Box 2256 Wichita, Kansas 67201 Dear Charles: During a discussion I was having with President MacBride the other day he mentioned that you had decided to contribute a substantial amount of money to the Liber- tarian Party but that your lawyers. after reading the FECA of 1971, were unsure about the legality of such a contri- bution. First. let me tell you how extremely pleased I am that you have decided in favor of making the contribution-- not only because we urgently need the funds but also because this indicates a degree of confidence on your part that Bob Meier and I are capable of directing the party in a principled and effective manner. we have tentatively retained John Bolton of Obvington and Hurling as the LPs attorney. John is considered to be one of the foremost experts on the federal election laws and he is quite convinced that there is absolutely no legal reason for you not to make your contribution to us. I expect to be in Washington on October 6 and will finalize our agree- ment with Covington Burling that week. As a first order of business I will have John get in touch with your legal people to discuss with them their concerns. Hopefully, he will be able to convince them of the legality of the contribution. If not. we will (without bringing your name into the discussion)'reguest an advisory opinion from the Federal Election Commission. We would prefer arles Koch Page 2 not to do the latter because we believe the law is ex- plicit and in our favor on the subject and (2) asking for an.advisory opinion from the EEC is a little like telling a child not to put beans in his ear.
