Plaintiffs consent to coordinating the 14 matter with this Coordination Proceeding; 15 (2) Pacific Gas and Electric Company v. California Department of Water Resources, Butte 16 County Superior Court, Case No. 18-CV-02014, filed June 21, 2018, asserting causes of action for 17 negligence, dangerous condition of public property, premises liability, private nuisance, public 18 nuisance, and interference with easement. VII. RELATED LITIGATION The only related litigation of which the parties are aware and which is not already included above in Section II is the matter of People v. California Department of Water Resources, Butte County Superior Court Case Number 18CV00415. That action involves claims for civil penalties under Fish & Game Code Sections 5650 and 5650.1. The parties agree that the legal and factual issues involved in that action are unique to that action and will have no effect upon, or be affected by, the resolution of any issues germane to this Coordinated Proceeding. To the extent there may be certain discovery in that action that is also required in this Coordinated Proceeding, the parties have agreed to use their best efforts to coordinate that discovery in order to avoid any unnecessary burden on the parties in all actions. 19 VIII. CORE FACTUAL AND LEGAL ISSUES 20 21 A. (1) Plaintiffs’ Claims The Individual Claims allege causes of action for: (a) inverse condemnation; (b) 22 dangerous condition of public property; (c) private nuisance; (d) public nuisance; and (e) premises 23 liability. 24 a. The Inverse Condemnation claims are brought under Article I, § 19 of the 25 California Constitution. The core legal and factual issues under the inverse 26 condemnation claims will be whether DWR’s conduct amounts to a taking or 27 damaging of private property under Article 1, Section 19 of the California 28 ♼ LAW OFFICES COTCHETT, PITRE & MCCARTHY, LLP JOINT CASE MANAGEMENT STATEMENT; JCCP NO. 4974 9 1 Constitution. (Paterno v. State of California (1999) 74 Cal.App.4th 68, 82, 87; 2 Locklin v. City of Lafayette (1994) 7 Cal.4th 327, 368-369.) b. The Dangerous Condition of Public Property claims are brought under 3 4 Government Code section 835. The core legal and factual issues under the 5 dangerous condition of public property claims will be whether DWR had notice of 6 the dangerous condition with enough time to have taken measure to protect against 7 the condition or whether the condition was created by a “negligent or wrongful act 8 or wrongful act or omission of an employee within the scope of his employment.” 9 (Gov. Code, § 835.) 10 c. The Private Nuisance claims are brought under Civil Code section 3479. 11 d. The Public Nuisance claims are brought under Civil Code section 3479. (See Paterno, 74 Cal.App.4th at 103-104.) 12 e. The Premises Liability claims are brought under Civil Code section 1714(a). 13 (See Linvill v. Perello (1987) 198 Cal.App.3d 195, 196). 14 15 (2) The Class Claims allege causes of action for: (a) permanent private nuisance; (b) 16 permanent public nuisance; (c) continuing private nuisance; (d) continuing public nuisance; (e) 17 inverse condemnation; (f) dangerous condition of public property; (g) private nuisance; (h) public 18 nuisance; and (i) premises liability. 19 (3) The Public Entity Claims allege causes of action for: (a) dangerous condition of 20 public property; (b) private nuisance; (c) public nuisance; (d) premises liability; and (e) equitable 21 subrogation. 22 23 24 25 The parties will continue to meet and confer regarding core legal and factual issues that, if heard on an expedited basis, could resolve this Coordinated Proceeding or portions thereof. B. As part of that Joint Discovery Schedule, the parties will include a class discovery schedule. 8 The Class Plaintiffs believe the certification motion should be heard in April 2019, depending on the 9 ability of the parties to begin and complete the limited discovery necessary and availability of the 10 Court. DWR contends that it is premature to set a date for hearing on class certification, as class 11 discovery has not begun and class definitions may change during that process. 12 Regarding damages, the parties are discussing means to exchange relevant information 13 efficiently. The parties will meet and confer within 30 days of the Initial Case Management 14 Conference and submit a Joint Discovery Schedule to the Court by October 26, 2018. As part of that 15 Joint Discovery Schedule, the parties will include a stipulated damages questionnaire to be completed 16 and verified by each plaintiff and class representative without objection, subject to a parties’ right to 17 amend or supplement its responses as discovery warrants. 18 The parties will continue to meet and confer regarding factual issues that, if heard on an 19 expedited basis, could resolve this Coordinated Proceeding or portions thereof. 20 X. JOINT DISCOVERY SCHEDULE 21 A. 22 Prior to DWR moving to coordinate these cases, Special Interrogatories and Requests for Outstanding Discovery Responses 23 Production of documents were propounded on DWR on March 2, 2018 in the City of Oroville matter 24 (no written discovery has been served in any of the other Coordinated cases). DWR responded to the 25 Special Interrogatories on May 7, 2018, and supplemented their responses on May 10, 2018. DWR 26 requested an extension to respond to the Requests for Production of Documents until May 21, 2018. 27 As part of the coordination, the matter was stayed on May 18, 2018. 28 ♼ LAW OFFICES COTCHETT, PITRE & MCCARTHY, LLP JOINT CASE MANAGEMENT STATEMENT; JCCP NO. 4974 12 1 The parties have agreed to continue to meet and confer regarding these outstanding requests 2 as part of creating a Joint Discovery Schedule. The parties agree that the existing stay on discovery 3 remain in place with respect to these requests until the Joint Discovery Schedule has been negotiated. 