We located 59 pages of records responsive to your request. Per a phone call between the Commission and American Oversight, attachments are not included in the production. 3 Some material on the pages produced has been redacted for the reasons discussed below. 2 On May 21, 2018, FCC called American Oversight to clarify the scope of the request. On May 30, 2018 FCC asked whether American Oversight would agree to limit the scope of the search to FCC Chairman Pai’s office and the FCC International Bureau, thereby excluding lower ranking FCC employees who may have assisted in logistical preparation for Chairman Pai’s trip to Barcelona. American Oversight agreed to this narrowing request. On July 18, 2018, an FCC representative called American Oversight to ask if the emails of an FCC employee whose last name matched specified search term could be excluded. American Oversight agreed to such an exclusion. Additionally, records responsive to your request were withheld or redacted under FOIA Exemption 5. 4 Exemption 5 protects certain inter-agency and intra-agency records that are normally considered privileged in the civil discovery context. Exemption 5 encompasses a deliberative process privilege intended to “prevent injury to the quality of agency decisions.” 5 To fall within the scope of this privilege the agency records must be both predecisional and deliberative. 6 Predecisional records must have been “prepared in order to assist an agency decision maker in arriving at his decision.” 7 Deliberative records must be such that their disclosure “would expose an agency’s decisionmaking process in such a way as to discourage candid discussion within the agency and thereby undermine the agency’s ability to perform its functions.” 8 In the present case, we redacted emails containing an internal staff discussion of the circulation of Commission items. We have determined that it is reasonably foreseeable that disclosure of these wholly internal deliberations would harm the Commission’s deliberative processes, which Exemption 5 is intended to protect. Release of this information would chill deliberations within the Commission and impede the candid exchange of ideas. We are required by both the FOIA and the Commission’s own rules to charge requesters certain fees associated with the costs of searching for, reviewing, and duplicating the sought after information. 9 To calculate the appropriate fee, requesters are classified as: (1) commercial use requesters; (2) educational requesters, non-commercial scientific organizations, or representatives of the news media; or (3) all other requesters. 10 Pursuant to section 0.466(a)(5)-(7) of the Commission’s rules, you have been classified as a category (2), “educational requesters, non-commercial scientific organizations, or representative of the news media.” 11 Because you are a representative of the news media,” the Commission assesses charges to recover the cost of reproducing the records requested, excluding the cost of reproducing the first 100 pages. As Chairman Blackburn observed , "we are all tired of hearing stories about parents driving their children to the local McDonald 's for Internet access in order to finish homework assignments. We owe them better, period. " But the hearing also made clear that Congress continues to have significant concerns around how to design such a program to ensure that any dollars designated for broadband are spent wisely. Chairman Walden was correct in noting that "too often our data is insuffic ient and investments are not targeted where they can do the most good. Until we know where broadband is and where it is not, we will continue to make the same mistakes that have slowed rural buildout for years." This was certa inly the case with NTIA 's Broadband Technology Opportunit ies Program (STOP), which targeted fund ing at both "unserved" and "underserved " areas, defin ing both terms too broadly. As a result , the program funded many projects that overbuilt existing broadband infrastructure. Indeed, at times , STOP dollars may have been used to overbu ild faci lities already being subs idized by other government programs, like the E-Rate program or the Agricu lture Department 's Rural Utility Service programs . Fortunately, there is a solut ion. We support an approach that places responsib ility on the FCC to disperse any new broadband dollars through its Connect America Fund (CAF) and Mobil ity Fund (MF) programs. These two programs, as further refined in two orders adopted by the FCC last month, provide clear evidence that the Commission has the expertise and the tools to manage a data-driven process that will ensure that any incremental broadband funding is directed where broadband does not currently exist and is needed the most. Let's exam ine the virtues of the FCC's approach. First, the FCC programs narrowly target spec ifically-defined "unserved" areas. The CAF II auction will include approx imately 307,000 census blocks and 1.5M customer locations across all 50 states where price cap carriers declined the 2015 CAF money, as well as areas not part of the CAF II auction but