Managing Partner, CME Associates T he Township of Aberdeen authorized CME Associates to perform design, permitting, and construction administration services for the Duda Lane Stream Restoration project in response to multiple complaints by affected residents. The project was designed to stabilize the severely eroded stream channel bottom and banks of the unnamed tributary to the Mohingson Brook, to prevent future erosion. Prior to the implementation of the project, erosion had created bank cuts up to 15 feet high, which had migrated into the rear yards of five (5) homes on Duda Lane. These extreme banks threatened to undercut and destroy several storage sheds and at least one of the residences where, in one area, the top of bank had migrated to approximately 15 feet from the structure. Erosion had already caused multiple mature trees to fall, thus presenting a safety hazard to the proximate properties and obstructing the channel. If left uncontrolled, erosion would have caused the stream bank to continue to migrate towards the existing homes and cause further property damage, loss of trees, safety hazard conditions, and property devaluation. process involved restoring the stream to its approximate original grade with compacted dense graded aggregate (DGA) and large boulders. At three separate locations, check-dams were constructed using gabion baskets and reno mattresses with scour holes on the downstream side. The bottom of the new streambed was also planted with water tolerant species and the side slopes were planted with willow branches for added stabilization, all in accordance with NJDEP design guidelines for stream restoration. The project required an Individual Stream Encroachment Permit from the NJDEP, which permit required multiple reiterations of hydraulic and structural calculations to demonstrate regulatory compliance for channel and check dam stability. The work was located within an unnamed tributary to Mohingson Brook, between a 36-inch diameter RCP discharging into the channel at the most upstream point, and a point located approximately 688 feet downstream. The construction of the redesigned park was completed on June 30th 2017, in time for the Borough’s Fourth of July Celebration and Veteran’s Field Park Grand Reopening Ceremony. The amenities constructed under the Veteran’s Field Improvement Project include: a Multipurpose Synthetic Turf Field Complex for Baseball, Little League, Football, Soccer and Lacrosse, a natural grass Softball Field, covered dugout area shade structures, Sports Field Lighting for all fields, an 18,000 square foot Playground with areas for children ages 2-5 & 5-12 and a central Spray Park water play feature, a Comfort Station with restrooms, A Great Lawn area for passive recreation, asphalt walking paths with pathway lighting, a picnic grove with grilling stations and picnic tables, an outdoor exercise equipment station area, water fountains, additional parking areas, a new electronic variable message park sign, several memorials, sitting areas, a clock tower and landscaping. Utilizing the former site of the Veterans Field this project reclaimed an important community park facility which was closed for many years and transformed this Hudson River park location into a new magnificent recreational facility for all of the pubic to enjoy. Mineo, PE, County Engineer, Union County (908) 789-3675 The existing bridge that carried Netherwood Avenue over the Green Brook in the City of Plainfield was a two-span, simply supported structure built in 1928 with concrete encased rolled steel stringers. According to the NJDOT SI&A Sheets in the 9th Cycle Bridge Re-Evaluation Survey Report and dated July 26, 2012, the maximum length span was approximately 26’-0”. The bridge was considered to be moderately skewed due to a skew angle of 15 degrees. The out-to-out normal bridge width was 56’-4”. The bridge cross section consisted of the following: two (2) concrete parapets; two (2) concrete sidewalks, each measuring approximately 8’-6” in width; and two (2) lanes of traffic within a curb to curb roadway width of approximately 36’-0”. According to the 9th Cycle report, the deck was in “serious” condition and exhibited severe concrete deterioration on the top and underside, with exposed, rusted transverse rebar with adjacent delaminated concrete. The concrete encased steel girders exhibited severe rust section loss of up to 1/8” of the exposed steel bottom flanges, which resulted in a “poor” rating for the existing superstructure. There were large spalls in both the South Abutment and the face of the pier which resulted in undermining of the corresponding stringer ends. As a result of these findings, the Overall Condition Rating of the bridge was “poor due to the conditions of the superstructure and substructure.” Due to the 2012 rating of 4 or “Poor Condition” given to the overall structure, the scope of this project was total bridge replacement. The