4 DWR has agreed that, within 14 days of the Case Management Conference, it will begin a rolling 5 production of documents in this litigation. The parties do not intend for this production to be 6 exhaustive or the exclusive means by which responsive documents are produced, and all parties 7 reserve all rights with respect to written discovery requests and related to any documents produced by 8 DWR prior to the negotiation of a Joint Discovery Schedule. B. 9 Joint Discovery Schedule The parties have begun to meet and confer regarding discovery topics, scheduling, 10 11 coordination, limitations, and phasing, if appropriate. Within 30 days of the Initial Case Management 12 Conference, the Parties will continue to meet and confer and will submit a Joint Discovery Schedule 13 to the Court on or before October 26, 2018. As part of that Joint Discovery Schedule, the parties will include: 14 15 (1) A proposal for inclusion of any additional cases to this Coordinated Proceeding; 16 (2) Selection of an electronic service platform; 17 (3) A proposal regarding phased discovery, including a description of the phases and proposed schedule; 18 (4) A proposal for coordination of discovery, including for propounding written 19 discovery and scheduling depositions; 20 21 (5) A proposed Protective Order; 22 (6) A proposed Electronically Stored Information (“ESI”) protocol; and 23 (7) A proposed Damages Questionnaire. 24 25 26 XI. Defendant’s Position: DWR is generally amenable to private mediation but agrees that it is 5 premature to set a schedule at this time. 6 XIII. USEFULNESS OF WRITTEN CASE MANAGEMENT ORDERS 7 The parties believe this matter would benefit from case management conferences every 45 to 8 60 days. The parties believe a case management conference should be scheduled during the week of 9 either October 29 or November 5 to allow the parties and the court to discuss the proposed Joint 10 11 Discovery Schedule. The parties have agreed to meet and confer to negotiate and present to the Court a Joint 12 Proposed Case Management Order in advance of the next Case Management Conference. DWR 13 previously circulated a proposed Joint Case Management Order No. 1, addressing the subjects 14 discussed herein, as well as detailed procedures for the consolidation and coordination of written 15 discovery, the addition of new parties, and other matters routinely made part of case management 16 orders in similar mass tort coordinated proceedings. The parties have begun discussions of these 17 issues and DWR’s initial draft, and will submit to the Court a proposed Joint Case Management 18 Order along with their proposed Joint Discovery Schedule on October 26, 2018, in an attempt to 19 resolve as many of the procedural issues as possible at the outset of this litigation. 20 XIV. TARGET TRIAL DATE AND ESTIMATED LENGTH OF TRIAL 21 22 23 24 25 26 27 28 ♼ LAW OFFICES COTCHETT, PITRE & MCCARTHY, LLP Plaintiffs’ Position: Plaintiffs believe this matter can be ready for trial one year from the initial Case Management Conference. Plaintiffs will have a better understanding of length of trial following the parties’ imminent meet and confer efforts and submission of their Joint Discovery Schedule on October 26, 2018. Plaintiffs request the court set a trial date in September 2019. Defendant’s Position: DWR asserts it is premature to set any trial dates or to estimate the length of any trials at this time. At this early stage, it is impossible to know how many plaintiffs will ultimately file actions, what issues will be raised by those additional actions, whether class actions will survive the certification process, whether separate issue trials will be held, what trial protocol JOINT CASE MANAGEMENT STATEMENT; JCCP NO. 4974 14 1 (e.g., bellwether trials, representative trials, consolidated trials) will be employed and numerous other 2 factors that will be directly relevant to both the timing and length of any trials. Notably, even if 3 plaintiffs’ proposal for an April class certification motion was adopted by the Court, it would not be 4 practical to have any certified class case go to trial the following September. 5 XV. OTHER ISSUES 6 A. 7 The Parties have begun discussion of whether a Master Complaint and Master Answer 8 procedure should be included, as well as the process by which such a complaint and answer would be 9 adopted across the Coordinated Cases. The Parties have also agreed to continue to meet and confer 10 on this subject and will include their proposal(s) in their Proposed Joint Case Management Order in 11 advance of the next Case Management Conference. 12 Master Complaint and Answer Plaintiffs believe, that given the scope claims in this Coordinated Proceeding, their 13 willingness to cooperate amongst themselves to manage this litigation efficiently and effectively, and 14 the appointment of Liaison Counsel, there is no need for a Master Complaint and Answer at this time. 15 Given DWR’s position, Plaintiffs will work with Defendant to determine if there are circumstances 16 which will necessitate a Master Complaint and/or Answer with respect to the individual, public entity 17 and/or class action claims. The Parties will also discuss whether other methods of coordinating the 18 cases, such as scheduling certification in the two class cases to occur concurrently, or any other 19 methods are appropriate. 20 Defendant believes separate Master Complaints for each for the three categories of plaintiffs 21 identified above, Individuals, Classes and Public Entities are appropriate.