designated "extremely highcost" or "high-cost" but lacking 10/1 mbps service. For the MF II auction, the target is areas that lack 4G LTE service with "a minimum advertised download speed of at least 5Mbps. " These specific definitions ensure that dollars are efficiently targeted to where they are truly needed and that they are not spent overbuilding areas where broadband currently exists . In both programs , the FCC develops the list of eligible areas based on Form 477 data - which is filed and updated regularly and certified by all carr iers. Is the Form 477 data perfect? No, of course not - the rules and techniques for measur ing and report ing broadband coverage are still evolving. But the data set represents exactly the type of detailed service information on which deployment dec isions should be based . And after AM PVERSIGHT FCC-18-0326-A-000001 eligible areas are identified, the FCC conducts a data challenge process to further refine the areas targeted for support. This process allows all parties to update or correct their own filed data (for example, to demonstrate coverage where it has been recently deployed) and/or dispute coverage claims of other providers (to show that coverage does not exist as alleged). Importantly, it will also allow state and local entities in areas that do not have broadband service to challenge what providers have filed. Moreover, the process is constantly improving. The FCC is currently seeking comment on how to further refine the challenge process to provide clear guidance to all parties on defined terms, submission requirements and clear standards for FCC decision making. When those refinements are finalized, the FCC’s process will yield the best data set currently available on the status of broadband deployment in America. This data-driven approach will ensure that programs that spend taxpayer dollars do so as efficiently as possible and target those areas that need the dollars the most. And to be sure, we believe it is dollars (not tax credits) that are needed to get the job done. Broadband service at a minimum of 10/1 mbps is now available from two providers in 91% of all developed census blocks in the United States. On the mobile side, 99% of the population now has access to a LTE network. These statistics make clear that CAF and MF dollars are going to the truly hard to serve and sparsely populated areas, where providers have not been able to make an economicallyviable case for infrastructure deployment. Tax credits alone will not attract the type of capital necessary to build out these areas or deliver broadband to the impacted communities. To be clear, current CAF II and MF II dollars are unlikely to be sufficient to complete the job of getting broadband deployment to all these remote areas. By our estimate, the $198M/year that will be made available through the CAF II auction is only 21% of the FCC’s own calculated deployment costs for all eligible areas. To address this, bids will be scored and ranked, regardless of geography, from lowest to highest with support awarded to winning projects until funding is exhausted. And we fully expect the budget to run out before all eligible areas are funded. But these programs are the best way to use available dollars and, importantly, these programs leverage private investment to the maximum extent possible by awarding funds to the bidder willing to get the job done at the lowest cost. It’s a true public-private partnership. There is one final way that the FCC’s programs excel. Any program should be technology neutral – supporting both wireless and wireline broadband, in all its forms. Fiber builds are great where they make fiscal sense but, unless these programs suddenly get unlimited budgets, fiber is not feasible in many of these remote areas. In many places, a wired 10/1 mbps service or a LTE build may be the only viable broadband solution for the community. Unlike the BTOP programs, which had rules that skewed toward specific technologies, the FCC’s programs support broadband in all its forms and are designed with the single-minded focus of getting quality broadband to the areas the market is not reaching. If Congress is looking for a data-driven, efficient and effective mechanism to disperse newly allocated broadband dollars, it need look no further than the experts at the FCC. Congestion caused some calls to fail or be abandoned. • Service was restored and declared all clear shortly before 1Opm (Eastern). • Initially believed to be a nationwide outage, subsequent reports indicated that the primary impacts were in AT&T's Northeast, Southeast, and Central regions. • AT&T provided notifications to all PSAPs nationwide regarding this outage. • The Root Cause Analysis of this outage has not yet been completed, but it is believed that the outage was caused by a scripted configuration change to a pair of AT&T routers. • VoLTE 911 Service was fully restored when the issue was identified and the provisioning change reversed (again, shortly before 10pm (Eastern time). I sudden ly found myself without basic transportation in Los Ange les. The logistics of getting to