Seastrunk, Lache - then prospective student-athlete and current student-athlete at Baylor University. SUMMARY DISPOSITION REPORT University of Tennessee, Knoxville - Case No. M364 June 4, 2012 A. Case Chronology. 1. How the investigation began. On August 30, 2011, the NCAA enforcement staff interviewed Will Lyles (Lyles), a former representative of Elite Scouting Services and owner of Complete Scouting Services, businesses that provided information related to prospective football student-athletes to institutions, regarding Lyles' involvement in the recruitment of Lache Seastrunk (Seastrunk), a football prospective student-athlete (PSA) in the class of 2010. 1 During his interview with the enforcement staff, Lyles reported that in the summer of 2009, Willie Mack Garza (Garza), former assistant football coach, provided impermissible inducements in the form of transportation, lodging and travel expenses to Seastrunk and Seastrunk's mother. The inducements were provided to enable Seastrunk and his mother to travel to the institution's campus for an unofficial visit. Lyles also provided the enforcement staff with documentation substantiating his purchase of airline tickets for Seastrunk and his mother to travel to Knoxville, Tennessee, and a Money Gram receipt showing that Garza reimbursed Lyles for purchasing Seastrunk's air travel. On August 31, 2011, the NCAA enforcement staff interviewed Garza regarding his acquaintance with Lyles and the institution's recruitment of Seastrunk in the spring and summer of 2009. Garza admitted to using Lyles to recruit Seastrunk and, when presented with the documentation illustrating the payment to Lyles, indicated that the payment was made to reimburse Lyles for the air travel provided to Seastrunk and Seastrunk's mother. In addition, Garza also acknowledged that he provided additional inducements to Seastrunk and his mother in the form of transportation and hotel accommodations in the locale of the institution. Garza reported that neither the then head football coach, nor other members of the then football coaching and athletics department staffs were aware of his activities. 2 1 The violations at issue in this case predate the time period relevant to the university's prior infractions case (Infractions Report No. 354, August 24, 2011) and were discovered through the enforcement staff's interview with an individual (Lyles) whom the enforcement staff and institution had no reason to question in connection with the prior matter. 2 Garza was employed at the institution from January 16, 2009, to January 21, 2010. Garza was interviewed on August 25, 2010, by the enforcement staff and institution concerning the prior infractions matter and he neglected to disclose any information to the staff and institution at that time concerning the impermissible activities detailed in this report. Further, he failed to report his involvement in the violations detailed in this case while he was employed at the institution. A-1 SUMMARY DISPOSITION REPORT June 4, 2012 Case No. M364 __________ 2. Date of verbal notice of inquiry. September 9, 2011. A-2 SUMMARY DISPOSITION REPORT June 4, 2012 Case No. M364 ____________ B. General Overview of Findings. 1. Nature of violations. The acknowledged major violations in this case involve the provision of impermissible inducements in the form of transportation, lodging and travel expenses to a football prospective student-athlete and the prospective studentathlete's mother. In addition, this case involves unethical conduct by a former assistant football coach. 2. Why the case is major. The institution, involved individual and enforcement staff agree that the violations outlined in Finding Nos. 1 and 2 are major violations. The impermissible transportation and lodging violations were not inadvertent, involved significant inducements to a prospective student-athlete and Seastrunk's mother and, are directly related to an unethical conduct finding involving a former assistant coach. 3. Show-cause advisement. Garza is named in and at risk for his involvement in Finding Nos. 1 and 2. Garza has been advised that by consenting to the use of the summary disposition process, he is acknowledging personal involvement in Finding Nos. 1 and 2, and he is at risk for a show-cause penalty in accordance with NCAA Bylaw 19.5.2.2(1). B-1 SUMMARY DISPOSITION REPORT June 4, 2012 Case No. M364 ____________ C. Specific Findings and Narratives. 1. [NCAA Bylaws 13.01.4, 13.1.2.1, 13.1.2.4-(a), 13.1.3.5.1, 13.2.1, 13.2.1.1-(e), 13.2.1.1-(h) and 13.5.1] The enforcement staff, institution and Willie Mack Garza (Garza), former assistant football coach, agree that in June 2009, Garza made impermissible arrangements for Lache Seastrunk (Seastrunk), then football prospective studentathlete (PSA) (Temple, Texas), and Evelyn Seastrunk, his mother, ,to complete an unofficial visit to the institution's campus at no cost to Seastrunk and his mother through the assistance of Will Lyles (Lyles), a representative of the institution's athletics interests. 3 Additionally, Garza provided impermissible transportation and lodging to the Seastrunks while they were in the locale of the institution. Specifically: a. On or about June 19, 2009, Lyles purchased round-trip airline tickets for Seastrunk and his mother to travel from Waco, Texas, to Knoxville, Tennessee, for the Seastrunks to make an unofficial visit to the institution's campus. Lyles made the purchase with Garza's knowledge and consent, and with the understanding that Garza would reimburse him for the cost of the airline tickets at a later date. The cost of the air travel was approximately $1,477. Following Seastrunk's visit, and on or about July 5, 2009, Garza provided Lyles a Money Gram in the amount of $1,500 to reimburse Lyles for the purchase of the Seastrunks' round-trip airline tickets. Additionally, around the time that Garza made the arrangements for the Seastrunks, Lyles had impermissible telephone and off-campus contacts with the Seastrunks regarding those arrangements. [NCAA Bylaws 13.01.4, 13.1.2.1, 13.1.2.4-(a), 13.1.3.5.1, 13.2.1 and 13.2.1.1-(e)] b. On June 20, 2009, upon the Seastrunks' arrival in Knoxville, Garza provided the Seastrunks impermissible automobile transportation from the McGhee Tyson Airport to the institution's campus where Seastrunk and his mother met with various members of the football coaching staff. Later that day, Garza provided the Seastrunks impermissible local transportation to a restaurant and a hotel near the institution's campus. On June 21, 2009, Garza provided the Seastrunks with impermissible automobile transportation from the hotel to the McGee Tyson Airport. [NCAA Bylaws 13.2.1 and 13.5.1] 3 Lyles is considered a representative of the institution's athletics interests only as a result of the manner in which he was used by Garza in the recruitment of Seastrunk, and his related involvement in these violations. C-1 SUMMARY DISPOSITION REPORT June 4, 2012 Case No. M364 __________ c. On June 20, 2009, Garza paid for the Seastrunks' one night of lodging at a hotel near the institution's campus. [NCAA Bylaws 13.2.1 and 13.2.1.1(h)] The institution, Garza and the enforcement staff agree with this finding and that these facts constitute violations of NCAA legislation. Supporting Narrative: In the spring of 2009, Garza was responsible for recruiting prospective studentathletes in the state of Texas. Garza reported that he first met Lyles in approximately April or May 2009 when Lyles was serving as a representative for Elite Scouting Services, a company with which the institution subscribed to receive information regarding high school football prospective student-athletes. Garza first met Lyles at a hotel in Houston, where Lyles provided him with information regarding Texas area prospective student-athletes and highlight films of some PSAs on DVD. Garza's institutional telephone records demonstrate at least weekly - at times, daily - telephone contact between Garza and Lyles beginning in May 2009 and continuing through July 2009. Garza's calls with Lyles continued on a less frequent (monthly) basis from August 2009 through January 2010 (Exhibit NCAA 3). Garza reported that, at some point, he became aware that Lyles had a relationship with Seastrunk (class of 2010) and Seastrunk's mother, and that he began discussing Seastrunk's interest in attending the institution with Lyles. In the summer of 2009, Lyles and Garza discussed the possibility of Seastrunk and his mother traveling to Knoxville, to make an unofficial visit to campus and meet with the football coaching staff. 4 Thereafter, Lyles contacted Seastrunk's mother regarding her and her son's availability to travel to Knoxville. On June 19, 2009, Lyles purchased round-trip airline tickets from Waco, to Knoxville, on Continental Airlines, departing June 20 and returning June 21, at a cost of $1,446.80 (Exhibit NCAA 3). Lyles reported that he purchased the airline tickets with the understanding that he would be reimbursed by Garza for the cost of the tickets. On June 20, 2009, Seastrunk and his mother arrived at the Knoxville airport where they were transported to campus, a distance of approximately 12 miles, by Garza to meet with members of the football coaching staff. Seastrunk arrived on or about the last day of the institution's summer football camp. Following meetings with the football coaching staff, Garza transported Seastrunk and his 4 It should be noted that had Garza and Lyles waited approximately 60 days, Seastrunk would have been eligible to make an official, expenses-paid visit to the institution with his mother. Garza reported that the following day, June 21, 2009, he went to the hotel to pick up Seastrunk and his mother, paid approximately $100 for their one-night stay (in cash), and transported them to the airport for their return trip to Texas. On July 5, 2009, Garza sent Lyles a Money Gram in the amount $1,500 using funds from his personal bank account at Bank of America (Exhibit NCAA 3). During Garza's August 31, 2011, interview with the enforcement staff he confirmed that he sent the $1,500 Money Gram to Lyles to reimburse Lyles for the cost of the Seastrunks' airline travel (Exhibit NCAA 3). 2. [NCAA Bylaws 10.1, 10.1-(c) and 10.1-(d)] The enforcement staff, institution and Willie Mack Garza (Garza),former assistant football coach, agree that during the 2009-10 and 2010-11 academic years, Garza acted contrary to the NCAA Principles of Ethical Conduct when he knowingly engaged in violations of NCAA recruiting legislation and when he failed to deport himself in accordance with the generally recognized high standards of honesty and sportsmanship normally associated with the conduct and administration of intercollegiate athletics by initially providing false and misleading information to the institution and the enforcement staff regarding his knowledge of, and involvement in violations of NCAA legislation. Specifically: a. As set forth in Finding No. 1, Garza knowingly provided, and/or arranged for the provision of impermissible transportation, lodging and travel expenses to Lache Seastrunk (Seastrunk), then football prospective student-athlete, and Evelyn Seastrunk, his mother, ,in conjunction with their June 2009 unofficial visit to the institution's campus. [NCAA Bylaws 10.1 and 10.1-(c)] b. On August 25, 2010, when questioned by the institution and enforcement staff about his knowledge of or involvement in any possible violations of NCAA legislation at the institution, Garza failed to disclose his involvement in the violations concerning Seastrunk's visit in June 2009. Further, on August 31, 2011, when questioned by the enforcement staff about the specifics related to Finding No. 1, Garza initially denied his knowledge of or involvement in the alleged violation. However, when Garza was confronted with information concerning the alleged violation, he then acknowledged his involvement in the matter. [NCAA Bylaws 10.1 and 10.1-(d)] The institution, Garza and the enforcement staff agree with this finding and that these facts constitute violations of NCAA legislation. C-3 SUMMARY DISPOSITION REPORT June 4, 2012 Case No. M364 __________ Supporting Narrative: With regard to Finding No. 2-a, the information in the