As you know, on January 26. 2018, a federal action was filed on behalf of BHUSD over the Purple Line?s environmental impact on Beverly Hills High School arising from the Federal 'l?ransportation Agency?s refusal to select an alternative route that would not travel under historic instructional buildings or planned recreational buildings and its decisions to approve a laydown area adjacent to the high school?s fence line and within extraordinarily close proximity to portable classrooms. Thus. neither BIIUSD, nor Ms. Korbatov can comment on the pending litigation. Nevertheless, BIIUSD asked me to provide you with a summary of publicly available information. Lisa Korbatov has been on the School Board since the plans for the Purple Line Extension were first being explored. BHUSD supported the plans for the project when the plans called for the route to proceed along Santa Monica Boulevard -- a public right of way. A last minute decision was made to reconfigure the route, so that the subway will proceed directly across the campus. beneath historic instructional buildings and planned new construction designed to bene?t the whole community. and through a ?methane zone." As a result. BHUSD knew it had to challenge the changed route. More recently, PTA approved Metro's decision to thoughtlessly site the construction laydown area against the west side of the campus. It will be there for 8 years, compounding the danger and disruption to the campus with ATKINSON, ANDELSON, LOYA, RUUD ROMO Matt Smith September 20, 2018 Page 2 noise. Vibration, higher levels of risk while tunneling, and pollution, negatively impacting air quality potentially impacting the health of students and staff at BHHS. As you know, the BHUSD Board has a ?duciary duty to protect the health and safety of all students and school personnel. In light of the fact that the campus is in an acknowledged methane gas zone, with 70-80 abandoned oil wells in unknown locations, the Board had no choice but to act. Should you have any questions, let me know. Very truly yours, ANDELSON, LOYA, RUUD ROMO Terry T. Tao cc: Michael Bregy. Edi) Lisa Koryatov
