This follow-up evaluation revealed that the customer leak investigation order (LIO 8007380504) regarding 2811 Kessler Ave, Wichita Falls, Texas, had not been presented to the Commission during its initial investigation. The LIO was created on September 3, 2009, noting the caller had reported a strong odor in the air. The ticket was reviewed and closed out on September 9, 2009, without an on-site investigation by Atmos. Should this case go to hearing, Enforcement would be required to seek an administrative penalty of not less than $10,000.00 (one violation of Pipeline Safety Regulation 8.130(c)(2)). However, if by or before September 14, 2012, Atmos pays a $5,000.00 penalty, cures the referenced violation, and signs and returns the attached Consent Order, Enforcement would be willing to accept a fifty percent reduction of the penalty that would otherwise be requested at hearing. The facilities and the subject of the investigation are identified in the attached Safety Evaluation Summary. Investigations are conducted in accordance with pipeline safety requirements of the Texas Utilities Code, Section 121.201 for natural and other gas pipeline facilities and TEX. NAT. RES. CODE, Sections 117.001 and 117.011 (Vernon Supp. 2002) for hazardous liquid pipeline facilities. During the investigation, selected physical conditions, written procedures, and records were reviewed. At the time of this investigation, alleged violations of the minimum safety regulations were found and are detailed in this correspondence. Action should begin immediately to correct the listed violation(s) and submit to this office a schedule and correction plan. The correction plan should be an item-by-item explanation of exactly how and by what exact date each individual violation will be corrected. The date specified in the Safety Evaluation Summary is the date we should receive your plan, not the date you are to have the alleged violation(s) corrected. LIO Number 8007380504-Dated 9/03/2009-11:07 pm, for 2811 Kessler Ave. This Leak Investigation revealed that Atmos determined it was not a natural gas odor the customer was smelling. Atmos called the customer and reported to them at 1:45 a.m. on 9/4/09 that it was due to an Oil Refinery Crude spill and not natural gas related. The ticket was reviewed and closed out by Mike Blair on 9/7/2009. During our investigation on Tuesday, September, 13, 2011 RRC investigators found a news clip describing the Oil Spill at the Hardin Road Refinery that was approximately 5 miles from the Kessler Avenue location. Atmos Energy received approximately 100 calls the night of 9/3/2011 and 9/4/2011 relating the smell created by the crude spill. LIO Number 8006650167-Dated 1/05/2009-9:50 pm, for 2811 Kessler Ave. This Leak Investigation revealed that the glow plug was out on the stove and was not a natural gas leak. A survey was conducted and no gas concentrations were found on the Main, Service or Sewer. The ticket was reviewed and closed out by Mike Blair on 1/06/2009. Cathodic Protection reading was not taken due to the service line being Bare Steel. Plan of Correction from Atmos: 1. After the incident, training was provided to Atmos Technicians and currently the Atmos Technicians are reporting situations that need action. 2. The cause of the failure was determined to be pipe failure and the pipe was not analyzed because the structure siding contained asbestos and required expensive remediation. DECEMBER 12, 2011 San Sein and Terry Sullivan met with Atmos Energy again on Monday, December 12, 2011.