school and work became quite challenging, forget about attempt ing a doctor's appointment or a socia l event. I became a slave to bus schedu les and favors from friends. And, contrary to the admon ition in the Missing Persons ' song that was popular at the time, I walked in LA. After six months, I scraped together enough money to buy a fr iend's 10-year-old dented Subaru min i-wagon. I loved that car as if it was a Cadillac. To this day, I remember my first day in the car driving down Santa Monica Boulevard feeling an enormous sense of freedom and opportun ity. I learned that transportation in LA was not a luxury - it was a necessity. This week, the FCC will cons ider two items central to delivering broadband - the 21 st century necessity- to rural commun ities that have been left beh ind. That these items are moving forward quickly is no surprise given Chairman Pai's enduring commitment to closing the digital divide, particularly in rural Amer ica. The FCC's Connect America Fund (CAF) and Mobility Fund Phase II (MF II) programs represent the best and perhaps only path to broadband deployment in these rural communities. And the MF II item now on circulation appears to take huge steps toward the adoption of a clear and fa ir framework that will increase both the efficiency and effectiveness of the program. But the hard fact is that there are clear limits to the amount of subsidy money available in both programs , and tough policy cuts w ill need to be made on the breadth and scope of the services that will ultimately be delivered to these communities. Let's cons ider first the MF II program, which will subsid ize the delivery of LTE service to areas where it does not current ly exist. As we understand it, the FCC has smartly pivoted toward assessing required LTE coverage based on geography, ensuring that winning bidders cover not only population centers , but also the various locations where commun ity members work, farm, visit fami ly and fr iends , and the points in between. AT&T's preliminary budget estimate is that the available fund dollars w ill support an LTE build to only 70-80% of the aggregate geography of the program 's elig ible areas. Yet the current proposed framework would require winn ing providers to cover an average of 90% of the geography that the provider w ins in a state, with no individual census track falling below 75% coverage. While such a coverage requirement is certainly laudable , it will come with a significant price tag and will likely push bidders away from census tracks with extreme ly sparse populations or tough topography, particularly because our prel iminary analysis suggests that 40% of the potentially eligib le areas currently lack wireless serv ice of any kind. Consider, for example, a census block where 50% of the area is covered by unpopulated mountainous terrain. Such a block could be deemed unbiddable, as efforts to reach 75% geographic coverage would be enormously AM PVERSIGHT FCC-18-0326-A-000007 expensive and, to meet the 90% aggregate requirement, other blocks in the state would have to be built to 100%. Moreover, stretching coverage requirements too far could exhaust available support dollars short of coverage for all eligible areas. If census blocks remain unbid because of coverage concerns or budget constraints, communities in those census blocks may be permanently left behind. But it is not just coverage decisions that are critical. In the CAF II item, the FCC also will need to decide how to weigh bids for varying service levels, from a basic service of 10 Mbps/down to Cadillac services with gigabit download speeds. The current proposal skews toward favoring fiber-fed services that will deliver gigabit speeds. Again, we do not fault the FCC for wanting to deliver gigabit speeds to rural communities. But setting weights that favor 1 Gig deployments will leave more than half of eligible consumers untouched by CAF II support and with little hope of being served in the future. A weight range such as USTelecom’s 0/5/15/20 acknowledges that speed has value without losing sight of the importance of coverage and cost effectiveness. Finally, for these auctions to be successful, participants must know what their service obligations are before they bid and certainly before they build. While the FCC has recognized the importance of clear and defined requirements, its current CAF rules still fall short. Specifically, the FCC subjects certain providers, which will include certain CAF II auction bidders, to an “evolving” usage standard. Evolving standards are moving targets for network builds and the FCC should end the use of evolving standards for all its CAF programs in its CAF II auction order. There is a reason why, year after year, the Toyota Corolla is one of the best selling cars in America. It’s no Cadillac, but it fulfills essential transportation needs at an affordable price. The communities targeted by these two programs deserve our best efforts to deliver them essential broadband services that will allow them to connect to the world around them, even if at 10-25 Mbps speeds. Indeed, Chairman Pai has