Both Payson and Somerton school districts are at risk of losing their federal and state funding for this year. This is the first year of the Arizona Broadband for Education Initiative receiving assistance from the nonprofit organization Education Super Highway (ESH) a 10 percent Arizona state match and E-Rate will provide an additional 10 percent for infrastructure build-outs. For example, if a school has an ACC000034 NSLP percentage of 80 (federal funds), instead of the school attempting to raise the remaining 20 percent of funds, the state match will fund 10 percent and E-Rate will then cover the final 10 percent. These school districts were one of the first to be approved in the state. I have the state ERATE director all over me about getting these projects completed. Both of these project must be completed and up and running before June 25th. I know this is not your issue, but any help getting these expedited would be greatly appreciated. Which is preferred: rooftop distributed solar or centralized utility-scale solar? From a cost perspective, utility scale solar today is approximately 1/3 the price to install relative to rooftop installations while providing the same environmental benefits. It also has benefits such as tracking that can provide more energy during peak periods on the system. However, some customers have shown the desire to exercise their energy choices and install rooftop solar to suit their individual needs. Additionally, “security and reliability of the grid is an important issue” that must always be considered. “Increased adoption of DERs causes operational and reliability challenges for the grid. These challenges revolve around four main areas: power quality, control of additional resources, additional load on equipment and managing impacts to baseload generation resources. Renewable energy sited at customer locations causes localized voltage issues on the grid because the grid was not originally designed with the concept of mid-circuit DERs and twoway energy flow in mind. It has been shown that it is possible for DERs to negatively impact power quality in localized areas, which can cause loss of efficiency and damage the electrical equipment of customers receiving service on those circuits. Grid scale installations of renewable energy have an advantage because they allow the utility the ability to select the best grid locations to integrate renewable additions as well as engineer power quality corrections into the overall installation. Do you think a clean energy standard that might include nuclear is more or less appropriate for Arizona than a Renewable energy standard that excludes it? Also, there have been various proposals out to extend the states renewable goals to 50% by 2030 or even 80% by 2050. What is the best vehicle for the required investment? Specifically, how much do you think the utilities should fund and build within regulated ratebase (vs third party competitive PPAs and distributed solar)? APS agrees with the Energy Modernization Plan’s (the Plan) “interpretation of clean energy resources as being broader than simply traditionally-recognized renewable energy. The Plan includes generation resources that operate with zero net emissions as clean energy resources. This clean energy definition appropriately recognizes the Palo Verde Generating ACC000062 Station (Palo Verde) as an integral part of the state’s ability to meet the Plan’s ambitious energy goals. Palo Verde is the largest carbon-free generating plant in the country, and the only resource in Arizona that provides continuous carbon-free energy day in and day out – every day. Besides being of vital importance to Arizona, Palo Verde has also become the anchor for the entire Southwest high-voltage transmission system since it began operation in 1986. APS and the state’s electric customers will rely on clean energy production from Palo Verde for the foreseeable future. We should be taking an all of the above approach to cleaner energy. That includes nuclear, renewables and other electrification strategies. With Commissioner Tobin’s Energy Modernization Plan calling for 3 GW of storage by 2030 APS’ plans to add another 500 MW of battery storage over the next 15 years, do you think batteries could become an even greater “disruptive” force within traditional utility generation fleets? The Energy Modernization Plan proposes a statewide goal of 3 GW of energy storage, which is aggressive, but potentially achievable over the long term. While it is not yet clear if the 3 GW goal can be reached without impacting affordability for Arizona’s utility customers, it is clear that energy storage would play an essential role in meeting the plan’s target for 80% clean energy by 2050. ACC000063 Note APS strives to maintain a diverse portfolio with the most economic resources to meet customer needs. APS considers the least cost/best resource to reliably serve customers, especially important is the need to provide reliable service during hot