STATE OF FLORIDA OFFICE OF THE GOVERNOR EXECUTIVE ORDER NUMBER 18-365 (Executive Order of Suspension) WHEREAS, Scott Maddox is presently serving as a City Commissioner for the City of Tallahassee, Florida, having been reelected by the voters of the City of Tallahassee in 2016 for a four-year term; and WHEREAS, on December 11, 2018, the United States Attorney for the Northern District of Florida charged Scott Maddox by Grand Jury indictment with Racketeering Conspiracy in violation of 18 U.S.C 1962; two counts ofBank Fraud in violation of 18 U.S.C. 1334; multiple counts of False Statements to a Financial Institution in violation of 18 U.S.C. ?1014; multiple counts of Extortion Using Fear of Economic Harm and Under of Color of Right in violation of 18 U.S.C. 1951 and 2; two counts of Honest Services Wire Fraud in violation of 18 U.S.C 1343, 1346, and 2; one count of Travel Act in violation of 18 U.S.C. 1952(a)(3) and 2; two counts of False Statements in violation 18 U.S.C. 1001(a)(2); one count of Conspiracy to Defraud the United States in violation of 18 U.S.C 371; and multiple counts of Making False Statements on a Tax Return in violation of 26 U.S.C. 7206(1); and WHEREAS, violations of the statutory sections enumerated above constitute felonies and misdemeanors under the laws of the United States; and WHEREAS, Article IV, section 7(0) of the Florida Constitution provides that the Governor may suSpend from of?ce any elected municipal of?cer who is indicted for a crime; and WHEREAS, section Florida Statutes, provides that the Governor may suspend from of?ce any elected municipal of?cer who is indicted for the commission of a federal felony or misdemeanor; and WHEREAS, it is in the best interests of the residents of the City of Tallahassee, and the citizens of the State of Florida, that Scott Maddox be immediately suspended from the public of?ce which he now holds, upon the grounds set forth in this executive order; NOW, THEREFORE, I, RICK SCOTT, Governor of Florida, pursuant to Article IV, section 7 of the Florida Constitution and section 112.51, Florida Statutes, ?nd as follows: A. Scott Maddox is, and at all times material was, a member of City Commission of the City of Tallahassee, Florida. B. The of?ce of City Commissioner of the City of Tallahassee, Florida, is within the purview of the suspension powers of the Governor, pursuant to Article IV, section 7(0) of the Florida Constitution and section 1 12.51, Florida Statutes. C. The attached indictment, which is incorporated as if fully set forth in this Executive Order, alleges that Scott Maddox committed felonies and misdemeanors under the laws of the United States. BEING FULLY ADVISED in the premises, and in accordance with the Constitution and the laws of the State of Florida, this Executive Order is issued, effective today: Section 1. Scott Maddox is suspended from the public of?ce, which he now holds, to wit: member of the City Commission of the City of Tallahassee, Florida. Section 2. Scott Maddox is prohibited from performing any of?cial act, duty, or function of public of?ce; from receiving any pay or allowance; and from being entitled to any of the emoluments or privileges of public of?ce during the period of this suspension, which period shall be from today, until a further Executive Order is issued, or as otherwise provided by law.