supporting narrative for Finding No. 1 illustrates that Garza knowingly provided, and/or arranged for the provision of, impermissible inducements to Seastrunk and his mother. During Garza's August 31, 2011, interview with the enforcement staff, Garza confirmed that he provided the Seastrunks with impermissible inducements in the form of transportation, lodging, and reimbursement for travel expenses. (See Exhibit NCAA 3, Garza's August 31, 2011, transcript, pages 48 through 51.) Garza knew that his actions were impermissible pursuant to NCAA regulations and engaged in the activities without the knowledge of the then head football coach or other members of the football coaching and athletics department staffs. With regard to Finding No. 2-b, Garza was initially interviewed by the institution and enforcement staff on August 25, 2010, regarding his knowledge (or potential involvement) in the possible rules violations being reviewed by the institution and enforcement staff at that time. 5 The prior interview with Garza did not specifically address activities related to Seastrunk; however, the institution's football recruiting practices were discussed relative to prospective student-athletes in the class of 2010. Garza did not provide any information regarding his recruitment of Seastrunk or involvement with Lyles (Finding No. 1). However, during Garza's August 25, 2010, interview, the institution and enforcement staff provided Garza with the opportunity to provide information regarding any other potential violations that occurred during his tenure at the institution. Specifically, the enforcement representative and Garza had the following exchange: Joyce Thompson (JT), associate director of enforcement. Willie Mack Garza (WM), former assistant football coach. JT: Okay. Coach Garza, this is your opportunity to ask me questions. So do you have, first of all, let me ask you one last questions, are there any violations that you are aware of that were committed by the University of Tennessee's football coaching staff that I haven't asked you about that you want to share at this particular time. 5 At the time of Garza's August 25, 2010, interview, the enforcement staff and institution were engaged in a joint review of information concerning the 'university's football program. Garza's interview was not specific to his involvement in any particular potential violation. Garza was no longer employed at the university, and his interview was conducted at his then current institution (University of Southern California). C-4 SUMMARY DISPOSITION REPORT June 4, 2012 Case No. M364 __________ WG: Any violations at Tennessee that weren't public notice already? Uh, none that I can recall, you know. [Excerpt from Garza's, August 25, 2010, transcript, page 53] Garza chose not to address the issues related the recruitment of Seastrunk during the institution and enforcement staff's initial inquiry into recruiting practices in the sport of football, despite Garza's understanding that the activities in which he engaged as set forth in Finding No. 1 were contrary to NCAA regulations. Further, on August 31, 2011, when questioned by the enforcement staff about his involvement in the arrangement of air travel and lodging for Seastrunk and his mother during an unofficial visit, Garza denied his involvement. Specifically, the enforcement staff and Garza had the following exchange: Jackie Thurnes (JT), associate director of enforcement. Willie Mack Garza (WG), former assistant football coach. JT: Well talk to me about the camp. How was it determined - what was your understanding as to how he decided he wanted to come out and how he got from Temple to Knoxville? WG: I don't know. He caught a flight far as I know. He caught a flight and his mom and I think the guy in the community, the pastor at the church, I guess they purchased him a ticket to fly out to Tennessee. [Excerpt from Garza's August 31, 2011, transcript, page 13.] JT: Do you know how their hotel was being paid for? WG: Miss Seastrunk paid for it. [Excerpt from Garza's August 31, 2011, transcript, page 17.] Despite Garza's initial denials, when he was presented with objective proof of violations of NCAA legislation in the form of documentation of the Money Gram that Garza sent to Will Lyles, Garza eventually conceded that violations of NCAA legislation occurred and admitted to his culpability. Specifically, Garza stated as follows: Jackie Thurnes (JT), associate director of enforcement. Willie Mack Garza (WG), former assistant football coach. C-5 SUMMARY DISPOSITION REPORT June 4, 2012 Case No. M364 __________ JT: I wanna make sure that I understand your testimony now. So you're saying that this $1,500.00 that's indicated on this money transfer, that was to reimburse Will for the Seastrunk's flight to Knoxville? WG: Yes. JT: For their visit to Knoxville. WG: Yes. JT: But are you also saying that within that $1,500.00 you were reimbursing him for DVDs, too? WG: Yes. Yes. JT: So about $23.00, $25.00 per DVD? WG: It was really for the flight. [Excerpt from Garza's August 31, 2011, transcript, page 35.] JT: What about their hotel expenses? Did you help them with their hotel expenses? WG: Yes. [Excerpt from Garza's August 31, 2011, transcript, page 48.] C-6 SUMMARY DISPOSITION REPORT June 4, 2012 Case No. M364 ____________ D. The Parties' Statements and Overall Positions on the Infractions Case. 1. Institution's overall position on the infractions case. The institution's overall position is that the violations set forth in Finding Nos. 1 and 2 occurred and that, by NCAA definition, they are major in nature. Its statements are incorporated in the supporting narrative sections that accompany those findings in the summary disposition report. Additional commentary from the institution is contained in its concluding statement in Section F, below. 2. Statement submitted by Willie Mack Garza. To Whom It May Concern: This letter is to inform you that our offices represent Mr. Willie M. Garza arising out of the Summary Disposition Process for an investigation concerning impermissible payments to Lache Seastrunk. Furthermore, this letter is in support of Mr. Garza who acknowledges responsibility for his involvement with Mr. Seastrunk. Throughout his coaching career, Mr. Garza has been committed to working with student-athletes and impressing upon them the importance of values such as hard work, trust, loyalty, teamwork, discipline, winning, integrity and commitment to excellence. His goal is to make sure that these football players are prepared to win both on and off the field. He has been a role model for many AfricanAmerican athletes who were raised by their single mothers and lacked a positive African-American male figure in their lives. For Mr. Garza, education is the priority over athletics. He received a bachelor's degree in social work from the University of Texas at Austin in 1993 where he was a star athlete. He also has continued his education by taking classes towards his Masters of Social Work. He has been an Assistant Coach (specializing in the secondary) since 1997. His most recent stints were with the University of Tennessee, Knoxville, and the University of Southern California. Mr. Garza recognizes his mistakes with Mr. Seastrunk but he is hopeful to continue coaching at the collegiate ranks. We are hopeful that the committee on infractions will look at his continuous body of work and not just this one investigation when deciding his coaching fate. Enforcement staff's overall position on the infractions case. The enforcement staff regards this as a serious infractions case and takes the position that the major violations that occurred in the sport of football were the result of actions of the then assistant football coach. The enforcement staff notes that the institution cooperated fully with the enforcement staff's investigation, produced documents that were requested by the enforcement staff and reported additional violations to the staff that it discovered in the course of reviewing the requested information. D-2 SUMMARY DISPOSITION REPORT June 4, 2012 Case No. M364 ____________ E. Review of Other Issues. 1. Unresolved allegations. There are no unresolved allegations in this case. 2. Institutional control. The enforcement staff determined that there was not sufficient evidence to support a finding of failure to monitor or lack of institutional control on behalf of the institution. The enforcement staff reviewed information provided by the institution in its previous infractions matter, Case No. M339, regarding its rules education and monitoring efforts, and concluded that additional monitoring strategies would not have detected the violations of NCAA legislation involving the PSA and the PSA's mother. The enforcement staff notes that although additional protocols may have been used to track the unofficial visit of the PSA, it is unlikely that such a system, in and of itself, would have revealed the local transportation and lodging violations. Further, additional monitoring efforts would not have prevented the then assistant coach's arrangement of air travel, the assistance in recruiting provided by the third party (Lyles), or the former coach's subsequent reimbursement of air travel expenses. Ultimately, the findings set forth herein were the sole result of the actions of the then assistant football coach to circumvent NCAA rules and conceal the violations. Finally, the enforcement staff notes that the former head football coach did not know, and had no reason to know, that Garza agreed to reimburse Lyles for the cost of the airline transportation for the Seastrunks or that Garza provided the one-night of lodging and local transportation. As a result, it was decided not to include a head coach's monitoring finding. 3. Secondary infractions. During the course of the enforcement staff's investigation, the institution reported additional violations of NCAA legislation that involved issues that were reviewed by the enforcement staff in the course of the major case set forth herein. The institution and enforcement staff agree with these findings and that the facts constitute violations of NCAA legislation. E-1 SUMMARY DISPOSITION REPORT June 4, 2012 Case No. M364 __________ a. [NCAA Bylaw 13.1.3.1] From April to November 2009, Garza made 10 impermissible telephone calls to Seastrunk and his mother. b. [NCAA Bylaw 13.14.3] It is alleged that in 2009, the football program paid for a subscription to Elite Scouting Services (ESS), a recruiting or scouting service, and used that service in a manner that was contrary to NCAA legislation. Specifically, the football program paid $6,000 to ESS and received impermissible oral reports from ESS representatives Charles Fishbein and Lyles. 4. Student-athlete reinstatement requests. None. 5. Miscellaneous issues. None. E-2 SUMMARY DISPOSITION REPORT June 4, 2012 Case No. M364 ____________ F. Institution's Corrective Actions and Penalties. 1. Overview of institution's investigation. The institution was notified of the enforcement staff's review of matters involving Garza (a former member of its football coaching staff), Lyles and Seastrunk in August 2011. From that point forward, the institution cooperated with the enforcement staff in gathering information and documentation relating to Seastrunk's recruitment and the recruiting/scouting services used by the football program. Given the limited nature of the violations - and that Garza was no longer employed by the institution and Seastrunk was not a student-athlete at the institution - an independent inquiry of the matter was not conducted by the institution. However, while preparing information for the enforcement staff, it did identify the secondary violation set forth in Finding No. 3-a. 2. Institution's corrective actions. The institution has taken the following corrective actions to address the violations that occurred: 6 a. Restructured its compliance staff to enhance recruiting monitoring, including the addition of a staff member; and, b. Enhanced unofficial visit reporting procedures for all sports. In addition, prior to the start of the 2012-13 academic year, the compliance staff will: a. b. 3. Conduct mandatory education for all sports using recruiting services; and, Conduct a recruiting specific education program with the current football staff, focusing on unofficial visits and individuals associated with PSAs. Institution's proposed penalties. The institution reviewed the "presumptive penalty" for major violations set forth in Bylaw 19.5.2.1, as well as the additional penalties available to the NCAA Division I Committee on Infractions and the Committee on Infraction's case precedent in previous infractions cases. 