summer days. Replacement resources are evaluated similar to any other resource – that is, based on customer needs and economics. Should the APS system require greater ramping capacity to ensure reliability, a mix of natural gas peakers and cost-effective energy storage technologies would be considered. As new technologies mature, the scope of resources that comprise the portfolio is expected to widen – providing greater diversity to the mix. Additionally, the toolbox for Demand Side Management is being expanded to include smarter or more efficient uses of energy as opposed to simply tracking kWh reductions. From a historical context, when the Energy Efficiency Standard (EES) was developed, customer energy usage patterns were different and focused primarily on lighting and other low-end improvements in energy management. Now with the rapid proliferation of change brought on by energy efficiency and smart home technologies, the EES – which has been in place for almost a decade - will be reviewed and updated as appropriate to reflect the impact of these changes. These savings were achieved by buying less expensive energy from the market when market prices were lower than APS generation costs, and from selling energy into the market when energy prices were higher than APS’s generation costs. Beyond Arizona, the Western EIM has also allowed better integration of renewables in the region and in better optimization of generation resources to meet energy demand in the region. APS then offered to place the service in her name and asked for her social security number to verify her identity (normal practice) as she would be a first time customer. Ms. Reid stated she did not want to provide her social security number so APS asked her if she was willing to provide her driver’s license number instead to place the service in her name. Ms. Reid refused and then disconnected the call. • 06/07/2018 – As APS cannot knowingly continue to bill a deceased customer, the attached letter was generated and mailed to the property address. The letter stated the responsible party would need to contact APS by 06/14/2018 to place the service in their name to avoid an interruption in service at the property. • 06/14/2018 – Ms. Ruth and her family, including Walter Bristow (author of the email below), contacted APS regarding the letter they received. APS offered to place the service in Ms. Ruth’s name and initially asked for her social security number. Ms. Ruth declined to provide it or her driver’s license number so APS informed her she could email the Company a copy of a government issued id. Mr. Bristow then requested to escalate internally as he believed APS should make an exception and not require Ms. Ruth provide any form of identification based on the fact she has been paying the monthly bill. Ms. Ruth eventually provided her social security number over the telephone in order to place the service in her name. APS waived the deposit as a courtesy based on the excellent payment history in Mr. Reid’s name. ACC000114 Clarifying points from Mr. Bristow’s email below as I had an opportunity to review his telephone conversations with APS: • Marissa’s Call – Marissa appropriately advised Mr. Bristow that the primary reason APS asks for a social security number is to verify the customer’s identity. She also informed him that APS will also, with the customer’s authorization, perform a credit check through Equifax in an effort to waive a deposit for new customers. Marissa further explained to him that if the customer declined the credit check then a deposit would be required. In my opinion, Mr. Bristow alludes that Marissa advised him that if a customer does not want to provide any identification then they can pay a deposit and receive service. This is not the case nor was this communicated to him by Marissa. She was very clear that some sort of identification would need to be provided by the customer in order to place service in their name. • Esther’s Call – Esther certainly could have done a better job in her call with Mr. Bristow. She incorrectly advised him that APS became aware of Mr. Reid’s death by “Final Bills Department” as it was Ms. Reid who notified us of his passing when she called on 06/07/2018. I will provide this feedback to Esther’s supervisor as a coaching opportunity. Aside from Esther’s miscommunicating how we became aware of Mr. Reid’s passing, APS appropriately handling this situation. For security purposes, we need to verify who we are doing business with and that is by obtaining either their social security number or another form of a government issued id. This also protects the customer to ensure others aren’t fraudulently establishing service in their name. Please let me know if you have any questions or need any further information. Thanks! It is dated 6/8 and tells her that because APS 'recently' learned that my father-in-law (her husband of 66 years) died, she must call APS by 6/14 or her power will be cut off. Let me say that