City of Bellevue Police Department MEMORANDUM Ci Ty 4'/3nl\ Date: January 7, 2013 To: Major John Manning From: Chief Linda Subject: Formal Standards Investigation 12-004 Discipline: Demotion to Lieutenant Last Chance Notice for any sustained similar policy violations On November 30, 2012, I informed you of my proposed findings and proposed discipline in Formal Standards Investigation 12-004. On December 20, 2013, I held a Loudermill Hearing for you to present any information you believed I should consider before making my final decision. You attended the hearing as did Deputy Chief Baker, Legal Advisor Kyle Aiken, Bellevue Police Management Association President Jerry Litzau, and your attorney, Judith Lonnquist. Afier consideration of your presentation and the presentation' by your representatives and the entire investigation, I have decided that I have no valid choicez other than demoting you to Lieutenant and informing you that this is your Last Chance. If you have similar sustained policy violations, I will pursue termination. I am imposing this discipline because of the following sustained violationsof the Bellevue Police Department Policy and Procedure Manual: 1 0.110 COND TTO ARD PER I DI ATE AND ASS 1. Employees, both on and off--duty, shall avoid associations which compromise the integrity or operations of the Bellevue Police Department. This rule shall not apply to associations occurring in the performance of official duties. 1 At the hearing, you and your attomey declined to provide specific responses to some questions raised during the hearing. I therefore directed the investigators to conduct further investigations. 1 have considered this additional information which is now part of the investigative file. 2 At the hearing, your attomey submitted that proper discipline would be a letter of reprimand and a brief suspension. 2. Tlie Bellevue Police Department believes that it is in the em.ployees' and the Department's best interest to keep business and professionalrelationships separate from personalrelationships. it is imperative that the Department strive at all times to prevent the reality or appearance of impropriety. Supervisors might create the perception of a conflict in their professional responsibilities if they directly supervise a subordinate with whom they have a marital, domestic partnership, familial, or dating relationship (Relationship). 3. The Bellevue Police Department will not knowingly assign employees who are family members, spouses, domestic partners or in a dating relationship to work assignments where one employee will directly supervise, appoint, remove, discipline the other or where one employee will evaluate or audit the work of the 5. If a relationship arises or exists between a supervisor and a subordinate as described in 3 or will exist with the appointment, reassignment or transfer of a supervisor or subordinate, the parties involved shall immediately notify the appropriate Deputy Chief. Failure to report such a Relationship may subject the involved employees to discipline. 11 .00.24O JUDGMENT RESPONSIBILITIES Employees will,at all times, exercise caution and good judgment. Employees will observe safe practices in the discharge of their duties to avoid injury to themselves and others, or unwarranted damage to property and equipment. I am entering a finding of non-<
