While being incarcerated at the ACI this officer was found to have participated in the smuggling of a controlled substance by a friend. The officer refused and was immediately suspended for refusing a direct order. The order to submit to drug testing was continuous and every day that the officer failed to comply was considered a separate violation for which he was suspended for a total of 39 days suspension without pay. He was assisted by two civilians/friends who were also arrested and subsequently convicted. As a result of this allegation an investigation was initiated, which led to this officer being arrested and charged with two counts of simple assault. A trial was held at the District Court level and as a result this officer was found guilty of two counts of assault. An appeal was filed and a second trial was held at the Superior Court level in 2005 and as a result the officer was found guilty of one count of simple assault, sentenced to 1 year probation and ordered to pay a $500.00 fine. The officer was the presented with Bill of Rights charges and on March 7, 2006, as a result of the panel’s decision this officer’s employment was terminated. The theft involved the taking of property from a citizen and converting this property to his own use and not turning it in as required. This officer was convicted after a jury trial in May of 2004. The officer appealed his conviction to the Supreme Court and on June 8, 2006, the conviction was affirmed. San Lucas Ptlm. unable to provide him with an articulable explanation of this incident. A supervisor on scene reported Ptlm. appeared to be intoxicated on the scene. (378) Ptlw. 200.8 Duty Responsibility Written Reprimand 200.9 Performance of Duty On April 18. 2017 Ptlw. was dispatched to 233 Weybossett Street for a report of larceny of rims and tires ?om a motor vehicle parked in 1e Central Parking Garage. In completing her ?eld report. she failed to docrunent that there was video sruveillance of the incident. which could have been useful in solving this or related crimes. Lt. San Lucas has documented in detail that the garage manager and complainant both infonned her that there was video surveillance available however she neglected to put this information into her report. Fmthennore when Lt. San Lucas attempted to contact the complainant he found that Ptlw. - had recorded his telephone number incorrectly. Ultimately Lt. San Lucas himself had to follow up on this report and supplement the report. Lt. San Lucas cites two other reports where Ptlw. has completed substandard reports. (385) General Order 520.03 - Social Media/Internet Policy On July 24t l. .. at approximately Commissioner Steven Pare alerted Colonel Hugh Clements that Of?cer '5 Face Book page stated that his job is ?picking up garbage in the City of Providence?. Through the course of the investigation it was determined the occupation ortion of Of?cer- ?5 Facebook page stated he ?works at picking up garbage in the City of Providence?. Of?ceri was contacted by the Of?ce of Professional responsibility and immediately removed the occupation section of his Facebook page. Ptlm- was suspended one day. removed from S.R.U. and reassigned to the Patrol Blu?eau. (386)_ 4 counts Breaking and Entering CCR 16-36196 Terminated Guilty Plea 4 counts Receiving Stolen Goods 73 On 4/15/16 members of the Providence Police Office of Professional Responsibility received a complaint from Distribution Services of Rhode Island located at 135 Harris Avenue, Providence. This business is an independent contractor for home delivery of the Providence Journal newspaper. The complaint involved larcenies that were occurring related to materials for home distribution of the newspaper. On 4-22-16 at approximately 0530 hours, member of the Office of Professional Responsibility set up surveillance at the above location. At approximately 0610 hours, police observed RI combination reg. , a 2006 red Ford F150 pickup, registered to , pull up to the address on 135 Harris Ave. made entrance into the secured building, and several minute later, left with an undetermined amount of newspaper inserts. left the area and was halted by members of the Office of Professional Responsibility, and apprehended without incident. was charged with 3 addition counts of Breaking and Entering and Larceny. (387) Part II, Section 200.5 Standard of Conduct Part II, Section 200.6 Rules Governing Conduct 1 day suspension On August 19, 2017 at approximately 0100hrs Ptlm. was involved in an incident while off duty at the Yellow Kittens Tavern in New Shoreham Rhode Island. He acknowledged getting into a verbal argument with a bartender over an incorrect drink. He states that he tugged at the bartender's shirt. The owner of the establishment indicates that it was reported to her by a staff member present at the time, that took a swing at a bartender and either missed or grazed him. resistant when the staff asked him to leave and because it took a while to get him to leave they contacted the police. He was briefly detained by the New Shoreham Police. It was determined that no one wished to pursue charges, but the establishment wanted him removed from the premises and the officer transported him from the establishment to his accommodations. New Shoreham Police Chief Vincent Carlone confirms that there was an incident at Yellow Kittens on the above referenced date and time. It was later discovered that he did not have enough time accrued in his bank to take a sick day. It was further determined that Sgt. intentionally interrupted the acknowledgments in an effort to disrespect Major . 2. On October 7, 2017 Sgt. took a furlough day off from his assigned shift. It was later determined that he had no available furlough time in his bank. 3. On October 14, 2017 Sgt. arranged for Civilians to be present inside the Mounted Command and interact with the animals without proper authorization to do so. During this time he stated that he may have sent her upwards of a dozen luisolicited nude photos of his genitals along with inappropriate messages. He stated that when she told him to stop sending them he complied and admitted that he knew that the photos he sent made her uncomfortable. He stated that when she would reinitiate contact with him he felt as though she was uyin to recomlect with him and therefore began sending nude photos of his genitals to her again.
