I have reviewed the two previous administrative records regarding both the first and second petitions for medical parole, including written statements previously submitted by the District Attorney?s Office and the victim?s family. I have also reviewed recently updated medical information from the Lemuel Shattuck Hospital and MCI?Norfolk, which indicate a significant decline in Mr. Phillip?s medical condition and progression of his disease. As indicated in my September 14, 2018 letter denying Mr. Phillips? second petition for medical parole, I stated that I would reconsider my decision should Mr. Phillips? medical condition deteriorate in the future such that he meets the statutory criteria for consideration of placement on medical parole{ Based upon this updated medical information provided to me, along with the other relevant materials previously submitted to me, including the statements from the District Attorney?s Office and the victim?s family members, I have reconsidered my decision on Mr. Phillips? second petition for medical parole and am hereby granting him medical parole. My decision -renders the-third petition for medical parole moot. I have determined that Mr. Phillips is currently terminally ill within the meaning of the statute and does not pose a public safety risk at this time. I also believe that Mr. Phillips will live and remain at liberty without violating the law and that his release will not be incompatible with the welfare of society. The Parole Board will impose terms and conditions for Mr. Phillips? medical parole that will apply through the date upon which his sentence would have expired. Please be advised that not less_than 24 hours before Mr. Phillips? release on medical parole, pursuant to G.L. c. 127, ?ll9A(e), I will notify the district attorney for the jurisdiction where the offense occurred, the department of state police, the police department in the city or town in which Mr. Phillips will reside and the victim?s family of Mr. Phillips? release and the terms and conditions of his release.
