TIME: 2:50pm PLACE: Corner orTeller Avenue and East m" Street, Bronx, NY 1, Lieutenant Paul Gaglin, assigned to Lhe 44'" Precinct of the New York Police Department, being duly sworn, do hereby depose and say: At the above time, date and place, the Respondent intentionally obstructed, impaired, or perverted the administration of law or other governmental function or attempted to prevent a public servant from performing an official function. by means of intimidation, physical force, or interference, and intentionally prevented or attempted to prevent a police officer or peace officer from effecting an authorized arrest of himself, in that: At the above date. time. and place, I was working in my official capacity as a Lieutenant for the New York Police Department. I was in uniform. [was responding to a report ofa stolen cell phone. 1 spoke with the complaining witness, who identified the Respondent as one of the individuals who was involved in the taking of his cell phone. then attempted to arrest the Respondent I tried to grab the Respondent's wrist and told her to come with me. The Respondent yelled at me, in sum and substance: fuck you, I'm not going anywhere. As she yelled that, the Respondent pulled her wrist away from me and started to walk away from me. then grabbed the Respondent's shoulder to try to stop her so that I could place handcufis on her. The Respondent then began to pull her body away from me and flail her arms so that I could not place handcuffs on her. As she was moving away from me and flailing her arms, the Respondent continued to yell, in sum and substance: gel alTof me. I'm not going anywhere was trying to hold the Respondent's arms still. At the time, there was ice on the ground. During the struggle, the Respondent and I both slipped and fell to the ground. On the ground, the Respondent continued to flail her arms llu-ash her body, preventing me from placing handcutrs on her. We continued to Struggle until I was eventually able to place handcuffs on the Respondent.
