This fifth interim response also responds to the matter of American Oversight v. U.S. Department of Commerce, et al., Civil Action No. 1:18-cv-00534 currently pending in the U.S. District Court for the District of Columbia. The pending Complaint in the above referenced matter is based on USDA’s alleged failure to comply with the applicable time-limit provisions of the FOIA in response to American Oversight’s request for the following: 1. All calendars or calendar entries for any of the following individuals between the date of January 20, 2017, to the date a search is conducted, including any calendars maintained on behalf of these individuals (e.g., by an administrative assistant or a scheduler): • Secretary Sonny Perdue • Deputy Secretary or Administrator to Secretary Perdue • Chief of Staff to Secretary Perdue • Deputy Chief of Staff to Secretary Perdue • Chief of Staff for the Office of Civil Rights, Joby Young • Senior Adviser, Heidi Green 2. Any calendars maintained for the Secretary’s Conference Room, and the Deputy Secretary or Administrator’s Conference Room. Below are the details regarding the DFO’s search for Secretary Sonny Perdue’s calendar. Also below are the details regarding the records found in connection with the search, and a description of the FOIA exemptions applied to select records. VERSIGHT www.dm.usda.gov/foia 2 Search Efforts A search for responsive records was conducted by the Office of the Secretary’s (OSEC) telecommunications provider, Client Experience Center (CEC). This provider performs network services for OCIO to include electronic messaging operations, electronic calendars, blackberry, mobile device management (MDM), file and print, remote access, voice, network, service desk, and other application services. CEC searched those Outlook accounts associated with the Secretary from the time he on-boarded up until the date of its search on December 26, 2017. A total of 334 pages were found to be responsive. The DFO has confirmed that the records provided in this fifth interim response constitute the Secretary’s official USDA calendar and that no other official business calendars (electronic or paper) exist. Following a review of the responsive records, the DFO determined that certain information contained in the records should be withheld pursuant to FOIA Exemptions 5, 6 and 7(C), U.S.C. § 552(b)(5), (b)(6), and (b)(7)(C). Below is an explanation of the information that has been withheld. Application of 5 U.S.C. §552(b)(5) “FOIA Exemption 5” FOIA Exemption 5 protects from disclosure those “inter-agency or intra-agency memorandums or letters which would not be available by law to a party other than an agency in litigation with the agency.” Two of the most frequently invoked FOIA Exemption 5 privileges are the deliberative process and the attorney-client privileges. To fall within FOIA’s deliberative process privilege, the records must be both predecisional and deliberative; the records must precede the adoption of an agency policy and include the opinions, recommendations, or deliberations on a legal or policy matter. The information being withheld under the deliberative process privilege consists of intraand inter-agency, pre-decisional discussions contained in email communications relating to budget and trade negotiations, potential reform initiatives and policy issues, draft agendas never circulated, and recommended talking points not relied upon by agency speakers. By withholding this information, the DFO is protecting the integrity of the agency’s decision-making process and ensuring no inhibition of free and frank exchange between federal personnel. The DFO is also ensuring against the premature disclosure of proposed policy, which could, if released, cause confusion to the public regarding the agency’s policy positions. The DFO is also withholding information under the attorney-client privilege. This privilege protects confidential communication between an attorney and his/her client relating to a legal matter for which the client has sought professional advice. Although this privilege fundamentally applies to facts divulged by a client to his/her attorney, this privilege also encompasses any opinion given by an attorney to his/her client based upon www.dm.usda.gov/foia VERSIGHT 3 those facts, as well as communications between attorneys that reflect client supplied information. Additionally, a few records are being withheld under the presidential communications privilege, which exists to protect advisory communications made to both the President and his close advisers. Application of 5 U.S.C. §552(b)(6) “FOIA Exemption 6” FOIA Exemption 6 permits the government to withhold information regarding individuals in “personnel, medical and similar files” when the disclosure of such information would constitute a clearly unwarranted invasion of personal privacy and where such privacy interests outweigh any public interest which would be advanced by disclosure. For purposes of the FOIA, the public interest is advanced when disclosure of the requested information educates the public about the activities of the government. Portions of the records produced as a result of CEC’s search efforts were withheld under FOIA Exemption 6. These items include the names and contact information of security agents, residential addresses, personal telephone numbers, personal email addresses, business contact information not available online, email addresses tied to members of the Executive Office of the President, names and other information related to interviewees, information related to personnel actions, information related to personal appointments, and places where the Secretary rested overnight (RON). All these items fall under the category of “similar files” because they apply to particular individuals. Release of the names and contact information of security agents, residential addresses, personal telephone numbers and personal email addresses, business contact information not available online, email addresses tied to members of the Executive Office of the President and RON locations could subject individuals to unwarranted or unsolicited communications. With regard to the other items, although not likely to lead to unwarranted or unsolicited communication, they are all still very personal in nature. Since there is a viable privacy interest in this information and no outweighing public interest to be advanced by disclosure, FOIA Exemption 6 authorizes the DFO to withhold these items from release. Application of 5 U.S.C. §552(b)(7)(C) “FOIA Exemption 7C” Exemption 7 protects from disclosure “records or information compiled for law enforcement purposes” that fall within the purview of one or more of six enumerated categories. To qualify under Exemption 7, the information must have been compiled, either originally or at some later date, for a law enforcement purpose, which includes crime prevention and security measures, even if that is only one of the many purposes for compilation. Exemption 7(C) provides that, “records of information compiled for law enforcement purposes” may be withheld from disclosure, but only to the extent that the www.dm.usda.gov/foia VERSIGHT 4 production of such documents “could reasonably be expected to constitute an unwarranted invasion of personal privacy…” In applying Exemption 7(C), the DFO considered whether a significant privacy interest would be invaded, whether the release of the information would further the public interest in shedding light on the operations or activities of the government, and whether in balancing the privacy interests against the public interest, disclosure would constitute an unwarranted invasion of privacy. The information withheld under Exemption 7(C) consists of the information related to the identities of security personnel. These individuals have a significant privacy interest in their identities, which, if known, could expose them to unwarranted invasions of their privacy. Furthermore, releasing their identities would reveal little about the operations or activities of the Government. Therefore, withholding this information is appropriate under Exemption 7(C). The DFO’s review of responsive records is still ongoing. In light of the matter American Oversight v. U.S. Department of Commerce, et al., Civil Action No. 1:18-cv-00534 currently pending in the U.S. District Court for the District of Columbia, administrative appeal rights are not being provided in this response letter.