6 Subsequent to the prior infractions case, the university made a series of personnel changes to its athletics administration. Although these corrective actions noted in this section are relevant and partly responsive to the findings cited in this report, they were not taken solely as a result of the findings in this case. F-1 SUMMARY DISPOSITION REPORT June 4, 2012 Case No. M364 __________ Additionally, the institution carefully weighed the nature and timing of the violations in this case with the potential impact on its current football program. In that regard, the institution urges the Committee on Infractions to recognize the following factors that the institution considered in imposing penalties: a. The former assistant coach is no longer employed at the institution and has not been employed at the institution since January 21, 2010 (the former head coach and recruiting coordinator are no longer employed at the institution, and have not been employed at the institution since January 12, 2010); b. Seastrunk committed to (and attended) another institution; and c. Seastrunk's unofficial visit predated his first opportunity for a permissible, expense-paid, official visit by only 60 days, and he never made an official visit to the institution. Further, the institution considered the significant self-imposed penalties that it imposed upon the football program in the prior case, and it believes that had this set of violations been known at that time, the penalties in that case would still have been substantially the same. The recruiting-related penalties imposed and accepted by the Committee on Infractions in the prior case are summarized in Section G, item 3, below. Nevertheless, the institution has self-imposed the following penalties as a result of this set of violations: a. Restricted the current football staff to hosting 49 official visits for the 2012-13 academic year. The restriction constitutes a two visit reduction from the program's four-year average of 51, and a seven visit reduction from the number (56) permitted under NCAA legislation; b. Reduced by four, from 168 to 164, the number of evaluation days permitted by the current football staff during the 2012 spring evaluation period. The reduction represents a two-for-one penalty for each former coach (Garza and the former head coach) who met with Seastrunk and his mother during his unofficial visit; The university will continue to be subject to probation for two years, ending August 23, 2013. Extension of the probationary period was not warranted because: (1) the violations in this case relating to travel occurred during the time period encapsulated by the investigation of the prior case; (2) had the travel violations been processed as a part of the prior case, the addition of these findings F-2 SUMMARY DISPOSITION REPORT June 4, 2012 Case No. M364 __________ would not have impacted the length of the probationary period imposed in that case; and, (3) the unethical conduct violation took place while Garza was an employee at the University of Southern California (Southern California), working for Lane Kiffin, head football coach, and thus should not be factored into institutional penalties for the University of Tennessee, Knoxville (Tennessee). 4. Conference actions. The Southeastern Conference has been notified of the violations in this case and has not imposed any punitive or corrective actions. 5. Application of NCAA Bylaw 19.5.2.1.2. The enforcement staff and institution agree that Bylaw 19.5.2.1.2 does not apply to the circumstances of this case. F-3 SUMMARY DISPOSITION REPORT June 4, 2012 Case No. M364 ____________ G. Background Information on the Institution. 1. General information. Tennessee is an NCAA Division I Football Bowl Subdivision (FBS) and Southeastern Conference (SEC) member institution. Total enrollment on the institution's main campus in Knoxville, Tennessee, is approximately 30,000 students. The institution's academic calendar is divided into semesters. The institution offers 20 NCAA-sponsored varsity sports: nine varsity sports for men (baseball, basketball, cross country, football, golf, swimming and diving, tennis, and indoor and outdoor track and field) and 11 varsity sports for women (basketball, cross country, golf, rowing, soccer, softball, swimming and diving, tennis, indoor and outdoor track and field, and volleyball). 2. Overview of the athletics department structure. The institution's current organizational charts for the department of athletics are provided as Exhibit NCAA 6. 3. Previous major infractions cases. Tennessee has been involved in three prior major infractions cases. August 24, 2011 The institution's most recent major infractions case involved major and secondary violations in its men's basketball program, secondary violations involving the football program and a failure to monitor by the institution. [As noted in the institution's statement (Section I, below) the violations set forth in this summary disposition report occurred prior to the secondary violations involving the football program in the prior infractions case.] A summary of the violations found by the Committee on Infractions and penalties imposed is as follows: a. Members of the men's basketball coaching staff placed 94 impermissible telephone calls to 12 PSAs over a two-year period. [NCAA Bylaws 13.1.3.1, 13.1.3.1.2 and 13.1.3.1.7] b. Members of the men's basketball coaching staff had impermissible, offcampus contact with three PSAs at the head coach's home and provided G-1 SUMMARY DISPOSITION REPORT June 4, 2012 Case No. M364 __________ the PSAs and their families with an impermissible meal. [NCAA Bylaws 13.1.1.1, 13.2.1, 13.5.3, and 13.7.2.1.1] c. The former head men's basketball coach violated the NCAA Principles of Ethical Conduct, failed to promote an atmosphere for compliance and failed to monitor the compliance activities of his assistant coaches. [NCAA Bylaws 10.1-(c), 10.1-(d), 19.01.2, 32.1.4 and 11.1.2.1] Three assistant coaches were cited for failing to cooperate and act with honesty and sportsmanship. [NCAA Bylaws 10.01.1, 11.1.1, 19.01.3 and 32.1.4] d. Secondary violations in the men's basketball program involved three occasions wherein the program inadvertently exceeded the 48-hour period for official visits. [NCAA Bylaw 13.6.4] e. Secondary violations in the football program included: (1) Members of the football staff placing 16 impermissible telephone calls to five PSAs during a competition. [NCAA Bylaw 13.1.7.2] (2) In-person, off-campus recruiting contacts by a recruiting intern. [NCAA Bylaws 11.5.1, 11.7.1.1.1.1, 13.1.2.1 and 13.1.2.1.1] (3) In-person, off-campus contacts by non-coaching staff football office student workers with three PSAs and an assistant coach's provision of cash to the student workers to assist with costs associated with travel to make the impermissible contacts. [NCAA Bylaws 13.01.4, 13.02.14-(c), 13.1.2.1.1 and 13.14.1] The Committee on Infractions placed the institution on probation for a period of two years, required the institution to develop and implement a comprehensive educational program to instruct coaches and athletics department personnel on NCAA legislation and instructed the institution to file annual progress reports with the enforcement staff. In addition, the Committee on Infractions imposed a three-year show-cause period on the former head men's basketball coach and a one-year show-cause order on each of the three former assistant men's basketball coaches. Additionally, the institution self-imposed the following corrective and disciplinary actions: a. Men's basketball - terminated the employment of the involved head and assistant men's basketball coaches (following significant salary reductions G-2 SUMMARY DISPOSITION REPORT June 4, 2012 Case No. M364 __________ initially imposed); prohibited off-campus occasional meals for the men's basketball team for a one-year period; reduced the number of permissible recruiting person days, telephone calls to PSAs, and official visits; restricted the former head and assistant coaches from off-campus recruiting for varying time periods, up to one year; required the former men's basketball staff to attend an NCAA Regional Rules Seminar. Also, prior to the termination of the former head coach's employment, he served an eight-game suspension imposed by the Southeastern Conference. b. Football - issued letters of admonishment to the former head coach and former recruiting intern, reduced the number of coaching staff members permitted to make recruiting telephone calls during the first day of the November 2011 contact period, permanently restricted non-coaching staff members from recruiting-related travel and prohibited recruitment of PSAs at the high school attended by the recruiting intern for a nine-month period. Additionally, the Southeastern Conference prohibited the football program from sending any recruiting correspondence, including National Letters of Intent and financial aid agreements, to PSAs at the high school attended by the recruiting intern. September 18, 1991 The institution's major infractions case in 1991 involved the football program. A summary of the violations found by the Committee on Infractions and the penalties imposed is as follows: a. An assistant football coach arranged for a PSA to receive a round-trip airline ticket on a credit basis from a Knoxville-area travel agency for the PSA to travel to the institution's campus to attend the institution's summer football camp. [NCAA Bylaw 13.2.1] b. An assistant football coach made in-person, off-campus recruiting contacts with two PSAs at the their high schools prior to the completion of the their junior years of high school. [NCAA Bylaws 13.02.3 and 13.1.1.1] c. Violations of Bylaws 13.02.3, 13.1.1.1, 13.1.4 and 13.6.1. (1) On two occasions, an assistant football coach made in-person, offcampus recruiting contacts with a PSA's parents and, on at least one occasion, the PSA's sister, prior to the completion of the PSA's junior year of high school; G-3 SUMMARY DISPOSITION REPORT June 4, 2012 Case No. M364 __________ (2) (3) d. On one occasion, during the institution's summer football camp, the assistant coach provided impermissible local automobile transportation to the PSA's sister; and On two occasions during the institution's summer football camp, the assistant coach made in-person, off-campus recruiting contacts with the parents and sister of a PSA at two different restaurants in Knoxville. The former assistant coach violated the NCAA Principles of Ethical Conduct by knowingly violating NCAA rules concerning the aforementioned violations. Also, following an interview with the enforcement staff, the assistant coach contacted a high school principal and asked that the principal not disclose the contact to the NCAA. The NCAA had directly instructed the assistant not to make any such contact. [NCAA Bylaws 10.01.1, 10.1-(c), 10.1-(d) and 19.01.2] The Committee on Infractions placed the institution on probation for a period of two years, required the institution to develop and implement a comprehensive educational program to instruct coaches and athletics department personnel on NCAA legislation and instructed the institution to file annual progress reports with the enforcement staff. The institution self-imposed the following corrective and disciplinary actions: the involved assistant coach was suspended and later terminated; the head coach was instructed not to fill the coaching position left vacant by the involved assistant coach; reduced the number of football grants-in-aid to 85 for a two-year period; and finally, the university's president advised all coaches and athletics administrators that future salary adjustments and other personnel actions would depend upon their continued and increased attention and