again, APS sent a letter 6 days ago. It arrived today. It said that it would cut off the power of an 86-year widow who has been an APS customer for 40+ years unless she called them today. Mr. Reid died more than two years ago. She has been paying the electric bill for the past two years. In fact, her name has been on the check APS has been receiving for 40+ years. That is a very bad customer experience. ACC000116 My wife, Mrs. Reid's daughter, called APC this afternoon. The person in the call center wanted to talk with Mrs. Reid. They immediately asked for Mrs. Reid's social security number so that APC could continue the account. Mrs. Reid explained she doesn't give it to anyone -- not even her children. And, she explained, she especially doesn't give it over the phone. At that point, Mrs. Reid suggested that the call center employee talk with me. I am a retired attorney, most recently working in the home office of Genworth Financial, a Fortune 200 insurance company. My primary client was Genworth's call center. I also provided advice to Genworth on data security and privacy issues. It quickly became apparent (and it is my experience having had Genworth's customer call center as my primary client) that the first tier customer service employee was not going to do anything but give me the company line. I asked to be transferred to her supervisor. I'm sorry but I didn't get her name. I then spoke with Marisa (ext. 879489), I asked her why APS needed such personal information. She explained it is so that APS could know who they were doing business with. I asked what happens if a person is unable (or unwilling) to provide a SSN or other government-issued ID. Marisa told me the person could pay a deposit and receive service. She also mentioned that APS, using the SSN, would run a credit check on the person. This sounded to me like the real issue might be that APS wanted the SSN for credit purposes rather than just to know 'who they are doing business with.' I then suggested that perhaps an alternative that might satisfy APS's need to know who they were doing business with. Mr and Mrs Reid have been APS customers over 40 years. Each month they paid their APS will by check. Those checks have Mrs. Reid's name on them. Might APS be willing to look at their records? They would then see that they have been doing business with Mrs. Reid for several decades. They would also see that they've always paid their bill on time. Marisa explained that company policy requires the company get a social security number or other government-issued ID... I asked to be transferred to her supervisor. This conversation was even more interesting. I spoke with Esther (ext 179497). She repeated the company policy. I asked if she might email me a copy of that policy that she and Marisa mentioned. She told me that "APS policies are not available to the public." I asked how APS knew that Mr. Reid has died. After a minute or so (presumably to check the file), she said the "Final Bills Department gets notification" of when people die. I asked if she could explain how they did that without violating the privacy of either Mr. Reid or the family. (I expected her to say they got it from public records.) Instead she told that was beyond the scope of her responsibilities. Okay. That's reasonable. I then asked for a number so I could talk with that department. Esther told me that 'they don't take calls from the public." ACC000117 I asked for the supervisor of that department. "That person doesn't take calls from the public." Interesting. But still reasonable perhaps -- remember I provided legal counsel to a large insurance company and understand the desire to insulate employees from the public. I then asked for that person's supervisor. "That person doesn't take calls from the public." I then figured I might as well go for broke. I asked if she could give me a number for someone in the office of the president of APS? Every company of any size (and APS certainly qualifies), has someone in the president's office who talks with disgruntled customers. Esther's response? "That person does not take calls from the public." "What?" I responded. "You're telling me that there is no way for a customer of APS to pick up the phone and make a complaint?" "The ACC approved APS's guideline that APS will not take customer complaints by phone." I read that back to her and asked if I heard her right. Her response at that point was that I had been told what APS policy was. I then asked if that meant she was unwilling to answer any other questions or talk about this any longer. She repeated that I had been given APS policy on the matter. I then asked her for her suggestion on what I should do now. She suggested I talk with her supervisor. Her supervisor, Rosa, is supposed to call me tomorrow or the next day. Sir, it is hard to believe that the ACC approved a policy that says APS does not have to let customers call to complain. It is hard to believe that you approved a policy that says APS