Janet Rosenberg (“Rosenberg”), having received a Notice of Non-Parte
Subpoena Duces Tecum does herby file through her attorney, James C. Thomas P.C.
her Objection and Response to the Subpoena issued by State Farm Mutual
Automobile Insurance Company and says the following:
1.

That Rosenberg objects to the subpoena because:

It seeks information that:
i.

is not relevant to the claims in the State Farm’s lawsuit;

ii.

is not proportional to the claims at issue;

iii.

is not limited to the two hundred twenty-one (221) patients
that are believed to be at issue in the above entitled matter.

Further that any responsive documents, if any were to exist, are
not in the possession, custody or control of Rosenberg.

2.

Without waiving the foregoing objection, Rosenberg states that she

does not personally have custody, possession or control of any responsive
documents.