replacement bridge was to be built in one stage since it was anticipated that Netherwood Avenue would be closed during construction. It was anticipated that the existing center pier would be eliminated, thus creating a single span bridge. Cast-in-place concrete abutments and wingwalls would be founded on spread footings bearing directly on shale. We anticipated the extent of the roadway improvements to be limited to that which was necessary to adequately transition the proposed bridge deck to the existing conditions on either side of the bridge. In accordance with the scope of services, we anticipated a limit of approximately 300 feet on either side of the bridge. We anticipated matching the existing roadway width of 34-feet +/- including curb and sidewalks along both sides within the project limits. We anticipated providing sidewalks across the new bridge deck and along the north side of the roadway where sidewalks previously existed along Netherwood Avenue. The roadway alignment and profile were designed generally to match the existing adjacent topography and to minimize disturbance to the adjacent properties. Where necessary, design exceptions were noted when the proposed roadway geometry did not meet NJDOT and AASHTO design standards. We anticipated the roadway would receive full depth excavation and the construction of dense graded aggregate base course, hot mix asphalt base course and hot mix asphalt surface course, where necessary, due to proposed grades and to transition to the proposed bridge deck. Hot mix asphalt pavement milling and the construction of hot mix asphalt surface overlay were to be provided, where appropriate. All proposed sidewalks within the project limits were designed in conformance with NJDOT and ADA design standards, as applicable to the proposed roadway reconstruction scope. Additionally, we anticipated providing individual details for the curb ramps within the project limits. Curb ramp details were prepared at a suitable scale to provide ADA conforming curb ramps and curb ramp transitions. Demolition of the existing bridge commenced in August 2017. Construction of the proposed bridge commenced in October 2017. CME provided Construction Support Services, including Construction Engineering Inspection, responses to RFIs and shop drawing reviews. The new bridge was opened to traffic in May 2018. Ettore, PE, County Engineer, Monmouth County (732) 431-7760 Project Status: 75% complete The Monmouth County Route 3 (Main Street - Tennent Road) project is approximately 2.8 miles long, beginning at the County Route 527 intersection and extending north to the Kensington Drive and Woodland Circle intersections in the Township of Manalapan, Monmouth County, New Jersey. Monmouth County completed a preliminary study of the Route 3 corridor. The County evaluated multiple improvement alternatives, including the no build alternative, and selected a preferred alternative satisfying the projects purpose and need while minimizing impacts to the environment and other resources. Based on that preferred alternative, preliminary design plans were developed. CME is currently developing the final design and bid documents for the proposed improvements based on the preferred alternative and the preliminary design. The purpose of this project is to relieve congestion and improve safety along the roadway corridor for motorists, bicyclists and pedestrians traveling along County Route 3 (Main Street – Tennent Road). The improvements consist of roadway widening and realignment, replacement of eight (8) bridge/culvert structures, the installation and/or reconstruction of five signalized intersections, reconstruction of an at grade railroad crossing, utility relocations, storm water management facilities, and the design of additional features appurtenant to the roadway improvements such as guide rail, curbing, drainage, and lighting. The preferred alternative improvements include widening of the subject roadway to provide a thirty-six foot wide typical section south of the Craig Road intersection, as per the County Scenic Roadway Plan, and a forty foot wide typical section north of the Craig Road intersection. These sections provide 12 foot wide travel lanes and either 6 foot or 8 foot wide shoulders. Project will require securing NJDEP individual freshwater wetland and flood hazard permit, comprehensive stormwater management assessment including the design of infiltration basins and swales, manufacture treatment devices and hardship waiver request, wetland mitigation assessment including onsite creation, offsite mitigation and purchasing of wetland credits, design of onsite riparian mitigation site and comprehensive state historic preservation office consultation. The project lies adjacent to the Monmouth Battlefield Historic District and several historically eligible properties. Metal detection surveys identified revolutionary war era artifacts potentially tied