Dear Sheriff Rice:

i have reviewed all the materials provided to me on October 9, 2018 by the Oklahoma
State Bureau of investigation, which included the Prosecution Report as well as 3 discs in
relation to the investigation of the officer involved shooting involving Ethan Mulkey of the
Okmulgee County Sheriff?s Office.

Based on my review of this information, it is my opinion that the officer involved shooting
in this matter was justifiable pursuant to 21 0.8. 732 (3). The facts submitted indicate the use
of deadly force in this incident was required to prevent death and/or serious bodily injury to
Deputy Mulkey. Therefore, based on this finding, this Office is declining to file any charges in
this matter.