adherence to NCAA, conference and institutional rules and regulations. October 9, 1986 The institution's first major infractions case involved the football program and primarily involved extra benefits provided by a representative of the institution's athletics interests. A summary of the violations found by the Committee on Infractions and penalties imposed is as follows: a. On several occasions, a representative of the institution's athletics interests provided a student-athlete with the personal use of automobiles at no cost to the student-athlete. Further, the representative permitted the student- G-4 SUMMARY DISPOSITION REPORT June 4, 2012 Case No. M364 __________ athlete to charge the cost of gasoline to his credit card, and he provided the student-athlete meals and lodging in his home at no cost. b. On numerous occasions during a six-year period, a representative of the institution's athletics interests provided cost-free lodging for several student-athletes and their relatives at a local motel. Further, some assistant coaches knew that the cost-free lodging was being provided. c. The head football coach was aware that a representative of the institution's athletics interests had provided a student-athlete the use of several vehicles, yet the student-athlete was permitted to compete while ineligible. d. The head coach attested in a statement filed with the chief executive officer of the institution that he had reported his knowledge of and involvement in any violations of NCAA legislation involving his institution when, in fact, he had not done so. The Committee on Infractions issued a public reprimand to the institution and placed the institution on probation for one year. The institution self-imposed several corrective and disciplinary measures, including the disassociation of the two representatives of the institution's athletics interests involved in the violations and a written reprimand of the head football coach. Additionally, the director of athletics developed and implemented a comprehensive educational program for boosters and additional programs for the initial and continuous monitoring of compliance activities. 4. Background information for each involved sport. See Exhibit NCAA 6. 5. Identities, titles and biographical background for all involved individuals named in an allegation. Garza was an assistant football coach at Tennessee from January 16, 2009, to January 21, 2010. Prior to his employment at the institution, he served as an assistant coach (defensive coordinator) at North Dakota State University. Garza left the institution in January 2010 to accept a position with the institution's former head football coach at his current institution, Southern California. Garza resigned his position at Southern California on or about September 1, 2011. G-5 SUMMARY DISPOSITION REPORT June 4, 2012 Case No. M364 ____________ H. Concluding Statements. 1. Statement submitted by the institution. The institution regrets that the violations in this case occurred. Throughout the review of these issues, the institution was particularly sensitive to the matter given its recent appearance before the Committee on Infractions in June 2011 to address the prior infractions that occurred in its men's basketball and football programs. It appreciates the enforcement staff's recognition of those concerns and its efforts to process the case as expeditiously as possible. Despite the fact that the violations identified in this summary disposition report occurred before the violations at issue in the prior infractions case, the institution is again subject to processing violations committed by a member of its former football coaching staff (to the detriment of its current football program). Had these violations been admitted to and addressed during the course of the prior matter, such violations could have processed in conjunction with that case. In so doing, the institution would have avoided the unwelcomed attention and stigma that is certain to follow the processing of two major infractions cases during the course of a single year. 7 Regardless of the unfortunate timing, the institution recognizes and accepts that it is responsible for the actions of its former assistant football coach while he was employed by the institution. Accordingly, the institution has taken corrective actions and has self-imposed penalties that it believes are meaningful to help prevent future violations and account for the unique circumstances and timing of these violations. More importantly, the institution sought to impose penalties that are consistent with the expectations of the Committee in a case of this nature. In so doing, the institution considered that no competitive advantage was gained by the prior, or current, football team as a result of the violations, and that the prior coaching staff is no longer at the institution. The actions taken by the institution are fully detailed in Section F-3, above. The institution is prepared to respond to any additional questions from the Committee, if necessary. 7 Although the prior case and the present case will be processed within a very short time of one another, the University does not believe that it is subject to the repeat violator legislation set forth in Bylaw 19.5.2.3. This assertion is based upon the facts and timing of the violations in the present case, and the NCAA definition of the "time period" for the application of repeat-violator legislation that is established in Bylaw 19.5.2.3.1. H-1 SUMMARY DISPOSITION REPORT June 4, 2012 Case No. M364 __________ 2. Statement submitted by Garza. To Whom It May Concern: This letter is to inform you that our offices represent Mr. Willie M. Garza arising out of the Summary Disposition Process for an investigation concerning impermissible payments to Lache Seastrunk. Furthermore, this letter is in support of Mr. Garza who acknowledges responsibility for his involvement with Mr. Seastrunk. Throughout his coaching career, Mr. Garza has been committed to working with student-athletes and impressing upon them the importance of values such as hard work, trust, loyalty, teamwork, discipline, winning, integrity and commitment to excellence. His goal is to make sure that these football players are prepared to win both on and off the field. He has been a role model for many AfricanAmerican athletes who were raised by their single mothers and lacked a positive African-American male figure in their lives. For Mr. Garza, education is the priority over athletics. He received a bachelor's degree in social work from the University of Texas at Austin in 1993 where he was a star athlete. He also has continued his education by taking classes towards his Masters of Social Work. He has been an Assistant Coach (specializing in the secondary) since 1997. His most recent stints were with the University of Tennessee, Knoxville and the University of Southern California. Mr. Garza recognizes his mistakes with Mr. Seastrunk but he is hopeful to continue coaching at the collegiate ranks. June 20, 2009 - Then prospective football student-athlete Lache Seastrunk (Seastrunk) (class of 2010) and Evelyn Seastrunk, Seastrunk's mother, traveled to Tennessee for an unofficial visit. Jackie Thurnes: That's good. Alright. I wanna talk to you a little bit about a recruit that you had recruited when you were at Tennessee, Lache Seastrunk. Willie Mack Garza: Mm-hmm. Jackie Thurnes: Can you tell me about that? I guess start from the beginning as to how you became aware of Lache and how the recruiting process progressed. Willie Mack Garza: Just through a recruiting service, media outlets. He was a national recruit. Willie Mack Garza: No. We have a list of the top players in the country everywhere I've been and we have a recruiting area that you're responsible for and I recruited the state of Texas and he was in my area. Jackie Thurnes: So were you his primary recruiter on your staff? Willie Mack Garza: Yes. Jackie Thurnes: Tell me a little bit about Lache and his - I always term it as circle of individuals that normally you guys as coaches would get in contact with in order to recruit the kid. I know that could be family, friends, other individuals. Who with Lache did you contact about recruiting him? Willie Mack Garza: First of all, we would have contacted, the best of my recollection we would have started out calling I'm assuming his mom and whatever number we had on him. Him or his mother. There was also a young man there that lived right in Waco - I mean in Temple, but I cannot recall his name though, but he was the first guy that I contacted after probably trying to contact the mom and Lache. And of course we were handwriting letters when it was outside of telephone contact period or whatever. Jackie Thurnes: You mentioned a young man in Temple that you contacted to be able to recruit Lache. Willie Mack Garza: Yeah. Jackie Thurnes: Describe him for me I guess if you can. Willie Mack Garza: He's a Black male. He works there in Temple and he knew me because I had played at the University of Texas, which is right down the road for Temple. So we knew each other prior to me knowing Lache Seastrunk basically, but we hadn't been communicating, but we knew each other. I don't know how to really - he's dark skin, Black male. I cannot recall his name though. Willie Mack Garza: The first time we met, I guess - I think we had met somewhere way back when I was at Texas because I remembered his name when we first talked on the phone and he talked to me like as if he knew me and maybe he just knew me from being at the University of Texas or whatever. But the first time I met him face-to-face during the period I was recruiting Lache Seastrunk was at Temple. I went there during the evaluation period and he was at the football game. Jackie Thurnes: How is he connected to Lache? Willie Mack Garza: I think - Temple's a relatively small country town and maybe they went to the same church, neighborhood friend. I'm not sure exactly. I don't think he was a relative of Lache Seastrunk, but he knew Lache Seastrunk. I think he may have been a part of a community outreach group or something and Lache maybe attended it or something. But I don't remember all of the details of exactly his connection with Lache, but I know he knew Lache and when you're in a small country town a lot of people know everybody. Jackie Thurnes: Sure. Willie Mack Garza: He grew up in Temple. Jackie Thurnes: I've heard of an individual who's named - the only way I know of him that's been explained to me is Peazo. Does that sound at all? Willie Mack Garza: I don't know a Peazo. Jackie Thurnes: What about Jeff Wood? Willie Mack Garza: Don't know a Jeff Wood. There's a gentleman in Houston named Willie Lyles that I communicated with at times about him, but the primary guy that I communicated with and worked with was - not worked with, but the young man that was right there in Temple because I kinda' knew him and he kinda' knew me and that was pretty much it. But most of the communication was with Lache and his mom. Jackie Thurnes: Okay. So this individual that you continue to reference, the young man in Temple. Willie Mack Garza: Yes, ma'am. Jackie Thurnes: Tell me about that. I guess what was the purpose of communicating with him and what did you communicate with him about? Willie Mack Garza: Most of the time in the recruiting process you try to get as much information about a young man's background, personal life, athletic life, all of that and he knew Lache Seastrunk. So he was a resource, a pool of information for us to make a good decision on whether or not Lache Seastrunk was a fit for Tennessee at that time. If he was a good guy. On film and everything he was a great player, but part of your job is to find out is also his off the field background and that was a part of that process. His uncle, he had an uncle that I knew that was a coach in Dallas that I have been knowing that played at TCU. I communicated with him as well. I think he's a cousin of the Seastrunk's; of the mother maybe. I sought him out because I knew him and he was at one of the scrimmages that I went to during the spring and I communicated with him as well. Not as much with him. Not as much with him, but I knew this guy and he was a good