to the District. The CME Team is conducted comprehensive Phase 1 and Phase II Cultural Resources investigations and studies. The railroad was originally constructed on a trestle that was removed and an embankment constructed in its place to support the tracks. The project faced many challenges due to limited access at the site and the existing soil conditions. Soil borings performed on both sides of the tracks indicated more favorable soil conditions on the south side but, due to the limited access on the south side, the jack and bore operation had to be performed from the north side of the tracks. The poor soil condition required over 58 piles In May 2017, the Jersey City Municipal Utilities Authority be installed to support the shoring, the jack and bore (JCMUA) experienced a surcharged condition in the equipment, manholes, 72” casing pipe and 54” carrier manholes along Pine Street and discovered a blockage pipe. in the 54” brick sewer below the tracks. To determine the extent of the damage, an internal inspection of the existing brick sewer was performed that indicated the condition of the sewer was deteriorating and there was a build-up of debris. To maintain the operation of the collection system, the Authority installed a 2,500 lf pumped temporary bypass system to convey flow around the deteriorated sewer. The Authority’s contractor maintained the bypass throughout the duration of the project. With the bypass installed, the design for the restoration of the Pine Street sewer started. The Authority procured a contractor to perform investigations of the existing pipe to determine the feasibility of lining it. After determining that the pipe had collapsed, the Contractor began to replace the existing brick sewer under the railroad. The Pine Street Sewer Replacement Project included the construction of approximately 350 lf of new 54” gravity sewer, replacement of two existing 8 ft diameter manholes and the construction of a 180 lf 72” diameter steel casing pipe beneath the railroad. Centrifugally cast fiberglass reinforced polymer mortar (HOBAS) pipe was used for the sewer and installed into the 72” casing pipe. In addition to the design of the replacement sewer, an application was submitted to Conrail for the abandonment and filling with flowable fill of the existing 54” brick sewer and the installation of the new sewer beneath the tracks. Associates (CME) will submit invoices to Client monthly and a final invoice upon completion of services. Payment is due upon presentation of invoice and is past due thirty days from invoice date. Client agrees to pay a finance charge of one and one-half percent per month, or the maximum rate allowed by law, on past due accounts. In the event that the invoice is not paid voluntarily and promptly, and must therefore be referred to an attorney or agency for collection, the Client agrees to pay a collection fee equal to the actual attorney or agency collection fee incurred by CME. Overtime rates are applicable after eight hours Monday through Friday, and all day Saturday and Sunday, and charged at one and one-half times the quoted rate. Holidays are charged at two times the quoted rate. Expenses incurred for reproduction, postage handling, photographs and for services including subconsultants equipment and facilities not furnished by CME are charged to the Client at cost plus fifteen percent. Automobile travel may be charged at the current rate per mile allowed by the Internal Revenue Service.. Standard of Care - Services performed by CME under this Agreement will be conducted in a manner consistent with that level of care and skill ordinarily exercised by members of the profession currently practicing under similar conditions. Contaminated Material - It is understood that CME is not, and has no responsibility as a handler, generator, operator, treater or storer, transporter or disposer of hazardous or toxic substances found or identified at any site. Client shall undertake or arrange for, either directly or indirectly through other contractors, the handling, removal, treatment, storage, transportation and disposal of hazardous substances or constituents found or identified at any site. Utilities - In the execution of the work, CME will take all reasonable precautions to avoid damage or injury to subterranean structures or utilities. The Client agrees to hold CME harmless for any damages to subterranean structures which are not called to CME's attention and/or not correctly shown on the plans furnished. While CME will take all reasonable precautions to minimize any damage to the property it is understood by Client that in the normal course of some damage may occur, the correction of which is not part of this agreement. Client shall furnish or cause to be furnished to CME all documents and information known to Client that relate to the identity, location, quantity, nature or characteristics of any hazardous or toxic substances at, on