STATE CRASH NARRATIVE: VEHICLE #1 WAS WESTBOUND ON A GRAVEL TOWNSHIP ROAD BEING PURSUED BY LAW ENFORCEMENT. DRIVER #1 ATTEMPTED TO DRIVE OFF INTERSECTION ONTO A PRAIRIE TRAIL. THE VEHICLE IMPACTED WITH THE BOTTOM OF THE DITCH, PROCEEDED WESTBOUND AND CAME TO REST IN A SHELTERBELT OF TREES, FACING WEST. DRIVER AND PASSENGER FLED FROM THE SCENE ON FOOT. UNKNOWN SPEED AT IMPACT. VEHICLE SUSTAINED DAMAGE TO FRONT, UNDERCARRIAGE, RADIATOR, AND THE ENGINE ASSEMBLY. THE REAR SEAT PASSENGER STRUCK THE REAR OF THE PASSENGER SEAT AND RECEIVED A MINOR INJURY TO HIS HEAD. CASE SUMMARY On 07/04/2005 I was patrolling southbound on ND Hwy 1 just south of Hannaford when I noticed a northbound vehicle traveling extremely fast. I activated my radar, which indicated a target speed of 96 miles per hour, the radar was functioning properly and I I identified the vehicle received a solid tone. My patrol speed was miles per hour. ?ns ?Ii Narrative for of?cer: Pederson, Eric J. as a Sebring convertible. I activated my emergency lights and video system, turned around, and drove northbound after the vehicle. When I reached the top of the Hannaford Overpass I saw a dust cloud and spotted the vehicle heading east on a city street. I drove 'gin the city street and then followed the vehicle south across the railroad tracks and onto a very wet and muddy prairie trail that is along the perimeter of the sewage lagoons. The vehicle was obviously attempting to elude me. I contacted State Radio, advised them of the situation, and asked them to locate backup units. we drove south approx l/8 mile, then west on the prairie trail approx 1/8 mile and then came back onto Hwy 1. weather was partly cloudy, with no wind or precipitation. I had just finished fueling in Hannaford prior to leaving on Hwy 1 and noticed that Main Street was empty at that time. I followed the vehicle northbound on Hwy 1 through Hannaford, I activated my siren as I drove through town. The suspect vehicle was approx 1/2 mile ahead of me when I reached the north edge of town, it was accelerating rapidly. I pursued the vehicle northbound on Hwy 1. my speeds exceeded 125 miles per hour. we met two oncoming vehicles while on Hwy 1. No other vehicles were encountered during the entire incident. I was gaining on the vehicle when it turned westbound on a gravel road approx 3 miles north of Hannaford. At this point Griggs CO Deputy Terry Grey advised me that he was responding from the north. Deputy Grey unsuccessfully attempted to contact Deputy Robert Hook from Hannaford to assist me. I pursued the vehicle westbound on the gravel road, my speed was between 70?85 during this time. we then turned southbound on another gravel road for approx 2 miles before turning westbound again. I continued to pursue the vehicle westbound on the gravel road. I slowed my speed down due to very soft, loose road conditions. I could see the taillights and dust being kicked up by the suspect vehicle. Trooper Niewind was now responding from the Sanborn area. Approximately 3 miles after we turned westbound I lost sight of the vehicle and dust cloud. I was approx 1/3 mile behind the vehicle at this time. I came to a intersection and did not see the suspect vehicle. There were 2 farmyards at the intersection. I drove south on "Roberts Road" and advised State Radio that I had lost the vehicle and was calling the pursuit off. I turned back to the north and shut off my emergency lights. I saw several individuals waving at me from the farmyard north of the intersection. I drove down the driveway. A male subject who identified himseld as Justin Campbell advised me that the vehicle had gone straight at the intersection out towards the pasture. I then noticed an impact mark in the ditch caused by the suspect vehicle becoming airborne and striking the ground. There was also some vehicle debris, including the front license plate, in the impact area. I drove west from the impact point on a prairie trail approximately 100 yards and located the suspect vehicle in a shelterbelt. The vehicle was a silver/tan Sebring convertible with ND plate I drew my handgun and approached the vehicle, which was unoccupied. I contacted State Radio and Deputy Grey and advised them of vehicle's location. I noticed fresh, wet blood in the passenger side rear and front seats of the vehicle. There was also blood on the outside of the vehicle on the passenger side. A registration check identified the owner as Dan wogsland. I secured the keys from the vehicle. The headlights were off. I returned to the Campbell farm and asked the residents to take the keys out of their Narrative for of?cer: Pederson, Eric J. vehicles. They stated that their horses had become disturbed. I walked around the corral, but did not locate anyone. Deputy Grey arrived at the scene. He