The first series of meeting started with meeting the Commissioner Brendon Carr. Commissioner Carr was joined by legal advisors. The purpose of this meeting was to discuss the DK technology and state our position that it employs non-jamming techniques. After a brief discussion on IXI background I described the operation of the DK. Both Commissioner Carr and his legal advisors asked probative questions on why we believe it is not a jamming technology. Commissioner Carr also related a recent ruling on a WiFi case that used a packet data transmission device to prevent users from connecting with any network other than the WiFi network of the transmitting device. We explained in detail the differences between the cited technology and how the DK operates. After lengthy discussion and how the FCC would classify a device like the DK, Commissioner Carr and his legal advisors stated they are leaning toward the position that the DK is not a jammer. However, the DK would be required to pass FCC part 2 and part 15 certification and be subject to further analysis by the various technical groups at the FCC. Commissioner Carr thanked us for coming to the FCC to discuss the issues surrounding the DK and asked us to continue working with his staff.