can send a letter when a spouse dies and threaten to turn off power with less than 24 hours notice. It is hard to believe that the ACC does not give APS discretion -especially in this day and age of data breaches -- to consider other factors in determining credit worthiness. And, as often as the statement was made, I do not believe APS is being honest with its customers when it says that the purpose of getting a social security number is so that APS 'knows who it is doing business with.' If you believe that my proposal that they look at their own files is reasonable, could you please have someone in your office intervene and knock some sense into APS? ACC000156 EXCERPT FROM APS’s SEC 1O-K FILING – February 2018 Palo Verde Fuel Cycle — The Palo Verde participants are continually identifying their future nuclear fuel resource needs and negotiating arrangements to fill those needs. The fuel cycle for Palo Verde is comprised of the following stages: • mining and milling of uranium ore to produce uranium concentrates; • conversion of uranium concentrates to uranium hexafluoride; • enrichment of uranium hexafluoride; • fabrication of fuel assemblies; • utilization of fuel assemblies in reactors; and • storage and disposal of spent nuclear fuel. The Palo Verde participants have contracted for 100% of Palo Verde’s requirements for uranium concentrates through 2023 and 50% of its requirements for 2024 and 2025. Additionally, Palo Verde has multiple contracts in various phases of negotiation to procure an additional 2.5 million pounds of uranium concentrates (equivalent to 1.5 years supply). Once these new contracts are completed, Palo Verde will have 100% of uranium concentrates assured through 2026. The Palo Verde participants have also contracted for 100% of its requirements for conversion services through 2021 and 46% of its requirements for 2022 through 2025. Additionally, Palo Verde has two contracts in negotiation to procure an additional 2.9 million kilograms of elemental uranium of conversion services (equivalent to 4.3 years supply). Once these new contracts are completed, Palo Verde will have 100% of conversion services assured through 2027. The Palo Verde participants have also contracted for 100% of its requirements for enrichment services through 2020 and 20% of its enrichment services for 2021 through 2026. Additionally, Palo Verde has several contracts in negotiation to procure an additional 2.3 million separative work units of enrichment services (equivalent to 4.3 years supply). Once these new contracts are completed, Palo Verde will have 100% of enrichment services assured through 2021, 90% in 2022 and 80% in 2023 through 2026. The Palo Verde participants have contracted for 100% of its requirements for fuel fabrication through 2024. Spent Nuclear Fuel and Waste Disposal — The Nuclear Waste Policy Act of 1982 (“NWPA”) required the DOE to accept, transport, and dispose of spent nuclear fuel and high level waste generated by the nation’s nuclear power plants by 1998. The DOE’s obligations are reflected in a contract for Disposal of Spent Nuclear Fuel and/or High-Level Radioactive Waste (the “Standard Contract”) with each nuclear power plant. The DOE failed to begin accepting spent nuclear fuel by 1998. APS is directly and indirectly involved in several legal proceedings related to DOE’s failure to meet its statutory and contractual obligations regarding acceptance of spent nuclear fuel and high level waste. DOE’s Construction Authorization Application for Yucca Mountain — The DOE had planned to meet its NWPA and Standard Contract disposal obligations by designing, licensing, constructing, and operating a permanent geologic repository at Yucca Mountain, Nevada. In June 2008, the DOE submitted its Yucca Mountain construction authorization application to the ACC000157 NRC, but in March 2010, the DOE filed a motion to dismiss with prejudice the Yucca Mountain construction authorization application. Several interested parties have also intervened in the NRC proceeding. Additionally, a number of interested parties filed a variety of lawsuits in different jurisdictions around the country challenging the DOE’s authority to withdraw the Yucca Mountain construction authorization application and NRC’s cessation of its review of the Yucca Mountain construction authorization application. The cases have been consolidated into one matter at the D.C. Circuit. In August 2013, the D.C. Circuit ordered the NRC to resume its review of the application with available appropriated funds. On October 16, 2014, the NRC issued Volume 3 of the safety evaluation report developed as part of the Yucca Mountain construction authorization application. This volume addresses repository safety after permanent closure, and its issuance is a key milestone in the Yucca Mountain licensing process. Volume 3 contains the staff’s finding that the DOE’s repository design meets the requirements that apply after the repository is permanently closed, including