resource to give me information on Lache Seastrunk. Jackie Thurnes: The uncle you're referring to? Willie Mack Garza: I don't think he's a uncle, but he's a relative of Lache Seastrunk's. He was a great running back in the NFL. I'm drawing a blank on his name. I apologize. But he played for the Buffalo Bills. He played for the Buffalo Bills. He was a backup tail back for Thurmon Thomas for all those years. He was a great running back at Texas Christian University. He's been a coach at Bishop Dunn High School for a number of years, which is a private school there in Dallas. I didn't actually know it. I didn't know that he was a relative of Lache Seastrunk until I went to the spring game and he was there at the - not the spring game. He was at one of the scrimmages whenever we went on the road recruiting and I saw him then. Of course we saw each other 'cause I had coached at TCU at one time and he was an alumni. So I developed a relationship with him and we talked and he said, "What are you hear for?" I said, "I'm here recruiting Lache." He said, "Oh, I'm a relative." We went from there as far as him giving me input on Lache Seastrunk. Jackie Thurnes: Was that an evaluation period when you first met him? Willie Mack Garza: Yes, it would have been in the spring. Willie Mack Garza: How did I find out about Willie Lyles. Someone, somehow I found out that Willie Lyles had a relationship with Lache Seastrunk. Willie Lyles was from Houston and I don't know how I got his number. I can't recall. He may have called me first. I may have called him. I can't recall if he called me first or I called him, but I know we talked on the phone. It was a few years ago. But I didn't have a great relationship with Willie Lyles. I had a relationship better with the other guy that was right there in Temple. That's who I had my connection and relationship with. There was also a pastor that I think is Lache's uncle that was there in the community as well that supposedly helped him financially or whatever; a pastor at the church that they attended that helped a number of athletes at Temple; take trips or whatever. Jackie Thurnes: You remember that individual's name? Willie Mack Garza: I can't remember. I didn't communicate with him a great deal, but I know he was a pastor there at one of the churches there in Temple, but I cannot recall his name. Jackie Thurnes: Okay. Willie Mack Garza: He tried to call me a couple weeks ago and I talked to compliance to let them know that he had tried to call me, but I haven't talked to Willie Lyles in a long time. I think maybe I talked to him once or something at USC. Maybe once. Jackie Thurnes: In the last couple weeks when he's tried to contact you, have you talked to him? Willie Mack Garza: It was probably - let me see. It was probably maybe three weeks ago or more. Jackie Thurnes: Did the two of you connect? Willie Mack Garza: No. I didn't talk to -- Jackie Thurnes: Did he leave a voice message? Willie Mack Garza: I didn't get no voicemail or nothing'. I just saw that I had a missed call from him. It's been maybe two times over the last year - awhile back ago I think he tried to call me and we didn't communicate or talk. Then maybe two or three weeks ago he tried to call me and we didn't talk, but I saw I had a missed call. The number that I have on Willie Lyles is 832-647-7586. Jackie Thurnes: With Willie Lyles and Lache Seastrunk, how often did you communicate with Lyles? Willie Mack Garza: Oh, it was randomly. I don't remember how often. It was just randomly. Mostly when we made recruiting calls at Tennessee, usually we were getting Lache Seastrunk on the phone or his mom. Well with Willie Lyles, I guess can you approximate? Did you talk with him once a week, once a month, once every two, three months? Just try to get a ballpark --? Willie Mack Garza: Just a ballpark? Jackie Thurnes: Yeah. Willie Mack Garza: Maybe once a month or less. Once a month or less I would think. I know if I went to - I recruited Houston as well and occasionally Willie Lyles would tell me about players anywhere 'cause he had a recruiting service. So he would tell me about players around the country. It was a kid in North Carolina he mentioned to me one time that I'm just thinking of off the top of my head. He would tell me about guys in Houston. He would tell me about guys in California, but for the most part in the state of Texas I knew because I grew up in that area. So I knew the area pretty well, but he would tell me about guys. He gave me some DVDs before on players that he was trying to push. Jackie Thurnes: Who was he trying to push at that time? Willie Mack Garza: I can't remember. I can't remember. It was a random group of guys. It was just a random group of guys. It wasn't no particular guy in particular that he was really pushing to me. It's just a group of guys that probably didn't have very many people recruiting them that were down the line recruits that he was trying to get USC to recruit and get involved. So he was showing me a DVD or he gave me a DVD of a kid. Jackie Thurnes: When did you first come to know Will? Willie Mack Garza: Had to be sometime when I was at Tennessee. Jackie Thurnes: Was it in relation to your recruitment of Lache? Willie Mack Garza: Yeah. I didn't know who Willie Lyles was. McKay Willie Mack Garza: I have had no contact with Willie Lyles since I've been here at USC. I think when I first got here, when I first got here, Willie Lyles called me and he was wondering if we would purchase recruiting service from him and nothing ever came of it. So that was it. Jackie Thurnes: I thought just a moment ago you said that he had provided you some DVDs - Willie Mack Garza: When I was at Tennessee. I'm sorry. I'm sorry. Go ahead. Jackie Thurnes: I wanna make sure you answer my question correctly so let me finish. Just a moment ago you had said that he provided you DVDs of guys that he was trying to get to USC. Willie Mack Garza: Yeah, that's true. Jackie Thurnes: So when would that have been? I thought you said you haven't spoke to him since you got here to USC. Willie Mack Garza: I haven't talked to him in person. I haven't talked to him in person. Let me get my thoughts right right here 'cause I don't wanna give you no bad information. I'm not - but it was awhile back ago. What I'm trying to say is understand my process here 'cause I'm trying to get you to understand it better. I was in North Dakota State for four years. I went to New Mexico in one year and I was there two weeks. Then in a two week period I jumped to Tennessee. Right after a year I came to USC and all of this was in the middle of recruiting. So sometimes things run together for me 'cause in that one year I was at four different jobs. So it was tough. But when I was at Tennessee in the spring I recruited Houston. I recruited the whole state of Texas, along with a jillion other places. I know that I made contact with Willie Lyles when I was at Tennessee during the recruitment of Lache Seastrunk and the recruitment of several other guys in the state of Texas. He was always trying to give me DVDs and keep me informed on guys in Houston and around the country, but at that time it was probably just the Texas area, but I didn't need much help there because I was good there. Now, when I left and came to USC, it would have been in January some time, Willie Lyles contacted me and because we were still in www.verbalink.com Page 11 of 55 WGarza_083111_Tennessee(JAT) Page 12 of 55 Jackie Thurnes, Willie Mack Garza, Dave Roberts, Ellen Ferris, J.K. McKay the middle of recruiting. We were still in the middle of recruiting. So I had just left TCU - I mean Tennessee. I had just left Tennessee and the same guys that I was recruiting when I got to USC, I was basically continuing to recruit those guys. So the contact with Willie Lyles was the same. I think maybe I went to Houston. I think when I first got here he may have - we may have talked on the phone and he was trying to give me DVDs and inform me about players in Houston and in the California area. Yeah. Yeah. Then maybe we talked once or twice after that. I'm not sure. But I know since the - to be honest with you, since the Oregon thing broke I haven't had any contact with Willie Lyles. I know when I first got to USC he tried to - he wanted us to try to purchase his recruiting service, but we never did because all his information is down there in Texas. I know Texas like the back of my hand. Jackie Thurnes: Sure. You came to USC in January of 2010, right? Willie Mack Garza: Yeah, I'm pretty sure. Yeah, it was in January, yes. Jackie Thurnes: When you were at Tennessee for that one year, Will at that time would have been working for Elite Scouting Services. Do you know if Tennessee subscribed to Elite? Willie Mack Garza: I'm not sure. I'm not sure. They may have, may not. I don't know. I wasn't that involved in the different services that we purchased. The only recruiting service that I can know of is Randy Rogers 'cause I was a personal friend with Randy Rogers from Texas and if I'm not mistaken, we purchased Randy Rogers recruiting service, but other than Randy Rogers, I don't know. I know we had different recruiting services. I don't know if Willie Lyles was one of them or not. If it was it wasn't through me. I didn't have anything to do with it. Jackie Thurnes: Okay. Well I wanna switch back talking a little bit more about Lache. Do you remember - just give me a brief overview of the recruitment of Lache involving any visits that you remember making out to Temple, whether it was during evaluation period or contact period. Willie Mack Garza: I know in that first spring that I was - in the spring, which would have been April and May, I know I went to go see Lache Seastrunk. McKay period. I did an academic evaluation and I went to a spring game. So I went to Temple twice during the spring. Then after that, course you couldn't contact him and you couldn't be off campus during the football season until whenever the evaluation period starts. So I know during the contact period I know I went down there to home visit him at least twice I guess. It was several kids in the area that we were recruiting. So I just made a trip. It was a kid in Waco. Then he was in Temple and it was three or four kids in Dallas. So I'd go to Virginia and then I'd fly to Texas and go Dallas, Waco, Temple. That's what I was doing for that contact period time. I don't know the exact number of how many - it wasn't - I can't remember exactly how many. Jackie Thurnes: That's okay. Talk to me about any visits that Lache took to Tennessee. Willie Mack Garza: He came to our camp. He came to our camp at Tennessee. He never came on an official visit. He came to our camp. It would have been a summer camp that he attended. Jackie Thurnes: You were there during -- that was 2009, right? Willie Mack Garza: Yeah, it would have been that summer. The summer before the football season at Tennessee. Jackie Thurnes: So other than being there for that summer camp, was Lache to your knowledge ever on campus there at Tennessee? Willie Mack Garza: No, ma'am. Not to my knowledge. Jackie Thurnes: Well talk to me about the camp. How was it determined - what was your understanding as to how he decided he wanted to come out and how he got from Temple to Knoxville? Willie Mack Garza: I don't know. He caught a flight far as I know. He caught a flight and his mom and I think the guy in the community, the pastor at the church, I guess they purchased him a ticket to fly out to Tennessee. This pastor at the church. Jackie Thurnes: Earlier you said that you talked to him maybe one time. Willie Mack Garza: Yeah, maybe one time, yeah, but the other guy, my contact over there would always tell me, the guy at Temple and I can't think of his name. I knew that this guy at this church was helping athletes. I don't think it was just all athletes. I think it was just people in general. He helped kids take trips to various schools around the country. Jackie Thurnes: Do you know names of any other recruits that he helped out? Willie Mack Garza: I think he had a son that went to somewhere, but I can't remember their names. There was the full back that was there at Temple who was - the guy at Dallas, but I cannot remember his name, the