or under the site. In addition, Client will furnish or cause to be furnished such other information on surface and subsurface site conditions required by CME for proper performance of its services. CME shall be entitled to rely on Client provided documents and information in performing the services required under this Agreement; however, CME assumes no responsibility or liability for their accuracy or completeness. CME will not direct, supervise or control the work of contractors or their subcontractors. CME services will not include a review or evaluation of the contractor's (or subcontractor's) safety measures. CME shall be responsible only for its activities and that of its employees on any site. Neither the professional activities nor the presence of CME or its employees or subcontractors on a site shall imply that CME controls the operations of others, nor shall this be construed to be an acceptance by CME of any responsibility for jobsite safety. Indemnification - To the full extent permitted by law, Client shall indemnify, defend and hold harmless CME and its subcontractors, consultants, agents, officers, directors and employees (herein collectively referred to as Engineer) from and against all claims, damages, losses and expenses, whether direct, indirect or consequential, including but not limited to fees and charges of attorneys and court and arbitration costs, arising out of or resulting from the services of work of Engineer or any claims against Engineer arising from the acts, omissions of work of others, unless it is proven in a court of competent jurisdiction that the Engineer is guilty of negligence or willful misconduct in connection with the services and such negligence or willful misconduct was the sole cause of the damages, claims and liabilities. Client agrees to indemnify and hold harmless Engineer from and against all claims, damages, losses and expenses, direct or indirect, and consequential damages, including but not limited to fees and charges of attorneys and court and arbitration costs, brought by any person or entity, or claims against Engineer which arise out of, are related to, or are based upon, the actual or threatened dispersal, discharge, escape, release or saturation or smoke, vapors, soot, fumes, acids, alkalis, toxic chemical, radioactive materials, liquids, gases or any other material, upon, in or into the surface or subsurface soil; water or watercourse; objects; or any tangible or intangible matter. To the fullest extent permitted by law, such indemnification shall apply regardless of the fault, negligence, breach of warranty or contract or strict liability of Engineer. This indemnification shall not apply to claims, damages, losses or expenses which are determined by a court of competent jurisdiction to be the sole result of negligence or willful misconduct by the Engineer of obligations under this Agreement. Limitations of Liability - CME's total liability to Client for any and all injuries, claims, losses, expenses or damages whatsoever arising out of, or in any way related to, this Agreement from any cause or causes, including but not limited to CME's negligence, errors, omissions, strict liability, breach of contract or breach of warranty, shall not exceed the total contract amount for the services provided by CME or $50,000, whichever is less. In no event shall CME be liable for consequential damages, including, without limitation, loss of use or loss of profits, incurred by Client or their subsidiaries or successors, regardless of whether such claim is based upon alleged breach of contract, willful misconduct, or negligent act or omission. Professional services rendered for a Client shall be provided for that Client. The Client is responsible for the proper operation and use of the subject facilities and/or report and nothing herein shall provide any rights to any third party. The Client, in authorizing CME to proceed, acknowledges that the professional responsibility is limited. Termination - This Agreement may be terminated by either party upon fourteen (14) days written notice in the event of substantial failure by the other party to perform in accordance with the terms hereof. Such termination shall not be effective if that substantial failure has been remedied before expiration of the period specified in the written notice. In the event of termination, CME shall be paid for services performed to the termination notice date plus reasonable termination expenses. In the event of termination, or suspension for more than three (3) months, prior to completion of all work contemplated by this Agreement, CME may complete such analyses and records as are necessary to complete its files and may also complete a report on the services performed to the date of notice of termination or suspension. The expenses of termination or suspension shall include all direct costs of CME in completing such analyses, records and reports.
