NARRATIVE OF THE FACTUAL FOR PROBABLE CAUSE: The undersigned certi?es that he I she has just and reasonable grounds to beleive that the hereinafter named defendant did commit the violation as stated above and the factual basis for belief is as follows: On March 28. 2018 l. Deputy Wester. was on patrol in my marked patrol vehicle traveling south on Hwy 71 in Marianna, Florida. While on patrol I observed a silver in color Chevrolet HHR traveling directly in front of me. As the vehicle approached Rocky Creek Road which Is adjacent to Hwy 71. a blue in color pickup truck was traveling north on Hwy 71. As the blue' In color pickup truck drew Closer to the silver' In color Chevrolet I observed the Chevrolet cross the center double yellow line. As a result of the Chevrolet crossing the double yellow line it impeded the flow of traf?c of the vehicles traveling north on Hwy. 71. I then activated my emergency equipment to conduct a probable cause traf?c stop on the silver in color Chevrolet and to ensure that the driver of the vehicle was not having a medical issue or impaired. The vehicle continued traveling south at a slow speed before stopping north of Simsville Road. Upon making contact with the driver she stated that her name was Jodie Willis and that she did not realize she crossed the double yellow line. When asked for her driver's license and insurance she stated that she did not have her license with her and that she would attempt to locate the vehicle's proof of insurance. While speaking with the driver I smelled the odor of marijuana emitting from within the interior of the vehicle. When i asked the driver to exit the vehicle so that I could conduct a probable cause search she stated that she would not be exiting the vehicle. The driver then picked up her cell phone and placed a call. During the phone call I ordered the driver out of the vehicle several times, to which she repeatedly ignored my commands. After advising the driver to exit the vehicle the seventh time I grabbed her left arm and removed her from the vehicle. Once out of the vehicle the driver tensed her body and began attempting to pull away from my grip. I then pulled her hands behind her back and placed handcuffs on her. While walking to the rear of my patrol vehicle I observed that her right hand was closed. as if she was holding an object. The driver then released her hand causing a giass pipe to fall to the ground and roll down a partial hill approximately ten feet from where we were standing. The glass pipe was subsequently recovered. After examination of the glass pipe I observed a substance in the "bowl" of the pipe consistent with that of methamphetamine. The contents were subsequentlyI ?eld tested which returned a presumptive positive for methamphetamine with a distinct color change in the reagent from light pink to dark blue once the substance was introduced therein. - The probable cause search of the vehicle revealed the following: in the front passenger seat a light brown and pink in color purse was located. it should be noted that while initially speaking with the driver she made several movements towards the purse. The interior of the purse contained taro silver in color spoons with a residue on the outside. Adjacent to the spoons, in the purse, a small Clear plastic baggie was located. The baggie contained an off color substance that when held up revealed small "shards" consistent with that of methamphetamine. The contents of the baggie were ?eld tested which returned a presumptive positive for methamphetamine with a distinct color change in the reagent from light pink to dark blue once the substance was introduced therein. NARRATIVE OF THE FACTUAL BASIS FOR PROBABLE CAUSE: The undersigned certi?es that he 1 she has just and reasonable grounds to beleive that the heretoafter named defendant did commit the violation as stated above and the factual basis for belief is as follows: red in color knife was located. There was a visible substance on the blade of the knife consistent with that of methamphetamine. Adjacent to the cup holders in between front driver and passenger seats approximately .97 grams of a green leafy substance was recovered. Based on my training and experience the substance was identi?ed as marijuana. The residue from the items of drug paraphernalia recovered from the vehicle were field tested which yielded a presumptive positive for being methamphetamine. When I walked to the rear of my patrol vehicle the driver asserted that none of the items recovered were hers including the glass pipe that she released from her hand onto the ground. The driver then stated that she originally provided a false name and that her name is Monica Jane Willis. Willis spontaneously stated that she provided a false name becaUse she "was scared? because her license was revoked and did not want to "get in trouble" because she is on probation. It was con?rmed through Jackson County Sheriff's Of?ce dispatch that Willis was on active State Probation with a supervision end date of 11/292021. It was also con?rmed that Willis' license was revoked and that she is a Habitual Traf?c Offender. While seated in my patrol car Willis explained that she was two weeks pregnant and that the handcuffs behind her back was hurting her. I then agreed to move the handcuffs to the front of her body. During the process of moving the handcuffs Willis became irate and once again attempted to pull away from my grip. Willis refused to re-enter my patrol vehicle, which resulted in me having to apply pressure to her right arm and left shoulder in order to gain compliance. At the conclusion of the traf?c stop Monica Jane Willis was placed under arrest for possession of methamphetamine, possession of drug paraphernalia, possession of marijuana less than 20 grams, providing false name to a law enforcement of?cer, habitual traf?c offender, resisting an officer without violence. and Violation of State Probation.