coach, he had a nephew that was on the football team and I think he helped him take trips, but I think prior to Lache Seastrunk, this pastor in the community had helped guys take trips around the country through the church I guess. Jackie Thurnes: Alright. Well what do you know about - so I guess do you remember, do you have a specific recollection of Lache and Evelyn flying into Knoxville? You said that you thought that they had took a flight. Willie Mack Garza: Yeah. They flew into Knoxville. Jackie Thurnes: Do you know what their arrangements were then once they got to Knoxville in regards to transportation, lodging? Willie Mack Garza: Far as I know they - I picked them up at the airport. I do know that. I picked them up at the airport. Jackie Thurnes: Where did you take them? Willie Mack Garza: I took them I think up to the office first and then I dropped them off at the - they stayed at the hotel there in Knoxville. I think it was the Radisson maybe. Jackie Thurnes: Anywhere else that you took them besides the office and the hotel? Willie Mack Garza: No. Jackie Thurnes: When you took them to the office, what was the purpose of that? What did they do there? Willie Mack Garza: It was for the camp. Jackie Thurnes: At the office? Willie Mack Garza: Well our offices are right there at the same facility where we're having the camp. Jackie Thurnes: What were they doing in the office though? Willie Mack Garza: Talking to the coaches. Jackie Thurnes: Which coaches were they talking to? Willie Mack Garza: All the coaches that were on hand there. I don't know which coaches in particular they spoke with, but it would have been all the coaches that were still there because when they got there, we were just about to break to camp. So a lot of guys were leaving so I don't know which coaches in particular they spoke with, but. Jackie Thurnes: About how long were they in the office? Willie Mack Garza: I don't know how long they were in the office. Jackie Thurnes: Five minutes, 30 minutes, an hour, more than that? Willie Mack Garza: Hour maybe. Jackie Thurnes: Were you involved in those conversations that they had with the other coaches? Willie Mack Garza: No. If they had a - no, I wouldn't have been involved in the conversation they had with other coaches. Willie Mack Garza: Yeah, 'cause they came on the last day of camp. Jackie Thurnes: So was he a participant in the camp? Willie Mack Garza: He was originally signed up to participate in the camp, but he got there and it was pretty much over. Jackie Thurnes: Was there a camp that followed that one immediately that he was involved in? Willie Mack Garza: No. Jackie Thurnes: So then once you all got done at the office, you then drove them to their hotel, is that right? Willie Mack Garza: Yes. Jackie Thurnes: Then what happened next? Willie Mack Garza: They were at the hotel far as I know. Jackie Thurnes: Was that at the end of the day? I'm just trying to figure out if you had any other interaction with them that day. Willie Mack Garza: No. Jackie Thurnes: So what else happened during their visit the next day? Willie Mack Garza: I think they - I'm trying to remember how long they were actually there 'cause they may have left the next day. I can't - but I know they came up to the office. We had other meetings with them, like an unofficial visit and we gave him information about Tennessee academics and talked to his mom about academics and everything. Jackie Thurnes: Did you participate in any meals with them? Willie Mack Garza: NO. Jackie Thurnes: How did they get around? You said the following day they had more meetings. Did those take place in the office? Jackie Thurnes: Were other recruits in town for unofficial visits during that same time? Willie Mack Garza: Not that I'm aware - I'm not sure though. I didn't have no other recruits there. Jackie Thurnes: Do you know if any other coaches gave rides to the Seastrunk's while they were in town that time? She was supposed to rent a car and when she got to the hotel - I mean when she got to the airport she didn't have no - either she didn't have her ID or she didn't have something, but she didn't have a ride. Jackie Thurnes: But this was an unofficial visit, right? Willie Mack Garza: Well he was coming to camp, but they were late. They were coming to camp for our camp, but then they got there late. Jackie Thurnes: You said they got there on the last day when camp was almost over. Willie Mack Garza: Yeah. But originally he was supposed to be there for our camp. Jackie Thurnes: But he didn't participate in the camp, right? Willie Mack Garza: No. Jackie Thurnes: You've been an NCAA coach for how many years? Willie Mack Garza: Thirteen - 12, 13 years. Jackie Thurnes: So you're aware for unofficial visits you shouldn't be providing transportation. Willie Mack Garza: From the airport? Jackie Thurnes: Yeah. Willie Mack Garza: I can't give nobody a ride from the airport? Then I probably messed it up there, yeah. Willie Mack Garza: We may have took him on a campus tour. I think we - he went to Neyland Stadium. We showed him Neyland Stadium. He may have went out with a player of ours or something, may have picked him up at the hotel and took him out. Willie Mack Garza: That he had a relationship with one of the players? Some of our players on the team, yeah. He talked to some of our players through Facebook and through the internet. He knew guys on our team. Jackie Thurnes: But with this particular situation where Lache told you that a player on the team drove him somewhere to go hangout, did you do anything to find out whether or not that was permissible under NCAA rules? Willie Mack Garza: No, ma'am. Jackie Thurnes: Did you notify the compliance office? Willie Mack Garza: No, ma'am. Jackie Thurnes: Did you notify your head coach? Willie Mack Garza: No, ma'am. Jackie Thurnes: Is there any particular reason you didn't do any of those things? Willie Mack Garza: I think I - I guess I probably assumed that he had a prior relationship or had communication and contact with this player and they had a friendship or whatever and if he was in town and he was friends with another guy on the team or whatever they could hang out. Jackie Thurnes: Is there anything else that you're aware of that went on during the visit? Willie Mack Garza: I know that we - I just know we met with him and stuff. Just trying to think back to that weekend. No, that's it that I can recall. Did anyone ask how? Did any coaches ask them or you how they got from the airport or back to the airport? Willie Mack Garza: Hm-mm. I don't think so. I don't remember. I don't remember anybody asking me that. Jackie Thurnes: Did you tell anyone that you had given them a ride? Willie Mack Garza: That's not common conversation, no. I don't think - no, I don't recall telling anybody. Jackie Thurnes: Did Coach Kiffin, since you were Lache's primary recruiter, did he make you responsible for Lache during that visit? Willie Mack Garza: Yeah, he was my recruit, yeah. Jackie Thurnes: What did Coach Kiffin say or how did he articulate that to you that you were responsible for Lache since he was your recruit? Willie Mack Garza: It's understood that if you have a recruit in town that he's your responsibility. It's no articulation or communication. If you got a young man coming into town that he's your responsibility. That's just understood. Jackie Thurnes: I wanna get back to - I guess when you went to pick up Evelyn and Lache at the airport, you said that Evelyn had called you. Willie Mack Garza: Yes. Jackie Thurnes: Did she call you when they arrived in Knoxville or did she call you prior to that? Willie Mack Garza: I may - I may have - I'm sure I talked to her prior to that, but I know when they arrived she - I'm pretty sure she called me when they had arrived 'cause she was gonna rent a car originally. Jackie Thurnes: So I guess was it a situation where they arrived, she called you and said they're there and then you left from wherever you were to go pick them up? Willie Mack Garza: Yes, I would have been at the school. So we were in camp all that morning I think. So I would have left from the school to the airport. Jackie Thurnes: I wanna get back to the actual flights that they took. Do you remember where they flew out of? Willie Mack Garza: Mm, I can't - I can't recall. I'm assuming that they probably would have flew out of Temple or Waco, but I don't remember exactly where they flew from. Jackie Thurnes: I wanna get back to the payment,. Initially you said you were assuming that the pastor had helped them out with that ticket. You're saying mm-hmm. For my recorder could you say yes or no though. Willie Mack Garza: Oh. Yes. Jackie Thurnes: Is that what you said? Okay. Then my understanding related to the Seastrunk's is that they were not in the best situation financially I guess you could say. Is that correct? Willie Mack Garza: Talking to Miss Seastrunk that she was pretty well off from my understanding. Jackie Thurnes: So then why would you assume that the pastor helped them if Miss Seastrunk had said that to you? Willie Mack Garza: Well I just know that the guy that I was talking to on the phone made it sound like that this pastor helped student-athletes there in the community with trips and stuff and just talking to Miss Seastrunk on the phone before I'd actually met her and before I went on a contact to their house on a home visit. The conversation on the phone with her before I actually saw the situation was they were pretty well off. If you talked to her that's what it seemed like. Jackie Thurnes: But outside of talking to her though, what was your understanding of their financial status? Did anyone else that you talk to indicate otherwise? Willie Mack Garza: They had said that she had a rough background. Jackie Thurnes: Why didn't that payment that you've described to us come out of the football budget? Willie Mack Garza: 'Cause they didn't have anything to do with it. Tennessee didn't have anything to do with it. I was doing this on my own. Jackie Thurnes: Is that something that you generally do? Willie Mack Garza: No, it's not. Jackie Thurnes: Have you ever done that before where you've - Willie Mack Garza: No. Jackie Thurnes: -- paid a guy whose got a recruiting service for DVDs? In general, if say University A purchases a recruiting service and they get DVDs, literature of information that they're trying to gather to make a good evaluation, well just because they may not get information from that, they may not get a recruit out of that information they cannot just say "Well we're not gonna pay that recruiting service." So that was the same thing, even though it wasn't through Tennessee or nothing like that. He was still providing me with information and DVDS. Jackie Thurnes: Did you enter into a contract with Will? I was still at Tennessee at that time. I think it was a kid in California that he gave me information on. Jackie Thurnes: When Will gave this to me he also showed to me, which I do not have with me, the itinerary for the Seastrunk's and the amount of the tickets came out to be somewhere around $1,477.00, which to me is very coincidental that you reimbursed him $1,500.00. he says that he paid $1,477.00 for their tickets and that you reimbursed him for that. Willie Mack Garza: All I can say is I reimbursed Willie Lyles for DVDs and information that he gave me through a recruiting service. Jackie Thurnes: Which is a recruiting service that did not get approval by the Tennessee Athletics Department. Is that right? Willie Mack Garza: Right, because - right, exactly. Tennessee never - no, Tennessee didn't have anything to do with this. This was me personally. Jackie Thurnes: You mentioned earlier that you've never done this before. Jackie Thurnes: So since this Oregon thing broke and I'm assuming that you're referring to in the media where it's been talked about Oregon's relationship with Will. Is that right? Willie Mack Garza: Yeah, just whatever happened. Jackie Thurnes: So since that broke have you told anyone that you used Will in this manner? Willie Mack Garza: No. No. No. Jackie Thurnes: So did you intentionally not tell anyone at Tennessee that you had used Will? Were you trying to keep it a secret? Willie Mack Garza: Yeah, I just didn't think - yeah, no, I was just - you have contact and interaction with guys around the country and some things you just keep to yourself in the recruiting process. Willie Mack Garza: Yes, him and Miss Seastrunk wanted me to reimburse him, pay for the flights and I told him I couldn't do that. Jackie Thurnes: So how did things change then that made you ultimately reimburse Will for the flights? Willie Mack Garza: I think I talked to him after the fact a couple of times and he was - I think he had been let go from whatever company he was with, whatever that - he was with one company. I can't think of the name of it. I think he had stopped and he was trying to start his own recruiting service at that time. He had purchased the tickets and he was also giving me information and DVDs. So I told him, "Yeah, I'll reimburse you." Jackie Thurnes: Describe for me how you went about doing this money transfer. How did you get it done? Willie Mack Garza: Mm, I think I went to I guess my - Bank of America and got the cash out. Whatever I was - (sigh) I mean, as I said I don't know. I don't know where I was. Jackie Thurnes: I'm trying to figure out - did you have a personal account at Bank of America? Willie Mack Garza: Yeah, I bank with Bank of America. Jackie Thurnes: So you're saying that you took about $1,500.00 out. Willie Mack Garza: Right. Jackie Thurnes: Then what I'm trying to figure out is with this wire transfer, how exactly you went about getting the money to Will. What was your means of getting it out to him? McKay Jackie Thurnes: Do you remember where you executed the money gram? Willie Mack Garza: It don't say it on there nowhere, huh? Jackie Thurnes: Well it shows on his end that he picked - it appears to me that he picked it up at Walmart and I'm aware that they have a money center service there. Do you recall going to a Walmart to get the funds transferred? Willie Mack Garza: I don't remember where I was to be honest with you. I think it was - I don't know if I was in Knoxville. I remember talking to Willie Lyles about - before I reimbursed him he was calling me, calling me, calling me wanting me to reimburse him and I didn't and then finally I just said alright, but I don't remember where I was. I don't remember when it was that I reimbursed Willie Lyles. I don't remember the time period. Well it says July, right, that I sent it? Jackie Thurnes: It looks like he received the money according to the money gram, he received it July 5, 2009. Willie Mack Garza: So I think I went on vacation then really I think so it's no telling where I was at. I'm not sure where I sent it from. Jackie Thurnes: But you're thinking that was the time period when you were on vacation? Willie Mack Garza: I'm pretty - July. We would have been on vacation in July. Jackie Thurnes: After this visit occurred did you keep in contact with Will? Willie Mack Garza: Yes. Yes, after the visit occurred, yes. I was in communication with Will after that. June would have been camps. July - June we usually have camps so we go on vacation in July. July, August we would have been in football season. I'm pretty sure throughout that process, I'm sure I was in contact with him, but I wasn't in contact with him on a regular, regular basis. The time I saw Willie Lyles in person was when I went to recruiting in the spring, in spring recruiting before that summer, before the camp in June and that's when he provided me with DVDs at the hotel when I was recruiting in Houston. He gave me information and contact information on a number of recruits. McKay Lyles and he was giving me information on players. Then when I was in Houston recruiting in May, he met me at the hotel and he had his laptop, we watched some recruits on his laptop, he gave me DVDs and contact information and telephone numbers on some recruits. I think it was a couple of kids in California. Then that would have been in May in the spring again. June, think that's when they came to camp in June. That's when we had our camps at Tennessee and then it says in July I reimbursed him, but - then in July when we went the whole football season I guess, but I really wasn't in contact with him very much in June and July 'cause I was talking to Lache and the mother and the grandmother. Then the end of the season, December, January, that's when we started home visiting him, Lache and his mom and his grandmother. But during that whole time period it was a point in there, as I reflect back, there was a point in there where Willie Lyles and the mom went crossways. I don't know what it was about, but Willie Lyles was no longer involved with Lache Seastrunk. I don't remember what, what particular time, but I remember Willie Lyles saying that he - I don't know. It was something. The mom was kinda' funny about different things, but when we went on home visits, when I went on home visits and I went to go see the mom and Lache, Willie Lyles was never involved in none of that stuff there 'cause I think that they had went their separate ways. I don't know what happened with them. Then that's December, January. December, January I think that's when - January I left Tennessee. It was right in the middle of recruiting I think and then I transitioned to USC. I continued to recruit, but the communication with Willie Lyles, I think he may have called me once I got to USC about his recruiting service, but we never purchased it. I never even told anybody about a recruiting service about Willie Lyles. I may have mentioned it to somebody that he was - I may have mentioned it that he was wanting to purchase a recruiting service. I may have asked. Jackie Thurnes: Who? Willie Mack Garza: I told somebody. I don't even know his name. He's not here at USC no more. McKay Lyles before at USC. He was only with us for a short period of time. Jackie Thurnes: What kind of position was he in? Willie Mack Garza: He was here so - everything was erased. I think he helped coordinate recruiting I think. I don't know. He was here a holdover from the previous staff. I cannot think of his name. He wasn't a recruiting coordinator. He was somebody that maybe helped with recruiting. He wasn't a full time coach or nothing, but I knew he was the only one left from the previous staff. So I kinda' asked him did he know anything about Willie Lyles and about the recruiting service and stuff like that. So, I think that would have been the only thing. But Willie Lyles wasn't really providing - he wasn't - the information other than - I wasn't gaining nothing from the information really, even though he was still giving me - he was telling me about players and he had provided me with DVDs. The players that he was giving me information on really wasn't guys that we were gonna go after. I think I talked to him that one time and he maybe called me two more times later on and I really never talked to Willie Lyles again and he's called me a couple of times. Jackie Thurnes: So in the past month have you talked with him? Willie Mack Garza: No, I haven't talked to him. He's called me - he called me maybe two, three weeks ago or something. I saw a missed call and then I think when the Oregon, that story about the Oregon thing broke, I think he called me then, but I never talked to him. I just had a missed call. Jackie Thurnes: Do you remember, Coach, between and during the football season, that last football season you had at Tennessee, was there any phone calls you had with Will Lyles August through December, that time period? Willie Mack Garza: I don't recall, but I could have. I very well could have talked with Willie Lyles during that time period. Willie Mack Garza: I cannot remember his name. Jackie Thurnes: You had mentioned just a few moments ago about meeting Will at a hotel in Houston. Willie Mack Garza: He met me. He came to the hotel. Jackie Thurnes: How many times have you done that? Willie Mack Garza: Once. Jackie Thurnes: When was that? Willie Mack Garza: Twice. I'm sorry. I take that back. Twice. Jackie Thurnes: Can you remember when those - Willie Mack Garza: Twice. Jackie Thurnes: -- when those events occurred --? Willie Mack Garza: One was in the spring. I think the spring when I was at Tennessee in the spring; spring recruiting. When I mentioned earlier I was in Houston recruiting and that was really the first time I'd ever met Willie Lyles. I had talked to him a couple of times on the phone, but that was the first time ever meeting him. I asked around. People told me about it and other coaches knew him. He met me at the hotel. It had to be April or May. April or May before the football season. Jackie Thurnes: Yeah, 2009. Willie Mack Garza: 2009 I guess; April, May of 2009 when I was recruiting in Houston and recruiting Texas. He stopped by the hotel. He showed me DVDs. Like I said, he had a laptop and he showed me some players that he thought that I may be interested in. He gave me a group of DVDs that I may be interested in, players, he gave me contact information and I just remember it was a kid out here in California. Why I don't know, but he knew the kid and he thought I should recruit him and stuff. McKay me about a barber shop in Houston to get my hair cut, but he gave me directions on how to get that, but other than that, no other time. Then I was in Houston another time. I think I was already here at USC. I think I was at USC. Just trying to remember if I was down there recruiting. It may have been a speaking engagement. I can't - I do not - I can't recall exactly if I was down there recruiting in Houston or I was down there 'cause I spoke at a Nike clinic in Houston one time and I know that I never met him face-to-face during that visit, but he stopped by the hotel when I wasn't there and left me some DVDs and information on recruits that he would recommend to me. Jackie Thurnes: Did he leave it with the front desk? Willie Mack Garza: He left it at the front desk in an envelope. Jackie Thurnes: What hotel was that? I know that he's referred to a Marriott that's out there close to the airport. Do you happen to know if that's the one that you stayed at? Willie Mack Garza: No, I don't. I don't remember what hotel it was. I know the first time I met him I was in downtown Houston and I can't remember the hotel. It was a big hotel downtown Houston. Jackie Thurnes: I guess who's idea was it the first time in spring of '09 when you were at Tennessee and you were in Houston, whose idea was it for Will to come to the hotel to meet you? Willie Mack Garza: He wanted to. He wanted to come over to the hotel to show me some players and give me DVDs, awesome players that he thought could play for us. Jackie Thurnes: Was that the time when he gave you information on the kid from California? Willie Mack Garza: If I'm not mistaken that was the time, yeah. Jackie Thurnes: Do you remember that recruit's name? Willie Mack Garza: It ended up - he told me about the kid. I think we watched him - we watched him on DVD, he gave me a DVD, but the kid wasn't - he wasn't really what we were looking for. It was a defensive back. He really wasn't the caliber kid that we were looking for. Willie Mack Garza: Oh, I'm sure that we communicated that I was coming to town to recruit. I'm sure we talked on the phone that I was coming to town recruiting because I'm sure through prior conversation he had mentioned a couple of kids that were in the Houston area that I should take a look at, that he recommended. Either I called him or he called me and knew it was spring recruiting and it was communicated. I told him when I was gonna be in Houston and where I was at. He stopped by the hotel. Jackie Thurnes: What about the next time? You said you're thinking it's the following year when you were here at USC when you saw him again or you didn't see him, but he left some information at your hotel for you. Willie Mack Garza: Right. Jackie Thurnes: Again, I guess who's thought was it for him to leave that information for you? Did you ask for the information? Willie Mack Garza: No, he's just like most recruiting services, they're always pushing their information. I'm sure through our conversation - he probably called me and said he had a couple of kids that he thought could play for us and that he was recommending. I think I was in Houston and out of there pretty quick. I