already initiated some important process reforms and we antic ipate that more are coming. Clearer and more transparent processes will lead to better regulatory results. We have also been contemplating reform, and will, from time to time, be posting our ideas for regulatory and structural reform at the FCC. We start with some ideas for reforming process at the Enforcement Bureau - a Bureau that operated for many years with professional ism but whose recent practices have been marked increasingly by bad process, novel and tenuous theories of liability , and Notices of Apparent Liability (NALs) that languish after adoption. There are a number of areas where we believe the enforcement process can and shou ld be sign ificantly improved: Rulemaking via Enforcement: The Bureau recently has used enforcement actions to create substantive requ irements that have not previously been articulated or formally adopted by the FCC. Concerns about th is practice have been voiced by many in the industry as the Bureau offered strained and novel readings of FCC rules that were often at war with longstanding communications concepts. Establishing substant ive requ irements within the context of an enforcement action runs counter to accepted notions of due process and fundamental fairness and should be avo ided. This pract ice is particularly dangerous because parties to enforcement act ions often feel pressure to settle to avoid litigation costs. If the matter is settled , the new requ irements become enshr ined and apply not on ly to the parties that were subject to the enforcement investigation , but also to everyone else in the industry. In the privacy context , an entirely new class of protected informat ion was fashioned in a NAL against two small companies despite the fact that , in 16 years of FCC precedent , the information at issue had never been considered "protected." When the companies settled the dispute for a relatively small sum , new obligations emerged without the requis ite notice and comment period requ ired by the Administrat ive Procedure Act (APA ). The new requirements were then referenced in the FCC's privacy rulemaking as settled law. Continuing and Enhanced Liability: Section 503 of the Telecommunications Act requ ires the Commission to take enforcement action within one year of an alleged violation. To circumvent this one-year deadline, the Bureau adopted increasingly aggressive theories of "continu ing" liability where the Bureau concluded that a party's fa ilure to address an alleged incident of misconduct could be deemed a "cont inuing violation," extend ing the agency's reach back to the first alleged violat ion date even if that original date far exceeded the one year statute of limitat ions - an approach that effectively neutered any limitat ion at all. This approach was endorsed in a February 2015 Policy Statement , which was never subject to APA notice and comment, and which is currently being challenged by CTIA, UST A, NCT A and COMPTEL in a petit ion for recons ideration ,. Similar ly the Bureau has repeatedly relied on enhanc ing factors to drive proposed penalt ies to stratospheric levels - even for mundane administrative violations and for issues aris ing from third-party conduct. Regulated AM PVERSIGHT FCC-18-0326-A-000013 companies should not be subject to extreme and multiplied penalties when they took reasonable and appropriate steps to comply with the law and the Commission should provide more detailed guidance on when enhanced penalties are appropriate. Enforcement without End: The Bureau has also adopted the troubling pattern of rushing to judgment on NALs – which are released with much press fanfare – but then failing to convert those NALs into final forfeiture orders. Half-baked and incomplete investigations should not move forward to NALs. To prevent this, the Bureau should be required to apprise the subject of an NAL of the specific claims that will be made against it and give it an opportunity to respond before the NAL is issued. The Commission should also refrain from turning NALs into press events. An NAL is a Notice of Apparent Liability – not an adjudication of actual liability. To ensure that NALs are timely resolved, the Commission should establish a hard deadline for issuance of a forfeiture order once a NAL has been released. Parties have only 30 days to file an opposition after receiving a NAL. The Bureau should then be required to resolve the matter either through settlement or formal circulation of a final forfeiture order within six months of receiving the opposition. If the inquiry is not formally resolved within that time frame, the inquiry should be deemed dismissed by operation of law, and the Bureau should be required to issue a Public Notice announcing the dismissal. Such an approach would encourage investigatory discipline before a NAL issues and would give parties clarity on process after they have presented their public opposition. It would also discourage the issuance of NALs that are lacking in merit. Reform in these areas will lead to better processes, better investigations and better results.
