This administrative reconsideration is vital to BIA and our members, so we appreciate you talking about the issues with us. As I stated last Thursday, we really need immediate relief from the December compliance deadline. Starting with the three?month delay would be a major help because companies are sending out million dollar checks right now that they could recall if they know they have a few more months to decide. We feel companies should not be expending resources on their compliance strategy until they know the full requirements of the revised Brick MACT, because changes to one standard can significantly change the overall compliance strategy. To assist in evaluating legal options as soon as possible, i have attached a paper describing our need for compliance relief and five legal pathways EPA can use to get there.