think he said he'd just drop it by the hotel. Then I got up early that morning and the information was there and I took it with me, but I never - I talked to him on the phone while I was in Houston, but I never saw him directly. That next morning when I got up I had a flight out of there early morning I think and he gave me the information. Jackie Thurnes: Did you pay him for that information? Willie Mack Garza: No. Jackie Thurnes: So did anyone here at USC know that you were in communication with him and that he had provided you that information? Once in the spring of '09 when you sat together and watched some film with him and he gave you information. Willie Mack Garza: Mm-hmm. Jackie Thurnes: And the second time the following year where he left information for you at the hotel, but you didn't actually see him. Willie Mack Garza: Right. Jackie Thurnes: Were there any other times when you saw Will in Houston? Willie Mack Garza: No. Jackie Thurnes: Have you ever ridden around in Will's car? Willie Mack Garza: No, ma'am. Jackie Thurnes: Have you ever seen him at a high school in Houston? Willie Mack Garza: No, ma'am. Jackie Thurnes: Did you ever ask Will to help you with recruiting? Willie Mack Garza: No, ma'am. I never asked him, no. His name, like I said, from the very beginning, his name was brought up through I think the other guy at Temple. His name was brought up. I really didn't know who Willie Lyles was. I was talking to the other guy. I can't think of his name in Temple and it was mentioned that Willie Lyles was a mentor, a guy that was looking after Lache. That's when I first got in touch with Willie Lyles. At that particular point in time, I think at that time he may have been working for a recruiting service at that time and he was telling me about other players as well. I already knew about Lache. I was just trying to find out who Willie Lyles was 'cause everybody said he was a mentor. McKay Then that spring, that's when I met him and he came to the hotel in Houston and he gave me more information; DVDs and stuff. But outside of that I never - because like I said, I grew up outside of Houston and I know Texas. I recruited Texas for a number of years so I really didn't need so much a recruiting service to help me, but at the same time he was always calling, giving information on various players and stuff and I guess he was trying to help guys that weren't like Lache Seastrunk that needed help in the recruiting process to get their information out. Jackie Thurnes: Do you recall now after reflecting on it a little bit, do you recall how you got Will Lyles number? Willie Mack Garza: I do not remember how I got Willie Lyles' number. Sometime while I was at Tennessee somebody - you get numbers on so many people. I don't know how I got Willie Lyles' number. I don' remember who gave me Willie Lyles' number. Jackie Thurnes: Did Coach Kiffin give you his number? Willie Mack Garza: No. Coach Kiffin, I'm not speaking for him, but I don't think Coach Kiffin knows who Willie Lyles is. He may know who he is now through all of what's going on, but definitely Coach Kiffin didn't give me Willie Lyles' number. Jackie Thurnes: Do you know Charles Fishbein? Willie Mack Garza: Fishbein. Fish, Fish, Fish, Fish. I may have heard a guy named Fish before, but I've never met him. I don't know - I've never dealt with - I think I've known -- is he down - I don't know. I'm not sure. I don't know him personally, but I think I've heard of Fish - somebody being called Fish, but I'm not sure. Jackie Thurnes: I'll tell you what my understanding is is that that time period in 2009, that spring to summer, Will was working with Elite Scouting Services and Charles Fishbein is an individual that also works for Elite Scouting Services. I think he's one of the higher - I don't know if it's his company or what it is. Does that help at all? Willie Mack Garza: I don't know. I don't know a - I don't know a Fishbein. A Fishbein? I don't know if Tennessee - I don't know if we had purchased that before or not. I don't know that. The only recruiting service that I'm aware of that we purchased at Tennessee was Randy Rogers. I knew Randy Rogers from Texas and I think maybe Tennessee had used Randy Rogers before, that recruiting service and we repurchased it while we were at Tennessee. That's my knowledge. I had talked to Randy Rogers before. I know we had a number of other recruiting services that we purchased, but that was really the only one that I was directly involved with. To say that 'cause I knew Randy Rogers. I knew he went and looked at the schools and the players and I was at Texas when he was there, but other recruiting services, I've never really used them and I've never really interacted with people like - I say people, but like Willie Lyles recruiting services. I've just never dealt with - I always dealt with the coaches, but this name was brought up with Lache Seastrunk. I don't even know if the guy at Temple brought up Lache - I can't even remember. I can't remember who gave me the number, but I know it wasn't Lane. Lane doesn't know who Willie Lyles is. He doesn't know who Willie Lyles is. He may have heard his name mentioned or something, but he don't. Jackie Thurnes: Did you and Coach Kiffin ever talk about Charles Fishbein? Willie Mack Garza: I don't know. Coach Kiffin, no, I've never talked to Coach Kiff about Fishbein, Charles Fishbein, no. Jackie Thurnes: Or talked with Coach Kiffin about Elite Scouting Services? Willie Mack Garza: I've never did anything with Elite Scouting Service. You said that came out of your personal account at Bank of America. Willie Mack Garza: Yes, ma'am. Yeah, I'm pretty sure; yeah. Jackie Thurnes: Did anyone provide you that money to give to Will? Willie Mack Garza: No. Jackie Thurnes: Is there anything else about that visit that we should know about that you didn't talk about initially about anything that occurred during the visit or other rides you may have given the Seastrunk's or meals? Willie Mack Garza: Well, we went to TGI Fridays, but they paid for their meals and stuff. So they paid for their meals. Jackie Thurnes: Who went to TGI Fridays/ Willie Mack Garza: Myself, Lache and Evelyn. I think before they were getting ready to catch their flight back to Texas. Jackie Thurnes: At that time, Coach, did you think that maybe what you were doing was impermissible? Willie Mack Garza: Yes. I thought about it, yeah. Jackie Thurnes: Did you talk to anyone about it? Willie Mack Garza: No, ma'am. Jackie Thurnes: What about their hotel expenses? Did you help them with their hotel expenses? Willie Mack Garza: Yes. Jackie Thurnes: You did? How did you pay for that? Willie Mack Garza: I can't remember. She was gonna - she had a credit card. She went up to the desk to pay for it with a credit card and she didn't have the money so I just paid - I think I paid for it in cash and told her she'd have to reimburse me for it. Jackie Thurnes: Did she? Willie Mack Garza: No, ma'am. Jackie Thurnes: Did you pay that in cash upon when they were checking out or at a different time or when they were checking in Willie Mack Garza: It was when they were checking out. It was when they were checking out and she didn't have a credit card to pay for it. I think she put her credit card up there and then when she was checking out she couldn't pay for it so I just paid for it. Told her she had to reimburse me. Jackie Thurnes: Did you make the reservations for them? Willie Mack Garza: Yes. Oh. Yeah, I think I did, yeah. At the hotel I think I did, yeah. Yeah, I think I did or maybe I - I gave them the name of the hotel, but I think I did, yeah. Jackie Thurnes: You think you did make the reservations for them. Willie Mack Garza: Yeah. Or I may not even made reservations. I don't even think I made reservations. I don't think I - I think we just - from the hotel I think we just drove over there. Dave Roberts: From the airport. Willie Mack Garza: From the airport I mean. Jackie Thurnes: So make sure I've got this right. Then so you picked Evelyn and Lache up at the Knoxville Airport. Willie Mack Garza: Yeah. I think that was the first time when they was at the football offices and then later on I think we went to the hotel. I took them to the hotel. Jackie Thurnes: But are you saying that there were no reservations made for them? Willie Mack Garza: I don't think there was no - I don't think there was no reservations made for them. Jackie Thurnes: So it just happened to be that they had vacancy -- Willie Mack Garza: Yeah, I think I gave - Jackie Thurnes: -- they had a vacancy that - Willie Mack Garza: Yeah, they just had a vacancy. I think I gave them information on a number of hotels and our hotel that we stayed at and then when they got there she called me. I was waiting for them at the football facility and she called me and she wasn't able to rent a car so I went up there and picked them up. Jackie Thurnes: That first day when you then picked them up at the airport and took them to the football offices, earlier you had mentioned that you believe that they met with just about every one of the football coaches. Is that accurate? Willie Mack Garza: I'm not going to say every one of the football coaches 'cause it was at the end of camp. It was at the end of camp and a lot of the coaches, the last day right when that camp was over we basically could start our vacation and it's the end of June; somewhere around the last week of June I think. So I don't know exactly how many coaches or which coaches met with Lache, but I'm sure Lane was probably there. He's a big time recruit. Lane was there. Probably Coach Orgeron. We did a presentation for him through I think marketing or whatever. So a lady from marketing I think may have been there. Jackie Thurnes: What's that called? What'd you just say? Marketed? Willie Mack Garza: Marketing. He was coming from camp, but then it kinda' turned into an unofficial visit. So we had a presentation for him. We showed him what Tennessee was all about and what our plans were for him academically and athletically. I think someone from marketing put that together; just a slideshow and stuff. Jackie Thurnes: At Tennessee when recruits come in for an unofficial visit, were you supposed to as coaches fill out any kind of compliance form? Willie Mack Garza: I'm sure we did fill out compliance forms at Tennessee. I'm pretty sure we did, but like I said, this was kinda' unique 'cause he was coming for our camp. He was scheduled to come for camp, but I think this is what happened. They were supposed to get up early that morning and catch a flight 'cause she called me and told me and they missed the first flight if I'm not mistaken. They missed the first flight to Knoxville, Tennessee. I can't remember if they flew out of Waco, Temple or Killeen. It was one of those areas that they flew out of. I think they missed the - the first flight I think they missed so they caught the later flight. So she got there late and they ended up missing the camp. So it ended up turning into an official visit. Unofficial visit I mean. Background Information -- Disposition Report, Section G-4 The University's football television obligations are related to its membership in the Southeastern Conference (SEC). The member institutions of the SEC have collectively assigned their television fights to the Conference, and the Conference has negotiated long--term broadcast agreements with CBS and ESPN for the exclusive televising of football and men's basketball games involving Conference schools. These contractual agreements are maintained and managed by the SEC office. Under the current agreements, ESPN, Inc., which includes ESPN, ESPN2, ESPNU, ESPN Classic, ESPN Regional Television and ESPN3 (formerly ESPN360), has the right to all Conference--controlled games, except those belonging to CBS. The number of times that each Conference school appears on each of specific networks varies from year to year. In addition to the games broadcast nationally by ESPN and CBS, the SEC Network (coordinated by ESPN Regional), a syndicated group of over--the-air stations, will broadcast SEC games solely within the SEC's geographic footprint. ESPN also distributes a limited number of football games to FOX Sports Network and Comcast.