unsuccessfully called Deputy Robert Hook to assist us in the search. I contacted Tpr. Niewind and advised him to respond to my location with K9 Raven. Deputy Grey informed me that Deputy Hook's wife had advised him that Dep. Hook was with Dan wogsland and she was unable to contact him. Dep. Grey also advised me that Sheriff Hendricksen was enroute to assist. Trooper Niewind arrived and we unsucessfully attempted to track the occupants with the assistance of his K9. The vehicle was photographed, searched, and impounded by Gille Auto from valley City. Statements were taken from the witnesses to the crash. Trooper Niewind and I searched all of the out buildings on the Campbell Farm. Nothing was found. I drove to the Hook residence in Hannaford and spoke with Robert Hook's wife Kim at approx 00:10. I advised her what had transpired and answered questions she had. She told me that she had not spoke with Robert since he left with Dan Wogsland around 17:00. I gave her my card and asked her to have Robert call me as soon as he came home. Trooper Niewind and I searched unsuccessfully in Hanaford for ngsland and Hook. I later went to the Wogsland residence in walum, there was no one there. At approx 01:30 I was contacted by Sheriff Hendricksen. He advised me that Robert had called home and told his wife that he was alright, but didn't give his location. I left the area and drove to Jamestown. I impounded'Wogsland?s cell phone from the vehicle. At approx 03:20 it rang. I answered it. The Caller ID registered the call as coming from Robert Hook's number. On 07/05/2005 at 0900 I received a call from Robert Hook. He advised me that both himself and Dan Wogsland had gotten home safely. He stated that he had been driving during the pursuit. He offered to provide a written statement and meet with me. I had him fax the statement to the Jamestown HP Office. we later set up a meeting for that afternoon. At approx 0940 I received a call from Dan ngsland inquiring about the status of his vehicle. I advised him that it had been impounded and that I would need to meet with him prior to it being released. An estimate of the vehicle damage due to the crash came to $2800. A faxed copy of Robert Hook's statement was received at the Jamestown Office at approx 11:03 At approx 13:00 Captain Nygaard interviewed Robert Hook at the Jamestown Pistol Range. I was present as a witness. Hook acknowledged his Miranda Rights and signed a Statement of Rights form. (SEE NOTES FROM INTERVIEW) Deputy Hook also signed his written statement in our presence . At approx 13:45 Captain Nygaard interviewed Dan ngsland at the Jamestown Pistol Range. I Narrative for of?cer: Pederson, Eric J. was present as a witness. Wogsland acknowledged his Miranda rights and signed a Statement of Rights form. (SEE NOTES FROM INTERVIEW). wogsland had fresh scabbing on the bottom of his nose, which appeared to be swollen. The pursuit was recorded on videotape. END OF REPORT Sgt. Eric J. Pederson NDHP 286 Narrative for of?cer: Niewind, Bryan J. On 07/04/2005 at approximately 9:40 pm, State Radio broadcast a call for assistance. They advised Sergeant Eric Pederson (NDHP 286) was in pursuit of a vehicle in the Hannaford area and needed assistance. vehicle was described as possibly a silver Sebring convertible. I responded from MP 273 on 1?94. While enroute, Sergeant Pederson advised he was calling off the pursuit because he had lost contact with the vehicle. I continued to head in his direction. A short time later, Sergeant Pederson advised he had found the vehicle in a shelterbelt, but the occupants had fled on foot. Sergeant Pederson requested for me to continue in his direction. Upon reaching the scene I was met by Sergeant Pederson. Deputy Terry Grey was also on scene near the suspects car. Deputy Grey advised the vehicle belonged to Dan WOgsland. Deputy Grey also advised that Robert Hook, Griggs County Deputy, was with Dan ngsland that evening. K-9 Raven was deployed to to do a track of the occupants of the vehicle, Raven began to track to the south through the shelterbelt, but eventually lost the track. Raven was placed back in my squad. Tow truck was now on scene. I assisted Sergeant Pederson with an impound form of the vehicle. vehicle was then towed away. Sergeant Pederson and I then drove around the area and in the city limits of Hannaford attempting to locate the two individuals involved in the pursuit. we were unsuccessful. Sergeant Pederson remained in the Hannaford area and I left. On 07/05/2005 I had Brent W?ndel from wendel Auto Body in valley City do a estimate on the amount of damage on Mi. Wogsland's vehicle. He estimated the damage as approximately $2800.00. I also took photographs of the blood spots on the vehicle. Video system not operating at time of incident.