but not limited to the post-closure performance objectives in NRC’s regulations. On December 18, 2014, the NRC issued Volume 4 of the safety evaluation report developed as part of the Yucca Mountain construction authorization application. This volume covers administrative and programmatic requirements for the repository. It documents the staff’s evaluation of whether the DOE’s research and development and performance confirmation programs, as well as other administrative controls and systems, meet applicable NRC requirements. Volume 4 contains the staff’s finding that most administrative and programmatic requirements in NRC regulations are met, except for certain requirements relating to ownership of land and water rights. Publication of Volumes 3 and 4 does not signal whether or when the NRC might authorize construction of the repository. Waste Confidence and Continued Storage — On June 8, 2012, the D.C. Circuit issued its decision on a challenge by several states and environmental groups of the NRC’s rulemaking regarding temporary storage and permanent disposal of high level nuclear waste and spent nuclear fuel. The petitioners had challenged the NRC’s 2010 update to the agency’s Waste Confidence Decision and temporary storage rule (“Waste Confidence Decision”). The D.C. Circuit found that the agency’s 2010 Waste Confidence Decision update constituted a major federal action, which, consistent with NEPA, requires either an environmental impact statement or a finding of no significant impact from the agency’s actions. The D.C. Circuit found that the NRC’s evaluation of the environmental risks from spent nuclear fuel was deficient, and therefore remanded the 2010 Waste Confidence Decision update for further action consistent with NEPA. On September 6, 2012, the NRC Commissioners issued a directive to the NRC staff to proceed directly with development of a generic environmental impact statement to support an updated Waste Confidence Decision. The NRC Commissioners also directed the staff to establish a schedule to publish a final rule and environmental impact study within 24 months of September 6, 2012. ACC000158 In September 2013, the NRC issued its draft Generic Environmental Impact Statement (“GEIS”) to support an updated Waste Confidence Decision. On August 26, 2014, the NRC approved a final rule on the environmental effects of continued storage of spent nuclear fuel. Renamed as the Continued Storage Rule, the NRC’s decision adopted the findings of the GEIS regarding the environmental impacts of storing spent fuel at any reactor site after the reactor’s licensed period of operations. As a result, those generic impacts do not need to be re-analyzed in the environmental reviews for individual licenses. Although Palo Verde had not been involved in any licensing actions affected by the D.C. Circuit’s June 8, 2012, decision, the NRC lifted its suspension on final licensing actions on all nuclear power plant licenses and renewals that went into effect when the D.C. Circuit issued its June 2012 decision. The final Continued Storage Rule was subject to continuing legal challenges before the NRC and the Court of Appeals. In June 2016, the D.C. Circuit issued its final decision, rejecting all remaining legal challenges to the Continued Storage Rule. On August 8, 2016, the D.C. Circuit denied a petition for rehearing. Palo Verde has sufficient capacity at its on-site independent spent fuel storage installation (“ISFSI”) to store all of the nuclear fuel that will be irradiated during the initial operating license period, which ends in December 2027. Additionally, Palo Verde has sufficient capacity at its on-site ISFSI to store a portion of the fuel that will be irradiated during the period of extended operation, which ends in November 2047. If uncertainties regarding the United States government’s obligation to accept and store spent fuel are not favorably resolved, APS will evaluate alternative storage solutions that may obviate the need to expand the ISFSI to accommodate all of the fuel that will be irradiated during the period of extended operation. Nuclear Decommissioning Costs — APS currently relies on an external sinking fund mechanism to meet the NRC financial assurance requirements for decommissioning its interests in Palo Verde Units 1, 2 and 3. The decommissioning costs of Palo Verde Units 1, 2 and 3 are currently included in APS’s ACC jurisdictional rates. Decommissioning costs are recoverable through a nonbypassable system benefits charge (paid by all retail customers taking service from the APS system). Based on current nuclear decommissioning trust asset balances, site specific decommissioning cost studies, anticipated future contributions to the decommissioning trusts, and return projections on the asset portfolios over the expected remaining operating life of the facility, we are on track to meet the current site specific decommissioning costs for Palo Verde at the time the units are expected to be decommissioned.
