W.S. 36-4-124 is created to read: 11 12 36-4-124. Non-motorized recreational trail fee. 1 [Bill Number] 2019 1 19LSO-0081 Working Draft 0.4 STATE OF WYOMING (a) Any adult that uses a designated non-motorized 2 recreational trail in Wyoming shall annually obtain a non- 3 motorized 4 Permits under this section shall expire on December 31 of the 5 year the permit is issued. The annual fee for permits shall 6 be ten dollars ($10.00). Permits under this section shall not 7 be required in any location where the department determines 8 that another fee, such as a parking lot fee, makes the fee 9 under this subsection unnecessary. The permit under this paragraph may be a 4 decal or other form as determined by the department; 5 6 (iii) For each nine dollar ($9.00) fee received by 7 the department under this section, deposit one dollar ($1.00) 8 to the Wyoming wildlife and natural resource trust account 9 created by W.S. 9-15-103(a) and the remainder to the non- 10 motorized recreational trails account; 11 12 (iv) Provide a process for individual users and 13 user groups to be provided one (1) or more permits without 14 the assessment of a fee based on the documented number of 15 hours 16 designated trails; that the user or group volunteered to maintain trails advisory 17 18 (v) Consult with the Wyoming 19 council to determine the establishment and maintenance of 20 adequate non-motorized trails in Wyoming. Funds in the non- 21 motorized recreational trails account shall be used for the 22 establishment, operation and maintenance of trails under this 23 paragraph; 3 [Bill Number] 2019 19LSO-0081 Working Draft 0.4 STATE OF WYOMING 1 2 (vi) Establish a process for users to pay an 3 additional voluntary fee of two dollars ($2.00) to fund search 4 and rescue activities at the time of payment for a permit 5 under this section. Any voluntary fees collected under this 6 paragraph shall be deposited in the search and rescue account 7 created by W.S. 19-13-301. 8 9 Section 2. W.S. 19-13-301(a) is amended to read: 19-13-301. Search 10 11 12 and rescue account; created; expenditures. 13 14 (a) The search and rescue account is created. Fees 15 identified in W.S. 23-2-101, 23-2-201, 31-2-404, 31-2-409, 16 31-2-703, 36-4-124(a)(vi), 41-13-109 and 41-13-110 shall be 17 deposited in the state treasury to the credit of this account. 18 19 Section 3.
