November 14, 2018 Statement of David Nold in Response to Press inquiries Re: Michael Avenatti Bar Complaint: I have received a letter from the State Bar of California in response to the Bar Grievance that I filed with respect to Michael Avenatti, advising me that it does not currently believe it has clear and convincing evidence of violations of the state?s ethic rules. It has invited a written response within 90 days to supplement the record and assist it in further investigation. Contrary to the malicious and personal attacks leveled against me for filing the Grievance, my motivation has always been solely to bring justice to the government and citizens of Washington State that were victimized by the undisputed and colossal failure of Global Baristas US, LLC ("Global"). Mr. Avenatti has himself claimed that he profited from the sale of the company to the tune of millions of dollars. In turn, there remain unanswered questions regarding what happened to the millions of dollars generated by the company that never reached employees, landlords, or various levels of government. Public records still list Mr. Avenatti as controlling the company, and nobody has risen up to claim ownership or responsibility as his successor. Mr. Avenatti refuses to answer that question, and has gone to great to prevent the public from learning anything about its current ownership structure. That the SBC has thus far been unable to discover the answers to these questions is unfortunate. A license to practice law is a sacred privilege, and one that I still believe imposes duties of morality inconsistent with what has transpired in connection with Global. Recently, several other creditors represented by other attorneys commenced an involuntary bankruptcy against Global (United States Bankruptcy Court, Western District of Washington Cause No. 18?14095). My clients were paid the $1.1 million in judgments obtained against Global, including over $73,000 in sanctions as a result of the Court issuing a finding of Contempt. The bankruptcy will shed light on many of these issues because no longer will those who were running the company be able to hide either their identify or conduct I will not comment further on any matter concerning Mr. Avenatti, choosing instead to focus solely on the interest of my clients. I respectfully ask the media to honor this decision.
