per violation). During the ?eld investigation of the debris at 520 E. Main Street. Units A and B. RRC investigator observed that the stop-cock of the service meter in the debris on the east side of the structure was still in the open position. The operator can not effectively perform an accident analysis without all pertinent information. On Friday, ?January 11, 2013 at approximately 10:10 am. Texas New Mexico Electric Company was drilling with an Auger to replace a Power Pole when a four-inch polyethylene natural gas distribution pipeline was hit. The Lewisville Fire Department was called and began evacuations. Average wind speed for Friday, January 11, 2013 was 21 in a north direction; evacuations were mandatory for business and residence structures downwind from the gas leak, structures upwind were noti?ed of the gas leak but not required to evacuate, which included the residence at 520 E. Main Street, Unit A and B. Atmos Energy repair crew was on-site, excavating and digging approximately fifteen feet west of the auger to expose the four-inch polyethylene pipeline in order to squeeze off the ?ow of gas. At approximately 12:30 pm. the duplex house located at 520 E. Main Street, in Lewisville, Texas exploded. There was one death and two injuries as a result of the incident. The natural gas pipeline was squeezed off at approximately 4:45 pm. The natural gas distribution system is owned and operated by Atmos Energy. Main Street, Lewisville, Texas caused by a third party hit on a polyethylene natural gas distribution pipeline. Upon arrival the ATMOS technician bar tested for gas concentrations and monitored the natural gas in the atmosphere. There are no notes or documentation showing the results of the technician?s actions. There are also no notes or documentation of ATMOS Energy personnel for the period between ATMOS Energy personnel arrival and the house explosion at 520 E. Main Street, Units A and B. Additional Atmos Energy construction crew arrived and began digging with a backhoe west of the puncture to locate the four-inch polyethylene natural gas pipeline. ATMOS Energy construction crew dug approximately seventy-five feet west of the auger puncture to expose the pipeline and squeeze-off the ?ow of natural gas. The flow of natural gas was squeezed-off at 4:49 p.m. on Friday, January 11, 2013. During on-site investigation the RRC inspector T. Sullivan observed in the debris one of the meters to the structure. The piping was still intact and the Stop-Cock was still in Open Position. Atmos Energy completed repairs on January 12, 2013.
